IN exercise of the powers conferred by section 14, 435 and 445 of p


the National Land Code, the State Authority of Selangor makes the e
following Rules: r

1. (1) These rules may be cited as the Selangor Land Rules 2003 it
and shall come into operation on the date of the publication of these t

(2) In these Rules, unless the context otherwise requires— t

“Administrator” means the Land Administrator appointed under h
section 12 of the National Land Code and includes Assistant Land o
Administrator appointed under the same Code; l

“the Code” means the National Land Code; and l

“value of the land” means the market value of the land approved n

(3) A reference in these Rules to a form identified by a number n
and a letter is a reference to the form identified by that number and d
letter in the First Schedule to the Code. e

APPLICATION FOR LAND t

2. (1) Every application for State land shall be made as prescribed e
in Schedule 1. M

(2) Every application— l

(a) shall be submitted in two copies; y
(b) shall be signed by the applicant or his duly appointed R
agent; e

(c) in the case of a registered company or incorporated body, e
shall be signed by the person or persons who is or are r
legally authorized to sign on behalf of the company or v
corporation; and a
(d) shall be accompanied with a plan. ti

(3) If the application is not in conformity with this rule, the n
Administrator shall refuse the application and may return it to the E
applicant. n

3. The Administrator shall summarily reject any application for c
land in the following circumstances: t
m
(a) land in a Malay Reservation unless the applicant is e
nt; Act 56/65.

(b) the land has been alienated;


(c) the land has been approved for alienation but the title has
yet to be issued;
(d) the land has been reserved for public purposes;

(f) the application does not satisfy the requirement of section
43 of the Code;
(g) the land has been acquired for a Government agency under
the Land Acquisition Act 1960;
En. 1/2000. (h) the land has been approved for a mining lease under the
Mineral (Selangor) Enactment 2000; or
(i) as generally directed from time to time by the State Authority.

particulars of the application and the payment of deposit under
Section 82 of the Code to be recorded as prescribed in Schedule ll.

PAYMENT OF FEES ON APPROVAL OF ALIENATION

Payment. 5. (1) The payment of any sums demanded under subsection 81 (2)
of the Code shall be recorded by the Administrator both in the file
dealing with the alienation of the land and in the “Record of
Applications for Land”.

(2) Where approval of the alienation is given, the District Land


Administrator shall issue notice in Form 5A of the Code upon
payment of all fees within a specified period.

Period. 6. (1) The period to be specified in Form 5A for the purposes of


rule 5 shall be three months. The Administrator may, in any particular
case he deems fit, grant any extensions:

Provided that the period of extension or extensions so granted


shall not in the aggregate exceed three (3) months and the application
for such extension is made before the due date.

(2) The State Director may grant any extension of time which
shall not in aggregate exceed six (6) months for the payment of the
premium.

(3) The Menteri Besar may grant any extension of time which
shall not in aggregate exceed six (6) months for the payment of the
premium.

PREMIUM

7. The rates of premium to be charged upon all land alienated after - Parki

Unless in any particular case or class of cases the State Authority
decides otherwise:
(i) alienation of land situated within the boundaries of a town
or village shall be by way of State Lease; or
(ii) alienation of such land will normally be by auction subject
to a reserve price to be fixed by the State Authority.

The premium to be paid on alienation of such land shall be:


A Category : Building
— (1) For
Residential:
(a) Residential - 1/2 x 1/100 x value of

(b) Squatters - 1/8 x 1/100 x value

and subject to such conditions and restrictions as it may prescribe,
delegate in writing to the State Director or the Administrator as the
case may be the powers conferred upon it by subrule (1).

17. (1) Subject to subrule (3), a proprietor of country land who Rebate of rent on

replanted; such rebate may be claimed for a period of six years

single calendar year and shall reach the Administrator before 1 April
of the year to which it relates.

(2) Where an application is made under subrule (1) in respect of


any land, the Administrator, if satisfied that the land or part thereof
has been replanted in accordance with subrule (1) and properly
maintained, shall make his recommendation to the State Director
that the land or that part thereof shall be allowed a rebate of rent
for the year to which the application relates so as to reduce the
annual rent to RM2.00 per acre per annum, and the State Director
may approve or reject the application.

(3) This rule shall apply only to proprietors who at the time of
submitting an application under subrule (1) own agricultural land
totalling not more that ten acres in area (excluding land used solely
for the cultivation of padi, sagu or nipah).

