A First Information Report was lodged against Izhar by the Police Station X situated in

Islamabad under section 302 Pakistan Penal Code, 1860 for the death of Mr.Ali.

Izhar had three kids who all died because of cancers before they reached to the age of

majority. The youngest one that was boy died on 7 th October 2022.It was recommended

to the wife of Izhar, by a nobleman that if she wishes to have a future baby alive she

should go and take a bathe on the grave of your last kid who had been recently died.

Resultantly, on 8th October 2022 Izhar and his wife went at night time to the graveyard

where their recently youngest son grave was, with a twenty liter plastic cane full of

water.It was so dark in the grave yard.Mrs Izhar sat on the grave of his dead son and

her husband started pouring water on her. Mr.Ali appeared there from nowhere in the

graveyard, the accused Izhar attacked mr.ali with a bamboo stick causing him grievous

injuries, six sticks were hit on the head, five on each shoulder and seven on each

hand.As a result of these grievous injuries Mr.Ali died in a hospital on 11 th October,

2022.After causing grievous injuries to Mr. Ali, Mr. Izhar and Mrs izhar ran from the

scene toward their home. While running back toward their home they both were seen by

mr Mustafa and on asking by Mr.mustafa,both husband and wife informed Mustafa that

they have killed a ghost in the grave yard.

On the way back to home, Mr izhar also met junaid and qadir as stated in his statement

that I have killed the ghost in the graveyard. Both junaid and qadir went back to the

graveyard along with Mr Izhar and his wife to see the ghost. When they all reached

there to the graveyard it was discovered that it was mr ali lying there in a very serious

condition and about to die. He was taken to the hospital by junaid and qadir where he

later on died because of the grievous injuries on his head and body.

Mr Izhar again met with Mr. Mustafa and told him that it was actually not a ghost but it

was mr ali who was grievously injured by beating him at night. Mr Mustafa went to

inform the brother of mr.ali, whose name was Mr Zubair. Zubair first went to the hospital

and then reported the whole case by lodging an F.I.R in police station X situated in

Islamabad with jurisdiction for the above mentioned case against Mr.Izhar.
Discuss the above case as you are the lawyers of accused mr.izhar,to save him from

the punishment under section 302 ppc.High light the relevant issues and apply the

relevant section of laws to all those issues whether he is going to be liable for the

punishment under section 302 ppc for the deceased mr ali?

On 14th August, 2022, ten cows belonging to Yasin shah were stolen from village

chakwal. The next morning a group of seven people was form to track the theft cows

and this group included yasin shah as well. This group was successful to track out the

stolen cows, which were founded into another surrounding village some kilometers

away from Chakwal with a name of chak umra.The group of seven stopped in chak

umra and their leader Basit ali shah went off to the nearby police station to get the

assistance of the police but due to some unexplained reason Police station did not

provide Basit ali shah assistance for at least three hours and he had to wait in police

station for three hours. After three hours two policemen, gul baaz and jamshid were

accompanied with Basit ali shah toward the place where the stolen cows were roped off.

On arrival toward the place where Basit ali shah left their other six members to stay

there until I come with the assistance of police, as a surprise they were not there and

they moved by their own to recover the stolen cows where the other party of five

members who have stolen the cows resisted the group of six by physical force and a

fight took place between both the parties. Resultantly one person izhar was killed

belonging to the party who has stolen the cows by the gunfire of the group of six as the

group of six have guns with them. All the members of the group of six were charged in

F.I.R for the death of izhar. What Provisions of law should be included in the F.I.R and if

you all are the lawyers of the accused, for the group of six what would be your way of

strategy to acquit the accused person in this case scenario..?

Ali and Usman, who were on the sea trip in a small boat lost somewhere in the high

seas and thousand miles away from sea shore. The food and water which they both

had, was finished and they were starving for the last three days in the lost sea. There

was another boy Azaz of the age of sixteen years who was also lost in a storm and was
pushed to the high seas. Ali and Usman saved him and brought him to his own boat.

After seven days without any food and water Ali asked Usman who should be put to

death to save the life of the rest of us. After a thought they said it would be better to kill

azaz to feed on his flesh for a week and to save our lives. When they were killing azaz

there was no sign of relief or any other boat or sea ship to ask for assistance and

food.Ali and Usman also felt that if we do not kill azaz to feed on his flesh, we will die of

starvation.

Ali and Usman was charge under section 302/34 PPC,what possible plea ali and

Usman may take under the exceptions available to them under Pakistan Penal code,if

any and will they both be justifiable by taking any defence available to them in Pakistan

penal code under the chapter of exceptions.
