Sub: Complaint against Mr. Jayant Shyam Sinari and Mr.

Chandrashekhar Jamanna Swami, Partner(s) of M/s. Concord Enterprises;
having registered office at 108, Kalindi Building, Sector 19 – C, Above
H.D.F.C. and I.C.I.C.I. Bank, Vashi, Navi Mumbai; bearing Mobile No(s).:
Mob. No.: +91 – 98921 22865; for Fraud, Cheating, Inducement and
Criminal Breach of Trust.

Dear Sir / Ma’am,

I am a reputed citizen of Republic of India having fixed

place of residence as stated hereinabove. I say that, I am engrossed in the
business of Construction and Development as well as providing material(s) for
Construction and Development since last many years.

I say that, I met Mr. Chandrashekhar Jamanna Swami and

Mr. Jayant Shyam Sinari in the year 2015 – 2016 via. a close friend and later on

were having friendly relation with each other and in the said friendly relation
Mr. Chandrashekhar Jamanna Swami and Mr. Jayant Shyam Sinari asked me
and showed me a plan of the property located at Karjat, Raigad and told me
that, the said property is constructed by them.

I say that, later on in the year 2016; Mr. Chandrashekhar

Jamanna Swami and Mr. Jayant Shyam Sinari asked me to visit the said
property located at Karjat and they asked me to supply goods and materials such
as Cement, Reti, Etc. and on their request I supplied the required goods and
materials on the said plot / project and raised necessary invoices for the
outstanding sum of Rs. 26,47,022/-. I say that, the said outstanding sum of Rs.
26,47,022/- was never paid to me despite regular and repeated reminders by me
and false promises were made by Mr. Chandrashekhar Jamanna Swami and Mr.
Jayant Shyam Sinari but were never fulfilled. Hereto annexed and marked as
Exhibit – “A” is the copy of the Ledger Accounts.

I say that, later on in the year 2017; Mr. Chandrashekhar

Jamanna Swami and Mr. Jayant Shyam Sinari induced me to invest in the said
property which was developed by them under the garb that, the rates / prices of
the said property will rise in near future as the area / locality in which the said
property is been constructed is a well – connected area.

I say that, on the words and assurance of Mr.

Chandrashekhar Jamanna Swami and Mr. Jayant Shyam Sinari and considering
the friendly relations I invested in the said project which was developed by Mr.
Chandrashekhar Jamanna Swami and Mr. Jayant Shyam Sinari. I say that, Mr.
Chandrashekhar Jamanna Swami and Mr. Jayant Shyam Sinari asked me to
apply for loan and allotted me 06 Flat(s) i.e., Flat No. 205, 206, 207, 208, 209,
210; in A Wing of the said project i.e., “LEGACY VRINDAVAN”, Karjat,
Raigad.

 I say that, I paid a sum of Rs. 48,00,000/- as earnest
money for the said 06 (Six) Flats i.e., Flat No. 205, 206, 207, 208, 209, 210; in
A Wing of the said project i.e., “LEGACY VRINDAVAN”, Karjat, Raigad; and
took a loan of Rs. 2,05,10,168/- for the said 06 (Six) Flats and the said amount
of Rs. 2,05,10,168/- has been transferred to the partnership firms bank account
i.e., M/s. Concord Enterprises Bank Account. Hereto annexed and marked as
Exhibit – “B” (Colly) is the copy of the Letters of the Bank and payment
receipts received from M/s. Concord Enterprises.

I say that, then after in September, 2017; Mr.

Chandrashekhar Jamanna Swami and Mr. Jayant Shyam Sinari; executed
Agreement for Sale for all the said 06 (Six) Flats i.e., Flat No. 205, 206, 207,
208, 209, 210; in A Wing of the said project i.e., “LEGACY VRINDAVAN”,
Karjat, Raigad; in favour of me but did not give me possession of the said
Flat(s) and told me that the possession will be given in the year 2018 as the said
project / building did not receive the Occupation Certificate (O.C.). And, hence
to co – operate with Mr. Chandrashekhar Jamanna Swami and Mr. Jayant
Shyam Sinari; I gave my assent for late possession. Hereto annexed and
marked as Exhibit – “C” (Colly) is the copy(ies) of the Agreement For Sale.

I say that, since the year 2018 to 2022; I constantly

followed up Mr. Chandrashekhar Jamanna Swami and Mr. Jayant Shyam Sinari,
but they have turned deaf ears for obvious reasons. I say that, I have tried to
establish telephonic communication with Mr. Chandrashekhar Jamanna Swami
and Mr. Jayant Shyam Sinari but they are neither receiving my calls nor are
bothered to call me back for the same.

I say that, I am aggrieved by the act of the above named

Accused person(s) i.e. Mr. Chandrashekhar Jamanna Swami and Mr. Jayant
Shyam Sinari and the act committed by them is / are serious in nature and I have
been cheated / dishonestly induced by the above named Accused person(s) for

illegitimate / unlawful personal gains of total Rs. 2,79,57,190/- and the Interest
on Loan which I have paid to the Bank.

I say that, the above named Accused person(s) i.e. Mr.

Chandrashekhar Jamanna Swami and Mr. Jayant Shyam Sinari has committed
the offence(s) of Fraud, Cheating, Inducement and Criminal Breach of Trust.

I therefore hereby request your good office to register a

Complaint / F.I.R. against Mr. Chandrashekhar Jamanna Swami and Mr. Jayant
Shyam Sinari (“The Accused”), for committing offences punishable under
relevant Sections of The Indian Penal Code, 1860 and The Maharashtra
Prohibition of Interest of Depositors Act, 1999.