(4) If at any time after a rebate of rent under subrule (2) has been
granted, it is discovered that at the time of submitting the application
under subrule (1) the applicant was disqualified for obtaining the
rebate under subrule (3), the rebate shall be withdrawn and the full

rate of rent shall be due to the State Authority in respect of any


period during which the rebate is purported to have effect.

Arrear fees. 18. Whenever any rent is in arrear according to section 94(2) of
the Code the following fees shall be payable in addition to the rent:

(a) Where the amount due does

Notice fee. 19. Whenever a Notice of Demand in Form 6A under sections 97


and 98 of the Code is issued, a notice fee as prescribed in item 62
of rule 21 shall be payable in addition to the arrear fees prescribed
in rule 18.

Provided that either generally or in any particular class of cases


or in any particular case, the State Authority may in its discretion
authorize the issuance of licenses on payment on higher or lower
fees than are herein before prescribed.

23. Before issuing a license under section 69 or a permit under Security.

GRAZING PERMIT AND FEE

Grazing permit. 28. The fee for a grazing permit issued under section 427 of the
Code shall be at the rate of fifty cents per head per year of part
thereof for goats and sheep and one ringgit per head per year or part
thereof for horses and cattle (which expression includes cows,
bullocks, oxen and buffaloes).

SALE OF STATE LAND BY AUCTION

Survey before 29. No sale of State land by auction shall take place until the land

Notification 30. (1) When a sale of State land by auction has been authorized,

31. The reserve price when State Land is sold by auction shall be Reserve price.

postpone the sale at any time before the fall of the

(b) the highest bidder shall be the purchaser, provided that his
bid is equal to or higher than the reserve price;

(c) the purchase shall immediately on the fall of the hammer


deposit with the Administrator twenty-five per cent of the
purchase money together with the additional payments
mentioned in rule 31 and if he fails to do so the land shall
forthwith be put up for auction again;

(d) the full amount of the purchase money shall be made good
by the purchaser before the close of business on the
fourteenth day from that on which the sale of the land
bought by him took place and thereupon the sale shall
become final and conclusive. In default of full payment as
aforesaid the deposit shall be forfeited to the State
Authority and the defaulting purchaser shall forfeit all
claim to the land or to any part of the sum for which it
may be subsequently sold;

(e) documents of final title shall be registered and issued as


soon as possible after the completion of sale; and

(f) possession shall be given immediately on the registration


of the register document of title.
Conduct of sale.
33. (1) On the day and at the time and the place advertised for a
sale of State land by auction the Administrator shall begin by reading
aloud the conditions of sale and the Gazette Notification. The sale
shall then commence and each lot shall be taken separately in the
order determined by the Administrator.

(2) The sale shall be conducted by the Administrator in person


or, if the special circumstances of the case so require, by an Assistant
Administrator nominated by the Administrator.

(3) Immediately on the fall of the hammer, the name and address
of the purchaser shall be audibly announced by the person who
conducted the sale.

(4) If the purchaser is acting as the agent of another, he shall


disclose the name of his principal and if he fails to do so, the
documents of title shall be prepared in his own name.

Auction sales book.


34. The Administrator shall keep an auction sales book in the form
set out in Schedule V of these Rules and shall make an entry therein
of every piece of State land for sale by auction with a reference to
the Gazette Notification and any other particulars which he considers
relevant.

36. No officer employed in any Land Office in the State shall

TIME AND METHOD OF PREPARATION


AND CULTIVATION OF LAND FOR THE
GROWTH OF RICE

Definition of 39. For the purpose of these Rules, “padi land” shall be such land
“padi land”. described under section 119 of the Code.

Proclamation by 40. The Administrator shall proclaim annually in respect of his

than one month from the date of such proclamation, on or by which


all proprietors or occupiers of padi land shall commence or complete
any of the following acts:

(a) the construction or putting in order jointly by all


proprietors or occupiers of padi land of dams, water-
wheels and water- courses, and individually by each
proprietor or occupier of all division ridges between
padi fields;

(b) the establishment of padi nurseries;

(c) the fencing of the padi fields;

(d) the transplanting of seedlings from the nurseries to the


fields; and

(e) the weeding of the growing padi.

