MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Memorandum of Agreement is entered into by and between:


The DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES-NATIONAL
CAPITAL REGION (DENR-NCR), a government agency with office address at the National
Ecology Center, East Avenue, Diliman, Quezon City, represented by its Regional Executive
Director, JACQUELINE A. CAANCAN, CESO III, hereinafter referred to as “FIRST
PARTY”;
- and –
The BARANGAY PALINGON TIPAS, CITY OF TAGUIG, a local government unit duly
created and existing under Philippine laws, with office address at 62 F.Manalo, Taguig, Metro
Manila represented herein by its Barangay Chairperson, JEROME M. MENDIOLA hereinafter
referred to as “SECOND PARTY”
WITNESSETH:

WHEREAS, as per Section 4 of Executive Order (EO) No. 192, s. 1987, the Department of
Environment and Natural Resources (DENR) is the primary government agency responsible
for the conservation, management, development, and proper use of the country’s environment
and natural resources;

WHEREAS, the DENR-NCR, as the primary agency responsible to implement the Operational
Plan for the Manila Bay Coastal Strategy (OPMBCS) for the conservation, management,
development, and proper use of the country’s environment and natural resources, provides
support to Local Government Units for collaborative efforts in fulfilling the said mandate;

WHEREAS, Barangay Palingon Tipas, City of Taguig plays a role in the sustainable and
continuous conservation and protection of the Manila Bay by practicing proper solid waste
management;

WHEREAS, pursuant to the Writ of Continuing Mandamus issued by the Supreme Court in the
Metropolitan Manila Development Authority, et. al vs. Concerned Residents of Manila Bay, GR
Nos. 171947-48, December 18, 2008, and Administrative Order No. 16, s. of 2019, the
PARTIES acknowledge their responsibilities to rehabilitate and preserve Manila Bay;

WHEREAS, to sustain the efforts to protect and rehabilitate Manila Bay, it is imperative for the
Barangays in the vicinity of rivers, creeks, esteros, and other waterways that drain into Manila
Bay to practice proper solid waste management;

WHEREAS, along the Taguig River System, a major tributary of the Manila Bay, Barangay
Palingon Tipas has narrow streets and alleys which are not accessible by ordinary garbage
trucks/waste collector vehicles;

WHEREAS, the uncollected solid wastes and debris in Barangay Palingon Tipas may end up in
water bodies such as Manila Bay, cause pollution, and pose potential health risks;

WHEREAS, in line with the objectives of protecting and rehabilitating Manila Bay, the
PARTIES jointly agreed and resolved the need for a “Waste Collector Rickshaw Trike,” with
the following specifications:

 Metallic DENR Logo (Back)
 0.90mL x 0.80mW x 0.50mH Carrier with Divider

WHEREAS, the FIRST PARTY procured said Waste Collector Rickshaw Trike worth
THIRTY-SEVEN THOUSAND PESOS (Php 37,000.00), and administer its transfer in favor
of the SECOND PARTY, to enforce and implement the Operational Plan for the Manila Bay
Coastal Strategy, in compliance with the Administrative Order (A.O.) No. 16 dated February 19,
2019, otherwise known as “Expediting the Rehabilitation and Restoration of the Coastal and
Marine Ecosystem of the Manila Bay and Creating the Manila Bay Task Force”;

NOW THEREFORE, for and in consideration of the foregoing premises, both parties hereby
agree as follows:

I. SCOPE AND COVERAGE

This Memorandum of Agreement (MOA) covers the transfer by the FIRST PARTY
of the physical and documentary accountability over One (1) Waste Collector
Rickshaw Trike as described in the abovementioned specification to the SECOND
PARTY for purposes of Manila Bay rehabilitation.

II. ROLES AND RESPONSIBILITIES OF THE PARTIES

A. The FIRST PARTY shall:

1. Transfer for and in behalf of the Government, the physical and documentary
accountability to one (1) set of Waste Collector Rickshaw Trike as provided in
the abovementioned description in favor of the SECOND PARTY in support
of its solid waste management practices;

2. Authorize the SECOND PARTY to use the Waste Collector Rickshaw Trike
for the collection of wastes within its jurisdiction, especially in areas not
covered by its regular garbage collection; and

3. Monitor the submission of monthly reports from the SECOND PARTY and
collate the data on the monthly volume of wastes collected using the Waste
Collector Rickshaw Trike.

B. The SECOND PARTY shall:

1.Accept and receive the transfer of one (1) set of Waste Collector Rickshaw Trike
from the Government, through the FIRST PARTY;

2.Sign the Invoice Receipt to Property (IRP) and Property Accountability Receipt
(PAR) and assume full responsibility and accountability over the Waste Collector
Rickshaw Trike;

3.Use and maintain the Waste Collector Rickshaw Trike solely and exclusively for its
intended purpose of the collection of garbage within its area of jurisdiction,
particularly in areas not routinely reached by the established garbage truck
collection;

4.Ensure that the collected solid waste shall be disposed of in accordance with
Republic Act No. (RA 9003) otherwise known as the Ecological Solid Waste
Management Act of 2000;

5.Coat, wherever applicable, the Waste Collector Rickshaw Trike with appropriate
metal paint for longer durability;

6.Submit a report to the FIRST PARTY containing a database of the monthly volume
of solid wastes collected by the Waste Collector Rickshaw Trike every 20th of the
month;

7.Keep the FIRST PARTY free from any liabilities arising from its utilization of the
Waste Collector Rickshaw Trike;

III. AMENDMENT, MODIFICATION, DELETION OR ALTERATION

No prior amendment, modification, deletion, or alteration of the above terms and


conditions of this Agreement shall be valid without the Parties’ written agreement.

IV. SETTLEMENT OF DISPUTE

The parties agree that any conflict, controversies, issues or disputes which may arise
within or during the effectivity of this agreement shall, in their best efforts, try to
settle the same among themselves.
In case of failure to come to an amicable settlement, all disputes between the parties
arising from the interpretation or application of this Agreement shall be settled
through mediation/conciliation process as provided for in Republic Act No. 9285
also known as the Alternative Dispute Resolution Act of 2004.

V. EFFECTIVITY AND REVOCATION

This Agreement shall take effect upon its execution and may be terminated by mutual
consent of the PARTIES in writing.

In case of failure of the SECOND PARTY to comply with the terms and conditions
of this Agreement, the same shall cause the revocation of this Agreement, without
prejudice to administrative accountability that may arise from the violation.

IN WITNESS WHEREOF, the parties, through their duly authorized representatives, have
hereunto affixed their signature this 29th day of November at the City of Quezon, Philippines.
