“arbitration” a form of alternate dispute resolution, Is a way to resolve dispute outside the
courts
Powers of an arbitrator
- Administer oath to the parties and witnesses appearing
- State a special case for the opinion of the court on any question of law
- Make the award conditional or in the alternative
- Correct in an award any clerical mistake or error from any accidental slip or
omission.
- Administer to any party to the arbitration such interrogatories as may, in the opinion
of the arbitrators or umpire, be necessary.
Power of court to modify award
- Where it appears that a part of the award is upon a matter not referred to
arbitration and such part can be separated from the other part and does not affect
the decision on the matter referred; or
- Where the award is imperfect in form or contains any obvious error which can be
amended without effecting such decisions.
- When the award contains clerical mistake or an error arising from an accidental slip
or omission.