Every proclamation made by the Administrator under this rule shall


be published in the Gazette and translations thereof in the National
language shall be posted locally at mosques, penghulu’s balais and
such other places in the district as the Administrator may direct.

41. (1) Every proprietor or occupier of padi land shall: Performance

repair and strengthen all division ridges of his padi fields,

to destruction by flood and fence the same, within the
period proclaimed for that purpose;

(c) assist in the construction or repair of such fencing as is


necessary to keep pig, deer, buffaloes or cattle from
straying into the rice-fields or from damaging any dams,
water- courses or water-wheels used for the irrigation of
the rice- fields;

(d) while the padi seedlings are in the nursery, plough or hoe
his land and prepare it for the transplanting of the
seedlings. He shall entirely clear the land and destroy
every bush and tree growing thereon, provided that he shall
not be compelled to destroy fruit-trees or sagu palms, and
shall level, or entirely clear, every ant-hill so that no
harbour for rats or other vermin shall be left;

(e) before the day fixed for commencement to transplant the


padi, clear of undergrowth on any adjoining land of which
he is the proprietor or occupier to a distance of one chain
from the edge of his padi land;

(f) join with other proprietors or occupiers of padi land in


clearing of undergrowth on any State land and any alienated
land the owner of which consents to such clearance, to a
distance of one chain from any padi land in the tract or
valley in which his own land is situated;

(g) transplant his seedlings from the nurseries to the fields


within the period proclaimed for that purpose. He shall
plant the whole area of padi land owned or occupied by
him;

(h) after the completion of transplanting, weed his growing


padi within the period proclaimed for that purpose; and

(i) join with other proprietors or occupiers in such measures


as are necessary to destroy rats or other pests damaging
the growing crops.

(2) If the proprietor of any land in any district or part thereof in


respect of which dates have been proclaimed under rule 40 fails to
commence or to complete any of the acts which he had to fulfill
under subrule 41(1) on or before the date proclaimed, the
Administrator may after such investigation as he shall deem
necessary by order under his hand, permit any person other than the
proprietor to enter into occupation of the land for the purpose of
enabling such person to do any of the acts aforesaid which the
proprietor had failed to perform and to take the seasons’s crops.

(3) In making an order under subrule (2), the Administrator may


direct the person permitted to occupy and land for the purpose
aforesaid to pay the quit rent reserved in respect of such land or to
pay to the proprietor of such land or to any person on his behalf such
sum of money, or to hand over to the proprietor or to such person
such quantity of padi, as the Administrator may consider reasonable.

(4) The cultivation of land by any person in accordance with an


order made under subrule (2) shall not be deemed to constitute
cultivation by the proprietor under section 119 of the Code.

Penalty. 42. Any proprietor or occupier failing to comply with the provisions
of rule 41 shall be liable to a fine not exceeding one hundred ringgit
provided that where it is proved that such failure has been the cause
of loss or damage to the its proprietors or occupiers of neighbouring
padi land or any of them such fine may extend to two hundred
ringgit but shall not exceed the estimated amount of damage caused.

43. Where a fine in excess of one hundred ringgit is inflicted under Compensation.

ringgit by way of compensation to the proprietors or occupiers who
have been proved to have suffered damage.

44. (1) If any proprietor or occupier of padi land makes any default Cost of

proof to his satisfaction that such default is likely to cause loss or
damage to the proprietors or occupiers of neighbouring padi lands

from the owner or occupier by the Administrator, on behalf of the
persons by whom the clearing was done, by suit before a Magistrate.

(2) In the event of any proprietor or occupier of padi land willfully


neglecting to assist or to continue to assist in constructing or putting
in order dams and water-courses used for irrigation of his land as
provided in rule 41 (1), the Administrator or in cases of urgency the
Penghulu may engage labourers at a reasonable eage to construct or
put in order the aforesaid dams and water-courses. Any reasonable
sum so expended may be recovered from such proprietor or occupier
by the Administrator, by suit before a Magistrate.

(3) Any proprietor or occupier of padi land, who enjoys the use
in common with his neighbours of any water from any water-course
and who willfully obstructs such water-course or diverts therefrom
water in excess of his reasonable requirements shall be liable to a
fine not exceeding twenty-five ringgit, and for every subsequent
offence to a fine not exceeding one hundred ringgit.

