AFFIDAVIT

I, LILIBETH A. OMI of legal age, married, Filipino citizen and resident of Brgy.
Catabayungan, Cabagan, Isabela after having been duly sworn to according to law hereby depose
and state:

1) That I am the same person executing this affidavit;

2) That I am a helper of the Canteen owned by the Zipagan family which is located at
the back of the Balay na Maguili (Municipal Hall);
3) That I am their helper for almost eleven (11) years now doing almost everything from
cooking and washing the dishes and their trusted person in the said canteen;
4) That I am aware of the transaction between Mrs. Dureza Emma P. Zipagan and her
daughter Charlene P. Zipagan and Ms. Caroline M. Guerrero;
5) That on February 07,2017, I was approached by Ms. Guerrero and asked me if she
could display her products in the canteen to which I replied, “I am not the owner of
this place and I am a mere helper of the Zipagan Family” and that they should just
wait for my boss to arrive and ask her permission;
6) When my boss Mrs. Dureza Emma P. Zipagan and her daughter Ms. Charlene
Zipagan arrived, they talked and came to an agreement that Mrs. Dureza Emma P.
Zipagan would allow them to display their products in the said canteen and if there
are sold products, Ms. Guerrero or his agent would just pick up the proceeds thereof
at the canteen;
7) That sometime on 2018, I noticed that no one is buying the said product in our
canteen due to its proliferation in the market and the same is sold at a lower price,
hence, Mrs. Dureza Emma P. Zipagan told me to return the unsold products to its
owner or her representative whenever they come to the canteen;
8) That every time the agent of Ms. Guerrero come to our office, Ms. Charlene Zipagan
and I would always tell him to get the unsold Dane Soaps because no one is buying it
and that they are about to expire but the agent always refuses;
9) That the same products are still on the canteen except those already lost or destroyed
during the infamous storm and flooding last November 2020;
10) That on January 2021, Ms. Caroline Guerrero came to our office to check on the
product and asked me the complete name of Ms. Charlene Zipagan and, at the same
time, I asked her to get the products because no one is availing it and that they are
already expired but she refused and replied, “you should have return the same when
no one is buying it”;
11) That I answered her that we attempted many times to return the unsold products even
before they become expired but our heed to her agent went unheard.
