MEMORANDUM OF AGREEMENT

KNOWN ALL MEN BY THESE PRESENT:

This Agreement made and entered in this 14th day of August, 2022, at the Universidad De
Manila, Philippines, by and between:

_Tristan_Edcel_D._Serad_, Filipino with residence address at 883-N Cristobal St. Paco

Manila_, of legal age/herein represented by his/her parent/legal guardian Gracelle D. Serad
(hereafter, the “UDM Scholar”;

and

Dr. Virginia I. Berganio, Dean, Office of the Student Affairs, UDM, with postal address
at Justice Cecilia Munoz-Palma St, corner Antonio J. Villegas St, Mehan Gardens, Ermita,
Manila (hereafter, the “University” or “UDM”):

Witnesseth that:

WHEREAS, the UDM Scholar, in consideration of and as a condition for maintaining his/her
status as a student-scholar in “good standing” undertakes to abide by the conditions of UDM in
connection with his/her scholarship; and

WHEREAS, UDM requires the UDM Scholar to abide by all pertinent rules, regulations, orders
and issuances issued by the University in connection with the conduct and demeanor of its
students, the conditions of which are imperative for a student-scholar’s continued enjoyment of
the privilege of scholarship in UDM as provided hereunder.

NOW, THEREFORE in consideration of the foregoing premises, the parties herein agree to the
following terms and conditions:

1. The UDM Scholar is a bona fide student of the UDM taking up BTVTE-Major in Food Service
Management, First Semester, for School Year 2022-2023;

2. The UDM Scholar fully understands and is aware that he/she will strictly observe and abide
by Philippine Laws and UDM’s Code of Conduct and all pertinent rules, regulations, orders and
issuances of the University;

3. The UDM Scholar agrees to subject himself/herself to the conduct of Random Drug Test
pursuant to the guidelines set by the Dangerous Drugs Board for Secondary and Tertiary
Students which aims at prevention and rehabilitation of drug users and dependent and agrees to
subject himself/herself to the conduct of random HIV tests pursuant to the guidelines that may
be set by R.A. 11166 and its implementing rules and regulations which aims to protect and care
for the young especially so because they are vulnerable to public health dangers. The tests that
may be conducted are not solely limited to those mentioned above subject to the guidelines and
implementing rules and regulations as may provided for under Philippine Law, the primary
concern of which is the general welfare of the student and/ or the public health;

4. The UDM Scholar shall observe and abide by the foregoing, which shall be enforced at any
time within the University’s campus, vicinity, or at University functions, events or activities;

5. The UDM Scholar shall, at all instances wear the prescribed uniform or dress code in-campus
and off-campus (for any UDM sanctioned/official function, event or activity;

6. The UDM Scholar shall at all times wear his/her official UDM Identification (ID) Card,
displayed at his/her left breast while inside the University’s premises, or at official or sanctioned
University functions, events or activities;

7. In addition to the foregoing, the UDM Scholar shall refrain from committing any form of
abusive conduct, arrogance, disrespect and/or discourtesy, gross disobedience, to any University
official, employee, faculty member or student;
8. The UDM Scholar shall not commit any-act against a University official, employee or faculty
member which may constitute a willful and utter disregard of their authority;

9. The UDM Scholar shall not bring inside the UDM’s premises in whatever form, any obscene
or pornographic objects, picture, media(s) (or literature (s), or materials that are or may be
considered as scandalous, morally offensive/appealing to prurient interests;

10. In connection with the immediately preceding paragraph, the UDM Scholar shall not engage
or participate in the preparation and/or publication of the abovementioned material;

11. The UDM Scholar shall not engage in any form of indecent or immoral conduct, nor be under
the influence of alcohol or prohibited drugs, within the University’s premises, its immediate
vicinity, nor at any official or sanctioned University function, event or activity;

12. The UDM Scholar shall not bring into the premises of UDM its immediate vicinity, or at any
official or sanctioned University function, event or activity, any alcoholic or intoxicating
beverages/substances, and prohibited drugs or paraphernalia;

13. The UDM Scholar shall hereby abide by the University’s strict “no smoking” policy, within
premises of UDM, its immediate vicinity, or at any official or sanctioned University function,
event or activity;

14. The UDM Scholar shall not cause any unwarranted or unjustified disruption during school-
hours or during any official or sanctioned University function, event or activity;

15. The UDM Scholar shall at all times observe orderliness and cleanliness within the
University’s premises;

16. That, I shall neither organize nor join any fraternity, sororities and/or similar sanctioned,
underground, secret or clandestine groups or organizations that requires hazing, or participate
in any initiation rite or practice as a prerequisite for admission into membership in said
fraternity, sorority group or organization, which places the recruit, neophyte or applicant in
some embarrassing or humiliating situations such as forcing him to do mental, silly, foolish and
other similar tasks or activities or otherwise subjecting him to physical or psychological
suffering or injury;

17. The UDM Scholar shall not engage in any form of cheating or plagiarism;

18. The UDM Scholar shall not engage in vandalism, or commit any act of willful destruction of
any University property, including but not limited to tearing-off, or defacing any library book,
magazine or doors, electrical, mechanical or electronic devices and unauthorized removal of
notices and posters from the bulletin board, and such other similar act;

19. The UDM Scholar shall not threaten, coerce, intimidate or compel another student to be
absent from his/her classes, to participate in any illegal activity, to restrain him/his from
participating in any legal/activity;

20. The UDM Scholar shall not inflict upon any harm or injury to any student, or official, faculty
and employee of UDM, nor shall he/she threaten coerce, intimidate or compel any faculty
member to give him/her grade which he/she do not deserve;

21. The UDM Scholar shall not bear, possess or use any deadly weapon or explosive/pyrotechnic
of any kind within premises of UDM, its immediate vicinity, or at any official or sanctioned
University function, event or activity;

22. The UDM Scholar shall uphold honesty and integrity at all times and shall not submit or
subscribe to any falsity or misleading statements in his/her official documents filed with the
University, nor will I publish, disseminate or circulate false, malicious and derogatory material
about the University, its officials, faculty members, employees and students;

23. Moreover, he/she shall not commit any falsification or forgery of any kind including but not
limited to signatures, school records or credentials, or use the falsified/forge materials;
24. The UDM Scholar shall neither engage nor indulge in any form of betting or gambling, nor
be in possession of any gambling material, equipment, device, or paraphernalia in connection
therewiths;

25. The UDM Scholar shall respect, observe and abide by the University and its faculty’s
Academic Freedom;

26. The UDM Scholar shall not engage in any unauthorized solicitation;

27. The UDM Scholar acknowledges that, in addition to any action which may be instituted or
penalty which may be imposed under Philippine Laws, the University shall have the right to
initiate any disciplinary action in the event of any violation of UDM’s rules, regulations, orders,
and issuances, including the covenants hereof specified and impose upon the UDM Scholar the
corresponding penalty/sanction, including but not limited to reprimand, suspensions, dismissal
or expulsion- in accordance with the duly approved student manual;

28. The UDM Scholar hereby executes this Agreement freely and voluntarily, in his/her personal
capacity, or under the direct supervision and guidance of his/her parent/guardian
acknowledging that the terms and conditions hereof were fully explained to the UDM Scholar.

IN WITNESS WHEREOF, the parties have signed this Agreement on the date and at the place
first above-stated herein.