45. The Administrator may compound any offence punishable under Compounding
rule 42 or rule 44 (3) by accepting from any person against whom of offences.

of the Code of a change of his address.

400(1) An offence by any person owning, occupying, applying


for or otherwise interested in, or employed on or in
connection with, any land which a survey officer is
required to survey who fails to comply with the notice
served on him in form 29A of the Code.

400(2) An offence by any person that a survey officer reasonably


believes that he can give any information inspecting the
boundaries of any land which the officer is required
to survey or he has in his custody or under his control
any document relating to boundaries of the land who
fails to comply with the notice served on him in form
29B of the Code.

400A An offence by any person who, not being a survey officer


or a licenced surveyor, carries out a survey or undertakes
to carry out a survey of any land in the state for
the purpose of this Act.

403 An offence by any person who, without the authority of


the Director of survey and mapping, willfully
destroy, damages, defaces, moves or otherwise
interferes with a boundary mark of a survey reference
mark.

422(a) An offence by any person who, knowingly makes any


false statement, either orally or in writing, in connection
with any dealing or other transaction affecting land
or any other matter arising under this Act.

conceals from the registrar, or assists or joins in so
doing, any material document, fact or matter.

423 An offence by any person who fraudulently alter, adds


to, erases, defaces, or destroys any document of title or
other instrument relating to land, or other entry on
any such document or instrument.

424(1) An offence by any person who without reasonable excuse,


fails to produce or deliver any document as required by
a notice lawfully served on him under paragraph (e)
of subsection (1) of section 15 or by paragraph (b) of
sub section (1) of section 175B or by a notice under
sub section (4) of section 343 of the Code.

424(2) An offence by any person who, without reasonable excuse,


fails to produce any document as required by a
notice lawfully served on him under subsection (2) of
section
398A of the

(a) occupies or erects any building on, any state land,


reserved land or mining land;or

or any public road or waterway or other place to which
public are entitled to access.

information which is communicated or divulged to him in

52. (1) Where any folio of the roll of approved applications is lost, Transitional

application to the Administrator as set out in Schedule XXI that his
or some other person’s name be entered in the provisional folio of the
roll of approved applications.

(4) Upon expiry of the period of notice under paragraph 52 (1)(a),


the Administrator shall prepare in the manner as provided in subrule
52 (5) and subrule 52 (6) a provisional folio of the roll of approved
applications.

(5) The provisional folio of the roll of approved applications


shall be prepared from other records available in the Land Office
or other documentary evidence, and from other particulars obtained
during an inspection of the land.

(6) The provisional folio of the roll of approved applications


shall bear an endorsement of the word “provisional” in a prominent
form and shall contain:

(a) except in so far as they relate to matters which have ceased


to be effective, the like endorsement and other entries as
are contained in the original folio, if they are legible, and
in the case of entries pertaining to the use of the land
which are not legible and no records or documents are
available to indicate such use, such entries may be
determined according to the use or occupation of the land
or the adjacent lands;

(b) such entries relating to the name of approved applicant,


the name of any person or body who has acquired the
rights of the name of the former approved applicant as
may be applied to be made therein under subrule (3); and

(c) where entries pertaining to payment of premium, rent and


other payments are not legible and not obtainable from
any record or evidence after due enquiries by the
Administrator, such payment shall be deemed to have been
paid and a statement to that effect shall be entered in the
provisional folio of the roll of approved applications.

(7) As soon as may be after the completion of the provisional


folio of the roll of approved applications, the Land Administrator
shall:

(a) cause a notice as set out in Schedule XXII to be published


in the Gazette;

(b) cause copies of the notice to be served on every person


who has made an application under subrule 52(3) and to
be published in accordance with the provisions of section
433 of the Code; and

(c) cause the provisional folio to be opened for public


inspection without payment at any time during normal
office hours.

(8) A note of the publication in the Gazette of the notice under


paragraph 52(7)(a) shall be endorsed in the provisional folio.

(9) Any person or body who has an interest in the land who
wishes to object to any entry therein or to any omission thereof may
do so within a period of the three months from the date of publication
in the Gazette of the notice in accordance with paragraph 52(7)(a)
by lodging with the Administrator a notice of objection as set out
in Schedule XXIII.

