JOINT AFFIDAVIT OF ARREST

We, the UNDERSIGNED Police Officers, both members of the Philippine

National Police, presently assigned at the, Malolos City Police Station do hereby
depose and state THAT:

01. We are among the members of the Regional Operations Division PRO3 who
conducted HOT PURSUE operations at Brgy Bangkal, Malolos, Bulacan located along
Sitio Uno, Malolos, Bulacan

02. Said operation stemmed from the complaint of Benito Samson Sr for
violation of “Republic act no. 7659 an act to impose the death penalty on certain
heinous crimes, amending for that purpose the revised penal laws, as amended, other
special penal laws, and for other purposes” which was referred to our office by the
Barangay Captain of Canalate. Against Nesio Lomotan,, (23), (Single), (Filipino) and
residing at No. 203 sitio dos Brgy Bangkal, Malolos, Bulacan. (Alvin Florentino) 25 years
old, single Filipino and resident of Sitio Mabini, Brgy Atlag, Malolos Bulacan,

03. On the complaint dated December 6, 2022, ( “Republic act no. 7659 an
act to impose the death penalty on certain heinous crimes, amending for that purpose
the revised penal laws, as amended, other special penal laws, and for other purposes”
).

04. Upon receipt of their said complaint, our office planned out an Hot
Pursue operation against the suspects. At about 08;00 in the evening of 6th December
2022, the undersigned together with the complainant proceeded at the location of the
suspect’s

05. Upon arrival thereat, complainants waited for the suspect to arrive
while we the undersigned seated near the table of the complainants. At about 09;00 in
the evening, suspect arrived and approached the complainants and after few
conversation, complainants handed over the marked money to the suspect that minutes
of prompted the undersigned to immediately effect arrest;
06. Seized and recovered in the possession and control of the arrested
person were the following, to wit:

a.) Marked Money, (3)THOUSAND PESOS OF LO0932842;

 b.) (1) ZIP LOCK OF HIGH GRADE MARIJUANA AND (3) ZIPLOCK
OF SHABU;

c.) CALIBER 45

07. Suspects together with the seized and recovered evidence was
brought to the MALOLOS CITY POLICE STATION for booking and proper disposition.
Likewise, the arrested person was apprised of their rights as provided for under the
Constitution of the Philippines.

08. The report of the PNP Crime Laboratory Group Physical Identification
Report No. 202034 dated 6th December 2022, revealed that suspect Nesio Lomotan
was POSITIVE for the presence of Gun powder residue on both palm and right dorsal
portion of the hands.

We executed this joint affidavit to attest the truthfulness of the foregoing facts
and to support the filing of Criminal Cases against (Nesio Lomotan,)(Alvin
Florentino)for violations of ( “Republic act no. 7659 an act to impose the death penalty
on certain heinous crimes, amending for that purpose the revised penal laws, as
amended, other special penal laws, and for other purposes” )
