Research Topic ONE

(1) Zambia has accented to 1951 convention on refugees. The 1951 convention has up the

rights and duties for all recognized refugees , such us freedom of movement, right to education,

right to life, just to name the few on the other hand Part (iv) of 2017 of refugee act of zambia

provides the rights and duties of recognized refugees in accordance with section 41(3) states

that A recognized refugee or a dependent of a recognized refugee may undertake studies in any

primary school and shall not require a study permit to undertake such studies ,section (43) also

states that A recognized refugee who holds an educational qualification recognized by the

relevant competent authorities, and who is desirous of practicing a profession, has the right to

choose a trade, an occupation or a profession, subject to limitations imposed by law . However,

in as much as these rights stipulated are in the refugee act, in as much as they are in existence,

they lack effectiveness they are limited in one way or the other. for instance, the education sector

is poor few refugees in Zambia acquire tertiary education, they are strictly limited to be moving

in a specific area. In order to acquire a self-employment permit, refugees require to pay a certain

amount which is contrary to the right of employment. These limitations are contrary to the 1951

convention and it has affected lots of refugees in Zambia to an extent that there rights are been

taken away from who they are, they are been denied a full capacity to education system which

has contributed to high number of unemployed refugees in Zambia. As a researcher I want to

find out to what extent has Zambia gone to effectively domesticate those rights.
