INSTRUCTIONS OF LICENSE FOR THE

CONSTRUCTION CONTRACTORS
For the year 2008

Issued pursuant to Article (3) item (A) of the


Construction Contractors Law No. (13) for the year 1987
and the approval of the Minister of Public Works and
Housing through his letter no. A / 5/1/1735 Dated on
22/7/2008

*NOTE: In the event of any difference in interpretation between the


English and Arabic text, the Arabic text shall prevail.

Article (1):
The following words and expressions wherever mentioned in these
instructions shall have the meanings assigned thereto here-in-below
unless the context provides otherwise:
Ministry : Ministry of Public Works and Housing
Minister : Minister of Public Works and Housing
Department: Government Tenders Department.
Committee : License Committee formed by the Minister of Public
Works and Housing pursuant to Item No. (B) Of Article (3)
of the Construction Contractors Law is assigned for
reviewing and studying the Applications of License and
submit recommendations thereon.
Contractor : Any person , natural or legal , who practices the profession
on construction contracts , licensed and registered in
accordance with the provisions of the Construction
contractors law and the Instructions issued under thereof .
Contract : A contract to construct buildings, roads, structures,
engineering projects of whatsoever, operation and
maintenance same.
Person : the natural and qualified person in accordance with what
has mentioned in these instructions or any legal person who
has obtained the temporary License.
Article (2):
These instructions shall be called “Instructions of License for the
Construction Contractors for the year 2008”, and shall come
into effect from the date of its publication in the Official Gazette.

Article (3):
The license shall be given to any person to practice the
profession of contracting and obtaining such license shall not be
considered an approval for practicing the profession of contracting unless
all requirements and procedures of classification are completed according

to the construction contractors Law as well as to the instructions of
qualification in force.
Article (4):
In the event that the information provided in the Application of
License was proven false and incorrect, contradicted to the construction
contractors Law, or contradicted to the applicable instructions of license,
the Committee shall terminate the license and prohibit the partners from
submitting a new application for a minimum of one year.
Article (5):
The license should not be granted to any person who does not hold
the Jordanian nationality without an existence of a Jordanian partner.
Article (6):
A license may not be granted to any person being a partner in
another contracting company, owner of contracting establishment the
purpose of its registration is Construction Contracting, Engineering
Consultancy, Engineering Projects, a partner in a housing company, or an
owner of housing establishment.
Article (7):
For the purposes of license the Co-founder shall have the following
requirements a minimum share of not less than 30% of the capital of the
company or one hundred thousand (100.000) Dinars whichever is lesser
and shall be entitled and authorized to carry on the technical and
administrative matters and to pass the General Examination of the
readiness to work in the construction sector determined by the
Jordanian Construction Contractors Association, the following
requirements shall be adopted:
A. If the partners were Engineers, the full time of them shall be
registered with the Jordanian Engineers Association, Jordanian
national, with at least two years of experience for any partner,
and providing a letter from the Association proves that they are
not working with any other party related to the field of
contracting, engineering construction or the public sector.

B. If the partner was an Engineering Diploma Certificate holder,
after obtaining the General Secondary Certificate, he should
have a minimum experience of not less than (10) years in the
same field of specialization and such Diploma should be
certified by the competent authorities.
C. The adopted specializations for Diploma Certificate are ( Civil
Engineering, Architecture,, Electrical Engineering, Mechanical
Engineering, Décor and Survey)
D. In the event that a full-time partner have been working with
another classified contracting company for more than (5) years
as a founder-partner before leaving from such company, he
shall submit his application for license within (5) years from the
date of leaving the company provided that he presents enough
experiences for the grade and field requested pursuant to the
classification instructions in force.
E. In the event of decease of any of the classified company's and
establishment's owners, the interruption in classification should
not exceed three (3) years.
F. Conversion from a classified to a company and vice versa.
Remark: The sub-field of work or specialization for the purpose of
licensing the engineers and the Engineering Diploma holders
mentioned in Article (7-C) here-in-above shall be determined upon the
certificate of education, provided that such certificate combined with a
practical experience in the same specialization.
Article (8)
The Arab Contracting Companies with Jordanian partners may be
licensed provided that one of them is a full-time engineer and registered
with the Jordanian Engineers Association and with experience of not less
than (12) years whereas the partners share must not be less than 50% of
the company's capital.
Article (9):
Drop-outs on Classification: Those who are interrupted in
classification for more than three years shall submit a new license

application whether they have or have not paid the fees of Jordanian
Construction Contractors Association, and with the commitment to
Articles (7) and (12) of these instructions.

Article (10):
License shall be given to individuals, companies and
establishments in accordance with the following procedures:
A. Obtaining and filling out the Application Form adopted by
the Department for twenty Jordanian Dinars in order to be
submitted to the Committee for review and study for once.
B. Requirement for license should be met in full prior the
submission of application to the Committee.
Article (11):
The applicant should be given a temporary license for one year
provided that he completes the procedures of registration in the Jordanian
Construction Contractors Association and such license shall become void
after this period is over if he was expelled from the Jordanian
Construction Contractors Association.
Article (12):
The applicant shall present a proof of his financial solvency of a
value of ten thousand (10.000) Dinars and confirmed with one of the
followings:
A. A balance in the name of one of the partners (three months prior
to the submission of application).
B. A bank time deposit in the name of one of the partners
constrained for a period of three months and should not be
released except by a letter from the Department .
C. Value of construction equipments: Dumper 10m3 or a leveling
machine, Loader, Bulldozer or Roller 25 tons with some
documents prove that these machineries are owned by one of
the partners for a period not less than one year from the date of
submitting the application of license.

Article (13):
The Committee shall study the applications of the cases not mentioned in
the articles here-in-above and recommend what it deemed appropriate.

Article (14):
The applicant may object the Committee's decision within a period
of 14 days from the date of notification of such decision for non-
refundable fees of ten dinars and after the expiration of the objection
period; the Committee's decision becomes final.

Article (15):
All instructions of license for the construction contractors for the
year 2006 and amendments shall become void.

Based on the recommendation of the licensing Committee of the contractors, dated on 9/02/2009 and according to
Article (3) of the Construction Contractors Law No. (13) for the year 1987 and its amendments; the following
contractors will be temporarily licensed on the condition to be registered in the Ministry of Industry and Trade and
in the Construction Contractors Law, taking into account Article (8-B) of the Jordanian Construction Contractors
Law. They shall not be allowed to carry on the profession of contracting before joining the Jordanian Construction
Contractors Association, as well as registering the company, its engineers and workers in the Jordanian Engineers
Association.

 Approval on license does not necessarily mean the classification of the contractor in the grade and in the
field he desires.
 The application shall be rejected in the event that any of the information submitted was incorrect.
