MEMORANDUM OF AGREEMENT

THIS MEMORANDOUM OF AGREEMENT IS ENTERED BY AND BETWEEN:

THE BUREAU OF FIRE PROTECTION, CITY OF SAN FERNANDO FIRE


STATION, a government entity created in accordance with law, with principal address at
Barangay 1, City of San Fernando, La Union, represented by SINSP MICHAEL JOHN V
ESCAÑO, hereafter referred to as the “FIRST PARTY”;

and the
SFO2 Daryl G Macagba

ILOCOS TRAINING AND REGIONAL MEDICAL CENTER (ITRMC) a


government entity duly organized and existing by virtue of the laws of the Republic of the
Philippines with principal address at Parian, San Fernando City, La Union, represented by
EDUARDO M. BADUA III, MD, FPSP hereinafter reffered to as the “SECOND PARTY”;

WITNESSETH, that

WHEREAS, Republic Act No. 7719, otherwise known as the “NATIONAL


Blood Coordinator

VOLUNTARY BLOOD SERVICES ACT of 1994” was passed and enacted in order to pursue
the State’s goal of attaining the objectives of the national voluntary blood program of the
government;

WHEREAS, one of the declared policy of Republic Act No. 7719 is to mobilize all
sectors to participate in mechanisms for voluntary non-profit collection for blood;

WHEREAS, the FIRST PARTY must be involved actively in the implementation of the
Blood Coordinator

provisions of Republic Act No. 7719, to encourage participation and to proceed with vigor for
the ultimate attainment of the objectives envisioned under said law;

WHEREAS, it is a declared policy of the FIRST PARTY to give priority to health


development through the provision and delivery of health services;

WHEREAS, pursuant to the aforesaid policy, the FIRST PARTY, is committed to

provide medical assistance when necessity for blood transfusion arises during confinements in
hospitals by providing them voluntary donors;

WHEREAS, a considerable number of patients who need blood transfusion during their
confinement at the hospitals have been recipients of the Blood Service Program;

WHEREAS, in order to have expeditious, orderly and effective release, delivery and
utilization of the needed blood for patients during confinements, the creation of Blood Donor
Registry is therefore imperative;

WHEREAS, concomitant to the avowed policies of Republic Act No. 7719, is the need
to have a blood collection/pool in the FIRST PARTY. Thus, the FIRST PARTY approved that
the Ilocos Training and Regional Medical Center (ITRMC) will serve as the blood storage of the
units collected during Mobile Blood Donation activities;

NOW THEREFORE, for and in consideration of the foregoing premises and the mutual
covenants set forth below, the parties hereby mutually agree and declare as follows:

AGREEMENT:

A. FIRST PARTY

shall:

1. Implement the voluntary blood services program through the assistance of the Health
Unit personnel as scheduled with emphasis to the following activities:

a. Blood donor recruitment, retention, education and counseling


b. Donor selection and screening
c. Blood collection

2. Enlist qualified donors, maintain and update Donor Registry;

3. Provide funds for the operation of scheduled Mobile Blood Donation;

4. It shall provide the SECOND PARTY the regular schedule of blood donation activities;

5. Notify the second party at least (2) weeks prior to the scheduled date of blood donation

6. Provide at least thirty (30) donors per Mobile Blood Donation Activity;

B. SECOND PARTY

The ILOCOS TRAINING AND REGIONAL MEDICAL CENTER (ITRMC) shall:

1. Provide medical personnel who will assist the Health Unit Personnel during the
scheduled Mobile Blood Donation;

2. Process and test the blood units for five infectious disease markers (anti-HIV ½ anti-
HCV, HBsAg, Syphilis and Malaria);

3. Serve as the storage of whole blood and blood components obtained from the FIRST
PARTY;

4. Authorize the issuance of blood units based on the blood requests from physicians and/or
blood program coordinator of the FIRST PARTY;

5. Provide the first party an inventory of the blood units stored, upon request. In case the
blood inventory is zero, blood services fee will be charged to the patient.

WHEREAS, Administrative Order No. 2015-0045 dated October 26, 2015 and Department
Circular No. 2016-0318, is intended to regulate blood service fees in accordance with Section 8
of the National Blood Services Act of 1994, which states that blood bank/center shall operate on
a non-profit basis, but that may be allowed to collect blood services not greater than the

maximum prescribed by the DOH.

COMMON PROVISIONS:

1. Both parties agree that the rates for the blood service fees shall be:

Whole Blood Php 1,800.00


Packed Red Cells Php 1,500.00
Other blood components (platelet, Concentrate, Fresh Frozen Php 1,000.00
Plasma, Cryoprecipitate, Cryosupernate)

2. Term of the MOA: this Memorandum of Agreement shall be valid and binding for a
period of two (2) years for a term beginning upon the signing of this agreement and
maybe renewed through a written Agreement subject to presentation/compliance of the
requirements under the Regional Blood Service Network.

3. Without prejudice hereof, this Agreement may be terminated by any party thereto subject
to a thirty (30) days prior notice to the other party on valid and justifiable grounds or if

any of the parties commit any material breach of this agreement or at any time whenever
the exigencies of the service so require;

4. Any amendment or modification to this Agreement should be made in writing and in


consultation with all parties involved.

5. Both parties attest that they have fully read and understood the terms, contents and
consequences of this Memorandum of Agreement which shall be in full force and effect

upon the signing hereof.
