0 Jurisdiction  
2.1 High court 
The High Court of Malaysia is the third highest court in the hierarchy of courts.  Which mean
after the Federal Court and the Court of Appeal.  Article 121 of the Malaysian Constitution provides
for two High Courts of coordinate jurisdiction.  There is the High Court of Malay and the High Court
of Sabah and Sarawak.  (这个可以放在 introduction 不放在这里) 

The High Court of Kuala Lumpur handed down a verdict that Najib was convicted of seven
charges in the SCR money laundering case involving the Malaysian malpractice, including three counts
of criminal breach of trust, one count of abuse of power and three counts of money laundering.  Since
one of the jurisdictions of high court is the original criminal jurisdiction which mean to hear the
criminal cases involving the death penalty.  Secondly, the high court will also adjudicate the original
civil jurisdiction which is to hear and determine all civil cases beyond the jurisdiction of the Session
and Magistrates’ Court that involving sums excess of RM 1 million.  Apart from this, the High Court
also hears appellate jurisdiction which is hears criminal and civil appeals from the Session Court and
Magistrates’ Court.  Najib will be tried in the High Court as he is being tried on seven charges
simultaneously.  The maximum penalty for breach of trust is 20 years in prison, a fine and whipping
but the law does indicate that over 50 years age is exempt from whipping; the maximum penalty for
abuse of power is 20 years in prison and fine; and the maximum penalty for money laundering is 15
years in prison and fine.  The Malaysia prosecutors have accused Najib of making a profit of RM42
million ringgit in transactions involving SRC International.  The penalties for his crime exceeded those
that could be imposed by the Session Court, so the trial had to start in the High Court.   

The hearing for Najib's appeal of the SRC decision occurred on April 5, 2021, in the Court of
Appeal. According to the Najib Razak case, the High Court sentenced him to 12 years in prison and a
fine of RM210 million after convicting Najib guilty of all seven charges. Najib submitted an appeal
petition detailing 307 reasons why the judges should pardon him for his actions. These cases will be
going to the Court of Appeal because, regarding issues that the High Court decided in its appellate or
revisionary jurisdiction, the Court of Appeal is the second highest Court that can hear appeals on those
cases. Subject to any written law regulating the terms and conditions upon which such requests are
brought, the Court of Appeal has the authority to hear and decide appeals from judgments or orders of
any High Court in any civil cause or matter, whether made in the exercise of its original or appellate
jurisdiction. It holds the position of being Malaysia's second-highest Court in the country's overall
judicial hierarchy. There are cases the Court of Appeal cannot hear. Under Section 68 of Act 91, the list
of instances such as when the amount of the claim is less than RM250,000, except with the Court of
Appeal left; When the judgement or order is made by consent of parties; When the judgement or order
relates to costs only, which by law are left to the Court's discretion, except with Court of Appeal go;
and where by any written law for the time being in force, the High Court judgement or order is
expressly derogated from.
3.0 Function of courts 
3.1 Function of High Court 
Najib was sentenced to 10 years for each of the three breach of trust offences, so
he will be sentenced to 30 years in prison.  He was exempt from flogging as he was
67 years old at the time.  He was also sentenced to 10 years in prison for the money
laundering charge and 30 years for the three money laundering charges.  As Najib
made a profit of 42 million ringgit in transaction involving SCR International, the
legal fine had to be not less than five times that amount, so five times RM 42 million
was RM 210 million and he was finally sentenced to 12 years and RM 210 million for
abuse of power.  The High Court concluded that Najib was sentenced to 12 years
imprisonment and RM 210 million.