(10) The Administrator shall as soon as practicable after the


expiry of the period specified in the notice under paragraph 52 (7)(a)
hold an enquiry into any objection and the provisions of Chapter 4
of Part Two of the Code shall have effect in relation to such enquiry
with the omission of section 27 of the Code (which relates to the
advertisement of enquiries), and no persons other than:
(a) the person who submitted an application to the
Administrator under subrule 52(3); and
(b) the person who lodged an objection under subrule 52(9),
shall be entitled to be heard or to adduce evidence at such
enquiry (and accordingly the persons and bodies mentioned
in paragraphs (a) and (b) shall be the only persons entitled
to apply for postponement or change of venue under sub-
section 28(2) of the Code or to receive notice under sub
section 28(4) of the Code of any cancellation, postponement
or change of venue.

(11) If after expiration of three months from the date of


publication in the Gazette of the notice in accordance with subrule
52(7) there has been no objection under subrule 52(9), the
Administrator shall cause the word “provisional” in the provisional
folio to be deleted and such deletion be authenticated under his
hand and seal.

(12) If there has been an objection under subrule 52(9) the Land
Administrator shall after the final decision thereon give effect to the
decision and authenticate the provisional folio under his hand and
seal by deleting the word “provisional”.

(13) The provisional folio of the roll of approved applications


which has been dealt with under subrule 52(11) or subrule 52(12)
shall be deemed to replace the original folio which was lost, damaged
or wholly or partially illegible.

53. When any land has been lawfully occupied by virtue of an Transitional
entry in any register of approved applications pursuant to approval provision in
respect of breach
given under any previous land law, its approved application may be of conditions of
cancelled by the Administrator in the event of a default in the land comprised in
Approved
observance of any of the conditions expressed or implied in such Applications
under previous
approved application: land law.

Provided that before ordering the cancellation of an approved


application as aforesaid the Land Administrator shall observe in so
far as is possible the procedure laid down in Part Seven Chapter 5
and Part Eight of the Code.

Transitional
provision with 55. (1) The Administrator, on receipt of a petition of distribution

under the Small Estates (Distribution) Act 1955 [Act 98/58], in
respect of the estate of a deceased person who was in lawful
occupation of land by virtue of an entry in register of approved
applications pursuant to an approval given under a previous land law,
may appoint the petitioner or some other suitable person to be the
representative of the deceased as regards to that land.

(2) Where a representative is appointed under subrule 55(1) as


regards to any land:
(a) the representative shall apply to the Registrar for the issue
of qualified title to the land, and the Registrar shall issue
qualified title accordingly, in the name of the applicant
with an additional endorsement “as representative”; and

(b) the land shall be dealt with by the Administrator as if it


had been held by the deceased under qualified title.

(3) Where in respect of any land regarding which an appointment


has been made under subrule 55 (1), a distribution order under the
Small Estates (Distribution) Act 1955 including a further order under
section 17 of that Act if any, has become final in accordance with
section 16 of that Act, it shall be the duty of the Registrar to give
effect thereto by endorsing a memorial of any transmission thereby
effected on the register documents of title to the land in question
and, if he is able to secure its production, on the issue document of
title.
Transitional
provision with 56. (1) Where before the commencement of the Code:

plan of the land made by the Survey Department) has been
received by the Registry or Land Office,

register a register document of title, and prepare and issue document
of title, in the appropriate form under that law instead of in the form
prescribed by the Code.

(2) Any register document of title prepared and registered, and


any issue document of title prepared, in accordance with subrule (1)
of this rule shall be deemed to have been prepared and registered
or, as the case may be, to have been prepared in accordance with
the Code.

57. A caveat registered under the Land Code, Cap. 138 which Transitional
corresponds in type to a private caveat under section 322 of the provision relating
to private caveat.
National Land Code shall, if not sooner withdrawn or removed by
an order of the Court, lapse at the expiry of six years from the
commencement of the Code.

PROVISIONAL FOLIO IN THE ROLL OF APPROVED
APPLICATIONS

In exercise of the powers conferred by paragraph 52(1)(a) notice is hereby given that
it is proposed to prepare a provisional folio in the roll of approved application relating
to the land described in the Schedule below for the following reasons:

2. Upon publication in the Gazette of this notice, no Land Administrator


shall accept any application for alienation under qualified title in respect of this land
until the word “provisional” entered in the said provisional folio has been removed
under the provision in subrule 52 (11) or subrule 52 (12) .
