Vehicular Accident: On March 4, 2022 at about 9:30 A.M, a vehicular accident

transpired along Maharlika Highway, Barangay Mabini, Santiago City, particularly in
front of Mabini Circle involving involving V1 crimson red Nissan Navarra Pivk-up with
plate no. SLG261 registered under the name of National Irrigation Administration of
Edsa Diliman, Quezon City, driven by Daniel Acosta Papa, 24 years old, born on
June 30, 1997, driver, college graduate, male, signle, 80 kg in weight, 165 cm in
height, Filipino, holder of Driver’s License no. B12-17-002081 with expiration date
on 2022-06-20, a resident of Purok 4, Barangay Baluarte, Santiago City and V2 a
metallic Toyota Innova Wagon with plate no. ZNP247, registered to Ronaldo Ma
Caylo Yap of Paranaque City, driven by Precious Jay Benidicto Mangalindan, 18
years old, born on May 28, 1003, college students, male, single, 60 kg in weight,
162 cim in height, Filipino, holder of Driver’s License no. B06-21-201422 with
expiration date on 2026-05-28, a residents of Barangay Paddad, Alicia, Isabela.
Initial investigation showed that V1 was travelling Mabini Circle heading to Barangay
San Andres while V2 was traveling Maharlika Highway heading Barangay San
Andres this City. When they reached the place of incident, V2 turned left and while
on the process, the approaching V2 accidentally bumped/hit the right side front
portion on the V1. As a result, vehicles involved incurred damage of still
undetermined cost.

for any legal purpose it may serve.

The undersigned under oath, accuses Precious Jay Benedicto Manglindan of

the crime of RECKLESS IMPRUDENCE RESULTING TO DAMAGE TO PROPERTY
as defined and penalized under Article 365 in relation to Article 263 and Article 327 of
the Revised Penal Code, committed as follows:
“That on or about 9:30 in the evening of March 4, 2022 along Maharlika Highway,
Barangay Mabini, Santiago City, particularly in front of Mabini Circle and within the
preliminary jurisdiction of this honorable office, Precious Jay Benedicto Mangalindan
being the driver of V1- crimson red Nissan Navarra Pivk-up with plate no. SLG261
registered under the name of National Irrigation Administration of Edsa Diliman, Quezon
City, driven by Daniel Acosta Papa did then and there willfully, unlawfully and
feloniously drove and operated the same in a negligent, carelessness and imprudent
manner, without due regard to the traffic laws and regulations and without taking the
necessary precaution to prevent an accident, V2- metallic Toyota Innova Wagon with
plate no. ZNP247, registered to Ronaldo Ma Caylo Yap of Paranaque City, driven by
Precious Jay Benidicto Mangalindan. That both vehicles were traversing in single
direction V1 was traveling Mabini Circle heading to Barangay San Andres while V2 was
traveling Maharlika Highway heading Barangay San Andres this City. When they
reached the place of incident V2 turned left and while on the process, the approaching
V2 accidentallt bumped/hit the right side front portion of the V1. As a result vehicles
involved incurred damages on its parts with an estimated amount of PHP10, 000.00. To
the damage and prejudice of the undersigned complainant.

TRAFFIC INVESTIGATION REPORT

SIR/MADAM:
 
I have the honor to refer to your office, the records of investigation relative to the case of
(Reckless Imprudence Resulting in Damage to Property ), committed on or about
9:30 P.M. of March 4, 2022 along Maharlika Highway, Barangay Mabini, Santiago City,
particularly in front of Mabini Circle.

COMPLAINANT: Daniel Acosta Papa, 24 years old, born on June 30, 1997, driver,
college graduate, male, signle, 80 kg in weight, 165 cm in height, Filipino, holder of
Driver’s License no. B12-17-002081 with expiration date on 2022-06-20, a resident of
Purok 4, Barangay Baluarte, Santiago City
SUSPECT: Precious Jay Benidicto Mangalindan, 18 years old, born on May 28, 1003,
college students, male, single, 60 kg in weight, 162 cim in height, Filipino, holder of
Driver’s License no. B06-21-201422 with expiration date on 2026-05-28, a resident of
Barangay Paddad, Alicia, Isabela.

EVIDENCE RECOVERED: V1- crimson red Nissan Navarra Pivk-up with plate no.
SLG261 registered under the name of National Irrigation Administration of Edsa
Diliman, Quezon City, driven by the suspect Daniel Acosta Papa and V2- metallic
Toyota Innova Wagon with plate no. ZNP247, registered to Ronaldo Ma Caylo Yap of
Paranaque City, driven by the complainant Precious Jay Benidicto Mangalindan,.

FACTS OF THE CASE: Initial investigation showed that V1 was travelling Mabini Circle
heading to Barangay San Andres while V2 was traveling Maharlika Highway heading
Barangay San Andres this City. When they reached the place of incident, V2 turned left
and while on the process, the approaching V2 accidentally bumped/hit the right side
front portion on the V1. As a result, vehicles involved incurred damage of still
undetermined cost.

DISCUSSION: Based on our investigation conducted, it was shown that the driver of
V1- crimson red Nissan Navarra Pick-up with plate no. SLG261 was the proximate or
immediate caused of the accident on the ground that, when they reached the place of
incident V2 turned left and while on the process, the approaching V2 accidentally
bumped/hit the right side front portion of the V1. As a result, vehicles involved incurred
damage of still undetermined cost.

CONCLUSION: This office therefore concludes that the suspect Precious Jay Benidicto
Mangalindan the driver of V1- metallic Toyota Innova Wagon with plate no. ZNP247,
registered to Ronaldo Ma Caylo Yap of Paranaque City with postal address at
Barangay Paddad, Alicia, Isabela were at fault and acted in reckless, imprudent and
negligent manner.

RECOMMENDATION: Wherefore, in the light of the foregoing, the undersigned

investigator who conducted investigation regarding the incident respectfully refer to this
Honorable Office a case of Reckless Imprudence Resulting in Damage to Property
for the conduct of Regular Preliminary Investigation and proper disposition.
