 Terms and Conditions
1 DEFINITIONS:
a) "The Act" - The Copyright Act, 1957.
b) "Licence Fee" - Fees payable for the interest in the rights granted for the limited purpose.
c) "Licence Period" -Is a limited period stated on the licence copy authorizing the licencee to use sound recordings for the
communication to the public.
d) "Communication of Sound Recordings to Public" - Making any sound recording work or performance available for
being heard or otherwise enjoyed by the public directly or by any means of diffusion whether simultaneously or at places
and times chosen individually, regardless of whether any member of the public actually hears or otherwise enjoys the
work or performance so made available. Communication of Sound Recordings to more than one residential room of any
hotel or hostel shall be deemed to be communication to the public.
e) "Background Licence" - Shall be applicable if you are playing sound recordings at your Premises, which shall not
include featured events.
f) "Event Licence" - Shall be applicable if you are playing sound recordings for a particular event/show/function at your
premises.
g) “List of Music Labels” - List of Music Labels/Companies who have granted exclusive rights of their sound recording
Repertoire to PPL together with specific exclusions/restrictions, uploaded and updated from time to time on the website
www. pplindia.org.

2 LICENCE:
a) Subject to the provisions of this Licence and on the payment of Licence Fee, PPL hereby grants to the Licencee a non-
exclusive and limited licence under Section 30 of the Act to communicate sound recordings under PPL repertoire to the
public at the licensed premises, during the license period.
b) Licence shall deemed to be expired automatically after the license period is over, without any further notice. Licencee
shall not communicate sound recordings after the expiry of licence.
c) PPL shall have the right and discretion to revoke/cancel licence if the licencee commits any breach of the terms of this
license.
d) In case of renewal, the start date will be as per records of PPL. Licencee shall not use sound recordings of PPL without
a valid licence.
e) PPL shall have the right and discretion to modify/alter the terms of licence without any intimation or reason.
f) A Background Licence is not valid for any Event (e.g. shows, functions, promotions, fashion shows, DJ parties, etc.)
conducted in the licensed premises, for which a separate Event Licence must be obtained.
g) The Licence fee is based on the declarations made by the licencee while obtaining licence. Any concealment,
discrepancy and/or incorrect declaration shall be treated as infringement and damages shall be recovered.
h) Non-compliant licence and/or user who seek to regularize past infringement and/or breach of the terms of this Licence
shall be liable to pay damages over and above the existing tariff at the discretion of PPL..
i) PPL reserves the right to inspect the licensed premises to validate the information furnished by the licensee during the
licensed period and thereafter for unauthorized usage of sound recording.
j) The Licencee agrees not to use or authorize/permit any other person to use sound recordings of PPL for any other
purpose whatsoever other than limited usage permitted under this Licence copy.
k) This license is non-transferable and no sub-license can be created. No third parties shall have any right to enforce this
License

3 PAYMENT OF LICENCE FEE:

a) In consideration of the licence granted by PPL, the Licencee shall pay to PPL Licence fee as per the tariff uploaded on
the website, www.pplindia.org, prior to usage of sound recordings. Applicable taxes shall be charged additionally.
Payment shall be made in full, without any set-off, adjustment or counter-claim. Payments shall be made via. online
transfer, cheque, DD, NEFT/RTGS/IMPS and payment Gateway PayU. Payment in cash shall not be accepted.
b) The Tariff shall be applicable only if licence is obtained before the usage of sound recordings.
c) The decision of PPL shall be final as to the applicability of tariff category and total license fees.
d) License fee is non-refundable in any situation.
4 Legal:
a) a) In case of any unauthorised usage or infringement of rights, PPL shall be entitled to damages and shall have all the
rights to take action under the Act. The decision of PPL as to the quantum of damages shall be final and binding on the
Licencee.
b) All rights which have not been specifically granted to the Licencee hereunder are hereby expressly reserved with PPL.
c) This Agreement supersedes all prior and simultaneous discussions, negotiations, proposals, agreements and
understandings.
d) No delay on the part of PPL in exercising any right under this Licence shall operate as a waiver of any such right.
e) This Licence does not constitute any joint venture or partnership between PPL and the Licencee.
f) All the rights and obligations hereunder shall be construed and interpreted in accordance with the laws of India. Courts
of Mumbai shall have sole and exclusive jurisdiction for all matters concerning this Licence
