EXECUTIVE ORDER NO. 361
SERIES OF 2018

"AN ORDER REQUIRING SHOPPING MALLS, RESTAURANTS, HOTELS,


HOSPITALS, AND OTHER SIMILAR BUSINESS ESTABLISHMENTS WITHIN
DAVAO CITY TO SUBMIT THEIR SEWERAGE TREATMENT PLANT DESIGN
PLANS AND TO DECLARE ALL SERVICE CONTRACTORS OR SUBCONTRACTORS
ENGAGED TO HANDLE THEIR ESTABLISHMENT'S CONSTRUCTION,
RENOVATION, MAINTENANCE, PLUMBING AND SEPTIC TANK CLEANING,
TERMITE AND PEST CONTROL HANDLING AND THE LIKE"

WHEREAS, Section 16 of Republic Act No. 7160, otherwise known as the Local
Government Code of 1991, provides that local government units (LGU) shall exercise
the powers expressly granted, those necessarily implied therefrom, as well as powers
necessary, appropriate, or incidental for its efficient and effective governance, and
those which are essential to the promotion of the general welfare;

WHEREAS, it is necessary for the City Government of Davao to enact measures in


order to promote its citizens' health and safety and enhance their right to a balanced
ecology;

WHEREAS, the Philippine Clean Water Act of 2004 (Republic Act No. 9275) encourages
all business sectors to use water quality management systems equipment, such as but
not limited to, wastewater treatment collection and facilities;

WHEREAS, it is imperative for the City Government to exert efforts in ensuring the
efficient and effective implementation of the State's environmental laws and exact
compliance to the same;

NOW THEREFORE, I, SARA Z. DUTERTE, Mayor of the City of Davao, by virtue of


the powers vested in me by law, do hereby order:

SECTION 1. REQUIREMENT. As part of the requirements for the renewal of Business


Permit, all shopping malls, restaurants, hotels, hospitals, and other similar business
establishments within Davao City must submit to the City Government of Davao, a copy
of the following documents:

1. Sewerage treatment plant (STP) design plans adopted by the establishments;

2. List of service contractors or subcontractors commissioned by the


establishments to provide services relative to construction, renovation,
maintenance, plumbing and septic tank cleaning, termite and pest control
handling and the like;

Likewise, all plumbing, septic tank cleaning, termite and pest control handling service
contractors, are also mandated to submit a certification stating the area where their
dislodging wastes are disposed.

SECTION 2. IMPLEMENTING AGENCY. The Permits and Licensing Division
(Business Bureau), in coordination with the City Engineer's Office (CEO), City
Environment and Natural Resources Office (CENRO), and City Health Office (CHO), is
tasked to ensure compliance of the abovementioned requirement.

SECTION 3. PROCEDURE. All requirements must be submitted to the Permits and


Licensing Division (Business Bureau) every year upon renewal of Business Permit.

SECTION 4. FUNDING. The Permits and Licensing Division (Business Bureau) shall
prepare and submit for the approval of the City Mayor, a budget to cover operational
expenses to include maintenances and other operating expenses, honoraria and such
other expenses to be incurred in the discharge of its functions.

SECTION 5. REPEALING CLAUSE. - All previous Executive Orders inconsistent with


this Executive Order are hereby repealed or modified accordingly.

SECTION 6. EFFECTIVITY. This Executive Order shall take effect immediately.
