Ako si JOEY MAGNO MARAÑON sa sakto nga idad, wala sang

asawa, Filipino kag pumuluyo sang Brgy. Catubig, Badiangan, Iloilo,
Philippines, isa ka mangunguma, nagsumpa sunod sa layi kag nagtuad sang
masunod:

(I, JOEY MAGNO MARAÑON, of legal age, single, Filipino and a

resident of Brgy. Catubig, Badiangan, Iloilo, Philippines, after having been
duly sworn to in accordance with law do hereby depose and state:)

PRELIMINARY STATEMENT

ATTY. EDMER P. FAMA, with office address at Fama, Fama &

Palomar Law Office, 3rd Gate, USA-High School Extension-Famaed Royale,
Brgy. Sambag, Jaro, Iloilo City, Philippines, conducted this direct
examination.

The direct examination was conducted in English which I know and

understand. I am answering the question asked of me by ATTY. EDMER P.
FAMA, fully conscious that I do so under oath. I am also aware that I may
face criminal liability for false testimony or perjury.

(I am here today in your office for my Judicial Affidavit
as witness in connection with the complaint of MARY
JEAN S. PINEDA for “Estafa under Par. 3, Article 316
of the Revised Penal Code” against JUDY PACIFICAR
ARMADA.)

Q3: Sa diin ikw sang Oktobre 18, 2022, alas dos (2:00) sang
hapon?
(Where were you on October 18, 2022 at 2:00 O’clock in
the afternoon?)

A3: Ara ako sa Kubo sa tupad sang balay ni Mary Jean S.

Pineda, sa Brgy. Sinuagan, Badiangan, Attorney.
(I was in the Kubo beside the house of Mary Jean Pineda
at Brgy. Sinuagan, Badiangan, Attorney.)

Q4: Anu and imo gina ubra sa amo nga lugar sang Oktobre
18, 2022, alas dos (2:00) sang hapon?
(What are you doing in the said place on October 18,
2022 at 2:00 O’clock in the afternoon?)

A4: Naga ubra, Attorney kay trabahador ako ni Ma’am Mary

Jean.
(I am working, Attorney because I am the worker of
Ma’am Mary Jean.)

Q5: Pwedi mo bala mahambal sa amon kung anu natabo sang

Oktobre 18, 2022, alas dos (2:00) sang hapon?
(Can you please tell us what happened on October 18,
2022, at 2:00 O’clock in the afternoon?)

A5: Ara ako sa Kubo upod si Leonilo Pineda sang nag abot si
Judy Armada, upod na si Jorila Casco kag duha ka indi
kilala nga lalaki kag gusto magsulod sa gate.
(I was in the Kubo together with Leonilo Pineda when
Judy Armada, together with Jorila Casco and two (2)
unidentified male persons arrived and wanted to enter
the gate.)

Q6: Anu dayon gin buhat mo?

(What did you do then?)

A6: Ginhambalan ko sila nga indi magsulod, pero namilit gid

sila kay hambal ni Judy makuha sila paray sa balay ni
Rogel Barientos.

 (I told them not to enter, but they insisted because
according to Judy they will get the rice in the house of
Rogel Barientos.)

Q7: Nakasulod sila sa gate?

(Were they able to enter the gate?)

A7: Huo, Attorney, kay na hadlok na kami, kay gapang away

na sila kag hambal ni Judy sa amon nga naka istorya na
sila ni maam Mary Jean nga kuhaon nila ang paray.
(Yes Attorney, because we already afraid because
they’re already making trouble and Judy told us that they
already talked with my sister that they will get the rice.)

Q8: Paanu sila nagsulod sa gate?

(How they enter the gate?)

A8: Gin buksan ko ang gate, Attorney.

(They forcibly open the gate, Attorney.)

Q9: Anu sunod natabo?

(What happened next?)

A9: Nag diritso sila sa balay ni Rogel barientos kag ginsunod

sya ni Leonilo Pineda.
(They proceeded to the house of Rogel Barientos and
Leonilo Pineda followed them.)

Q10: Anu ang sunod nga natabo?

(What Happened next?)

A10: Nakita ko nga ginkuha sang duha ka lalaki ang apat ka

sako nga paray, Attorney.

Q11: Daw anu kalayo ang balay ni Rogel Barientos sa Kubo?

(How far is the house of Rogel Barientos from the
Kubo?)

A11: Mga 50 metros, Attorney.

(About 50 meters, Attorney.)

Q12: Pagkatapos nila kuha sang apat ka sako nga paray, anu
ang sunod nga natabo?
(After they took the four (4) sacks of rice, what happened
next?)

A12: Si Judy Armada nagbalik kag ginkuha ang isa ka saging,

kag ginsugo na si Rogel Barientos nga tapson ang iban pa
nga saging sa sulod sang kudal ni ma’am Mary Jean.

 (The said Judy Armada went back and harvested one (1)
bunch of bananas and told Rogel Barientos to cut the
other bananas inside the compound of ma’am Mary
Jean, Attorney.)

Q13: Anu sunod natabo?

(What happened next?)

A13: Ginhambalan sya ni Leonilo Pineda nga indi pagtapson

kag hulaton lang si ma’am Mary Jean, pero ginpa sige na
katapas ang mga saging kag ginhambalan si Leonilo
Pineda nga “ngaa inyu na diri duta? Akon na diiri
tinanom”.
(Leonilo Pineda told her not to cut and wait for ma’am
Mary Jean, but she continues cutting the bananas and
uttered the following words to quote: “ngaa inyu na diri
duta? Akon na diri tinanom”.)

Q14: Pagkatapos sina, anu natabo?

(After that what happened?)

A14: Nagpuli sila, Attorney kag gindala ang apat ka sako nga
paray.
(They went home, Attorney and they brought the four (4)
sacks of rice.)
