- Because they deserve it. They need justice so that they will feel at ease and also to make sure that the
suspect wont do it again to them.

Instruction: Give one (1) actual scenario related to the following concepts.

1 .Dolo - ames noticed the arrival of Cathy. Armed with and M16 Rifle, he went to the latter’s house
and started firing towards the house of Cathy, because he was so angry that Cathy chose to marry
another man.

2. Culpa - Glenda, while driving her car, did not see many passing through the pedestrian lane. She thus
caused the injury of many through her imprudence or lack of foresight.

3. Mala Inse - Mala in se (“evil in itself”) – A crime or an act that is inherently immoral, such as murder,
arson or rape. [Black's Law Dictionary, 9th Ed.] Mala prohibita (“prohibited evil”) – An act that is a crime
merely because it is prohibited by statute, although the act itself is not necessarily immoral.

4. Mala Prohibita - Mala In se is a latin phrase which means, “wrong or evil”. It is considered wrong even
if there is no law prohibiting it. But since the Philippines is a Civil law country, these wrongful acts by
nature must be prohibited under the written law. Mala prohibita/prohibitum, on the other hand, is not
wrong in itself. It’s not wrong in nature. It becomes wrong because of the statute that proscribes it.

5.Ex Post Facto - An ex post facto law is a law that applies to crimes that happened before the law was
passed. An example of an ex post facto law is a law passed in 1994 that applies to acts that occurred in
1989. A law intended to apply to crimes or events that took place before its passage

6.Bill of Attainder - A bill of attainder (also known as an act of attainder or writ of attainder or bill of
penalties) is an act of a legislature declaring a person, or a group of persons, guilty of some crime, and
punishing them, often without a trial.

7.Act or Omission - When A shoots B and kills him, this constitutes killing by an act since A moved his
muscles in order to kill B. However, when A sees B drowning and does not save him, this is an omission
because A did nothing to cause the death of B. In this case, A will be convicted only if he had a duty to
act.

8.General Characteristics - One of the general characteristics of criminal law is territoriality, which
means that penal laws of the Philippines are enforceable only within its territory

9.Territorial Characteristics - The territorial theory takes the position that criminal jurisdiction depends
upon the place of perpetration. That is, the nation on whose territory the crime was committed has
jurisdiction of the offense. It is a logical outgrowth of the conception of law enforcement as a means of
keeping the peace.
10.Prospective Characteristics - PROSPECTIVE-(characteristic of criminal law)- in that a penal law cannot
make an act punishable in a manner in which it was not punishable when committed.
