Issue:
The issue in this question is whether the acceptance is valid by the date it is posted

Law:
Section 2(h) of the Contact Acts 1950-definition of contract.
Section 2(a) of the Contact Acts 1950-definition of offer.
Section 2(b) of the Contact Acts 1950-definition of acceptance.
Section 7(b) of the Contact Acts 1950-acceptance must be communicated.
Section 4(2) of the Contact Acts 1950-acceptance letter made through post, it binds the
offeror from the time it is posted and not by the time it is received.

Case:
Entorres V Miles Far East Corporation
Ignatius V Bell

Application and Conclusion:

Since Wong has chosen to accept through post, therefore Section 4(2) will come into effect
and therefore the date of contract and the date of communication of acceptance is on the
date he posted the letter which is 5 September 2022 and not the date when the letter
received by Wong which he had sold a land to other people. We can conclude that the case
of Ignatius v. Bell will be applicable, and Wong is entitled to sue Chong for his remedies.

OR

In this question, even though the letter has not been received by Chong after the date that
they’ve agreed upon, the letter was already posted by Wong before the date given and
therefore it has been accepted. Applying Section 4(2), the acceptance letter made through
post binds Wong from the time is it posted and not by the time it is received. Applying the
case Entorres V Miles Far East Corporation, the acceptance is complete as soon as the
letter is put into the post box. Based on Ignatius V Bell, the acceptance is valid when Chong
posted the letter on 5th of September even though it arrived much later. As there is
acceptance to the offer, there is a contract between Wong and Chong. In conclusion, Chong
can sue Wong as there is a breach of contract since the contract is valid.
