part of a Writers' Guild Registered screenplay with an award-winning co-writer (LA Film Festival).

mind on the matter after Respondent showed him in a lawsuit that his Bench Partner and Judge of

the Year Frank E. Cuthbertson disagreed with his position as noted in Appendix A. Subsequently
14 over in Thurston County Judge Price thanked Respondent on his professionalism and media pooling.

12 by the judge to be sufficiently compelling to outweigh that presumption;

First, I note that I cannot find any supporting case law that would allow this Court to deny my
17 request. In point of fact, Washington State 2010 Judge of the Year Frank E. Cuthbertson hails from
Pierce County and he made it absolutely clear that one need not be a news journalist in order to
18
enjoy the protections of GR 16 in his MEDIA ORDER of 31 October, 2012. That request was
19
issued by an entity working on a documentary movie in point of fact.

In point of fact, as noted by Counsel for Liberty’s Champion, in Obsidian Finance Group,

LLC v. Cox, 740 F. 3d 1284, 1291 (9th Cir. 2014) the Court noted “[t]he protections of the First
22
Amendment do not turn on whether the defendant was a trained journalist, formally affiliated with
23 traditional news entities, engaged in conflict-of-interest disclosure, went beyond just assembling
others' writings, or tried to get both sides of a story”)…..”

1 While Plaintiff is indeed a trained journalist who has also won First Amendment Jury Trials,
he is entitled to no more or less protections than ABC News or a well-behaved private citizen holding
2
up a cell phone in a Courtroom. The only distinction could be that I am making footage available in
3
a professional capacity for media pools so my equipment may be placed in the corner where media
4 tripods are placed.
I ran private video of my own trials commencing in 1997 and publicly since 2010 in courtrooms
5
throughout the Country -- including Courts of Record in the States of Wisconsin, Ohio, Washington,
6
New Hampshire, Massachusetts and more -- on murder trials, civil litigation and foreclosure without
7 incident including countless King County Courtrooms, completely without incident.
I also shoot and produce raw Deposition videos. No King County Jurist has ever denied
8
camera access to record Court proceedings, with the obvious caveat that the recording is not an
9
official transcript, same as any and all other media who routinely shoot courtroom video with just a
10 phone call to the Court or by walking into the courtroom with advance time to set up gear.
In this instance the gear would be set up at my home as it appears to be that this will be a zoom
11
Hearing; either way the video is captured I have a right to capture it as long as the cameras do not
12
pose a disruption to proceedings, which I have never done in hundreds of court recordings.

I/we will comply with any and all Court directives as to placement and use of equipment. All
