Khatian No. 343 comprised in Dag No. 37, Police Station Sonarpur, now within Rajpur Sonarpur Municipality, Ward No. 2, in the District of South 24 Parganas from it’s the then owner Himangshu Bhusan Mandal at and for a valuable consideration mentioned therein. The said Himangshu Bhusan Mandal also purchased the said land on 16.07. 1980 vide Deed No. 3362 for the year 1980 of Addl. District Sub-Registrar at Sonarpur, 24 Parganas(S). AND WHEREAS thus the said Smt. Shrabani Datta Chaudhury, by way of aforesaid purchase became the sole and absolute owner of the said land and while had been possessing, enjoying and occupying the said land free from all encumbrances, liens and attachments whatsoever nature or manner having good clear and marketable title therein, the said Smt. Shrabani Datta Chaudhury sold, conveyed and transferred her said all that piece and parcel of land measuring more or less 2 (Two) Cottahs, being plot No. P 8, at Mouja Dhalua, J.L. No. 43, Touzi No.1209, C.S. Khatian No. 215, RS. Khatian No. 343 comprised in Dag No. 37, Police Station Sonarpur, now within Rajpur Sonarpur Municipality, Ward No.2, in the District of South 24 Parganas unto and Sub-Registrar, Sonarpur being recorded in Book No.1 Volume No..1.& Pages fromasa7fo 5, ‘ SBS02006 et and for the valuable consideration mentioned therein. AND WHEREAS thus the present Vendor became the sole and absolute rightful owner all that piece and parcel of land measuring, more or less 2(Pwo) Cottahs being plot No. P 8, at Mouja Dhalua, J.L. No. 43, Touzi No,1209, C.S. Khatian No, 215, R.S. Khatian No. 343 comprised in Dag, No. 37, Police Station Sonarpur, now within Rajpur Sonarpur Municipality, Ward No.2, in the District of casing, er 1 South 24 Parganas and has been poss and occupying the said land free from all encumbrances, nature or manner liens and attachments whatsocv having good clear and marketable title therein the said land. AND WHEREAS now the Vendor herein being in urgent need of money for lawful purposes has offered to sell and the Purchaser herein has agreed to purchase ALL THAT piece and parcel of Land measuring more or less 2(two) in the District of South 24 Cottahs lying and situate Parganas, Police Station Sonarpur, Mouja Dhalua, J.L. No. 43, Touzi No. 1209, appertaining to C.S. Khatian No. 215 and R.S. Khatian No, 343, Dag No. 37, together with easement right of 12’ ft. wide now within the limits of the Rajpur Sonarpur Municipality, Ward No. 2. and which is more fully and particularly described in the Schedule hereunder written and specifically shown in the annexed Plan delineated with “RED” border , at and for 12,00,000/- (Rupees twelve lakhs _) only free from all encumbrances liens and the total consideration price of Rs attachments whatsoever nature or manner having good clear and marketable title therein . NOW THIS INDENTURE WITNESSETH that in consideration of a sum of Rs. 12,00,000/- Rupees twelve lakhs ) only paid by the Purchaser being agreed as the price of the property and the receipt whereof is being acknowledged by the Vendor as per memo of consideration hereunder written and the Vendor doth hereby and hereunder grant convey, sale, transfer, assign and assure all it’s estate and interest in the Land measuring more or less 2(two) Cottahs lying and situate in the District of South 24 Parganas, Police Station Sonarpur, Mouja Dhalua, J.L. No. 43, Touzi No. 1209, appertaining to C.S. Khatian No. 215 and R.S. Khatian No. 343, Dag No. 37, together with easement right of 12’ ft. wide now within the limits of the Rajpur Sonarpur Municipality, Ward No. 2. together with all easement right and right of 12’ ft. wide Road and other rights easement and benefits attached thereto the said land and which is more fully and particularly described in the Schedule hereunder written and specifically shown in the annexed Plan delineated with “RED” border with all appurtenances, together with all hedges, ditches, ways, waters, water courses, lights, liberties, privileges, easements whatsoever to the land described in the schedule hereunder to the Purchaser which is more fully described in the schedule hereunder written. AND ALL the estate, rights, title, interest claim and demand whatsoever of the Vendor into or upon the said land and every part thereof TO HAVE AND TO HOLD the same unto and to the use of the Purchaser absolutely and forever together with title deeds, writings, monuments and other evidences of title and the Vendor do hereby covenant with the Purchaser that notwithstanding any acts, deeds, things hereto before done, executed or knowingly suffered to the contrary the lawfully seized and possessed of the said encumbrances attachments or Vendor is now