Auction is the sale of goods that are open to the public with a written/verbal price quote or along with

the development of technology going offline or online which is increasing or decreasing to reach the
highest price starting with the Auction Announcement.
Auctions in Indonesia are under the authority of the Ministry of Finance, which is one of the functions of the
Directorate General of State Assets. Since 2006, the auction institution has continued to make changes in line
with technological developments and public demands. The development of the auction is very rapid, not only
in terms of the type of auction, the improvement of the position of the auction officer, the improvement of the
standard operation procedure of the auction but also the bidding system. This is supported by the issuance of
various regulations that support the creation of a more competitive, objective auction, providing legal certainty
and accountability.

Based on the applicable law, the auction can be carried out in

 Voluntary non-execution auction

auction of private property, person or legal entity/business entity that is auctioned voluntarily.
Mandatory Non-execution auctions are studied in depth whether they can fully follow the same path
as the voluntary auction or will have their own road map. However, if you pay attention to its non-
executional nature, it would be more appropriate to compare it with a voluntary auction, in the sense
that deregulation is carried out in order to enlarge the market niche
the implementation of the execution auction should still be carried out by the Class I Auction Officer
(PL I) at the KPKNL, this is very important to emphasize because in addition to having an economic
dimension, the execution auction also has a law enforcement dimension. Coupled with the fact that the
auction of executions causes many disputes and lawsuits, it should be carried out by the state
apparatus.ex: land and building assets
 Mandatory Non-execution Auction
auction to carry out the sale of goods which by legislation are required to be sold by auction. There are
18 auctions included in the mandatory non-execution auction, namely the abolition of BMN/BMD,
goods belonging to BUMN/BUMD, goods belonging to BPJS, BMN withholding from Customs and
Excise, gratuities, asset property, demolition of BMN, consumables of ex-election, property of ex
BDL, inventory of ex BDL, ex managed by PT PPA, APU obligor PKPS, inventory of ex IBRA, ex
IBRA property, hall of inheritance, BMKT, BI assets, movable goods left over from projects, as well
as timber and other forest products.
 Execution Auction

auction to implement court decisions/determinations, other documents equivalent to that, and/or

implement provisions in laws and regulations. There are 15 auctions included in the execution auction,
namely the execution of PUPN, courts, taxes, bankruptcy assets, Article 6 UUHT, confiscated objects
Article 45 of the Criminal Procedure Code (Polidi/Prosecutor/Judges), confiscated objects Article 271 of
Law 22/2009 concerning LLAJ, confiscated objects Article 94 Law 31/1997 concerning Military Courts,
confiscated goods (Prosecutors), fiduciary guarantees, goods not controlled/controlled by the ex-Customs
State, findings, evidence returned but not taken by the owner, pledges, and items confiscated by the KPK.
