START AND END OF WORKS

1.4. The Contractor will start the work within a week of contract signing.

1.5. The works are to be complete within ( ) working days from the starting date.

1.6. Conditions

1.6.1 For contract to come into force

The contract comes into force at the date of the signature.

PRICE

The total value of the works to be performed under this contract is MMK xxxxxx.

1.7. Payment

The price of the works is payable according to the Bill of Quantities in Annex C
Payment of the works is according to the schedule below. Each payment is a
percentage of the total contracted amount of MMK xxxxxxxxx. The payment should
be done in cheque or in cash or via bank transfer.

Down Payment: Within 5 working days of

signing the contract

Second Payment: upon completion of 50% of

Final Payment: upon the completion of all the

works

The AMOUNT of the (final) payment will be calculated according to the completion
certificate following the actual executed works.

INSURANCE AND LIABILITY

1.8. Construction works insurance

The Contractor guarantees that it has concluded a construction works insurance

contract and that it will pay the related premiums.

The Client will receive certification from the insurer concerning the all-in price and the
delegation of payment.

1.9. Third party liability

Not applicable

PENALTIES

Failure by the Contractor to fulfill the contract by the agreed dates will result in the
Contractor being penalized as follow:

- retain from the payment schedule a penalty equivalent to 1% of the total value of
the present Contract per each week of delay, up to a maximum of 5%.

Furthermore, the General Conditions apply.

LANGUAGE

If this contract is translated into another language, the English version will prevail in
case of dispute or discepancy.

APPLICABLE LAW

Not applicable

ARBITRATION

This contract is subject to arbitration exclusively, according to the attached General

Conditions.