property free from any defect in title whatsoever and that the Vendor has full power absolute authority to sell the said property in manner aforesaid and the Purchaser shall hereafter peaceably and quietly hold, possess and enjoy the said property in khas without any claim or demand whatsoever from the Vendor or any person claiming through or under them. And further that the Vendor, its successors in office, administrators or assigns covenants with the Purchaser to save harmless indemnify and keep indemnified the Purchaser from or against all encumbrances, charges and equities whatsoever and the Vendor, its successors in office, administrators or assigns further covenants that M/s BIPNET TECHNOLOGY, the Vendor herein, shall at the requests and cost of the Purchaser do or execute or cause to be done or executed all such lawful acts, deeds, and things whatsoever for further and. more perfectly conveying and assuring the said property and every part thereof in manner aforesaid according to the true intent and meaning of this deed. The Vendor herein doth hereby covenant with the Purchaser as follows :- a) That notwithstanding any act deed matter or thing whatsoever heretofore done committed or knowingly suffered by the Vendor to the contrary the Vendor is lawfully and absolutely seized and possessed of or otherwise well and sufficiently entitled to the said property hereby sold , granted, conveyed, transferred, assigned and assured as an absolute and indefeasible estate or an estate equivalent of analogous hereto and free from all encumbrances and liabilities whatsoever. e b) ‘That the Vendor has full power and absolute and indefeasible right and authority to sell , grant, convey and transfer the said property and every part thereof unto and to the use and benefit of the Purchaser in the manner aforesaid and according to the true intent and meaning of these presents. c) That it shall be lawful for the Purchaser at all times peaceably and equitably to enter into and use hold and enjoy the said property and receive the rents issues and profits thereof without any eviction interruption hindrance disturbance claim or demand whatsoever from or by the Vendor or any person or persons having or lawfully or equitably claiming any estate, right , title and interest whatsoever from under through or in trust for the Vendor artd that free and clear and freely and clearly and absolutely acquitted exonerated and forever discharges or otherwise well and sufficiently indemnified of from and against all charges and encumbrances whatsoever made done executed or occasioned by the Vendor free and clear and freely and clearly and absolutely acquitted, exonerated and discharged from or by the Vendor or its predecessors in title and well and ded, kept harmless and sufficiently saved, ¢ indernnified of from and against all and all former or other estates, rights, title, interests, liens, charges and encumbrances whatsoever created made done occasioned ecessors-in-title or or suffered by him or any of his pred any person or persons rightfully claiming, from under or in trust for him. d) The said property is not affected by any attachment ificate cases or including the attachment under any Cel any proceedings started at the instance of any cs under the Public Dernand Government authori’ Recovery Act or otherwise whatsoever and that there are no Certificate Cases or proceedings pending for realization of arrears of Incorne Tax and other taxes or otherwise under the said Public Dernand Recovery act or any other Act for the time being in force and that the said property is not affected by any Notice of Scheme of the Land Acquisition Collector or any Authority or the Government or any other Public Body or Bodies and that no declaration has been made or published for acquisition of the said property or any part thereof under the Land Acquisition Act or any Act for the time being in force for acquisition of the said property. ©) The Vendor and all persons having lawfully or equitably claiming any cstate, right, title, interest, use, trust, property claim and demand whatsoever or into or upon or out of the said land under or in trust for it shall and will from time to time and at all times hereafter upon every reasonable request and at the costs of the ots) wer ts Supine (6 swans) Ae Purchaser me urchaser make do execute and perfect or cause to be made, done, executed and perfected all such further and other urances, acts, deeds, matters and things whatsoever for further better and more perfectly assuring, conveying and confirming the said property unto and to the benefit of the Purchaser forever in the manner aforesaid as the Purchaser shall or may reasonably required.
