Le parti si danno reciprocamente atto che, prima della conclusione dell'accordo, l’agenzia di viaggio intermediaria, ai sensi dell'art. 34 del Codice del
Turismo, ha fornito tutte le informazioni utili per conoscere le misure normative in essere in materia di sicurezza e di sanità, per prevenire il contagio
Covid-19 in vigore nel paese di destinazione.
Il Viaggiatore è stato altresì informato in merito al principio giurisprudenziale ormai consolidatosi dell'autoresponsabilità del viaggiatore, affermato nella
sentenza n. 14257 del 8 luglio 2020 resa dalla Corte di Cassazione, Sezione III ("deve al contempo affermarsi che pure gli stessi acquirenti il
pacchetto turistico sono tenuti ad attivarsi diligentemente onde acquisire quelle informazioni facilmente accessibili e di pronta intuibilità, in ossequio al
medesimo principio di correttezza e buona fede oggettiva nella esecuzione del contratto (artt. 1175 e 1375 c.c.), volto a tutelare il reciproco affidamento
di ciascun contraente all’esatto adempimento delle prestazioni negoziali") e dalla Corte di Giustizia, causa C-412/06, causa C-489/07, causa C-511/08.
In particolare, l’agenzia di viaggio intermediaria, ha riferito che alla data della partenza del servizio venduto potrebbero esserci impedimenti alla
partenza oppure in destinazione, ma il viaggiatore ha autorizzato ugualmente l’acquisto assumendosi l’intero rischio della risoluzione ed erogazione del
servizio ai sensi dell’art 1463 Cod Civile e dell’art 41 comma 4 del Codice del Turismo.
