Environmental Compatibility and Public Need Pursuant to Article 10 to
Construct a 201 MW Wind Energy Facility

Dear Secretary Phillips:

We represent Applicant Lighthouse Wind, LLC ("Lighthouse Wind" or "Applicant") in

the above-referenced proceeding. Pursuant to this letter, on behalf of Lighthouse Wind, we are
writing to notify the Examiners, the Siting Board, and the Secretary that Lighthouse Wind does
not intend to file an Article 10 Application at this time and is no longer seeking a Certificate of
Environmental Compatibility and Public Need from the New York State Board on Electric
Generation Siting and the Environment pursuant to Article 10 of the Public Service Law for the
Lighthouse Wind Project.

Apex previously deposited with the Board a $70,350 filing fee as required by PSL 164(4)
accompanying the Preliminary Scoping Statement that was filed in this proceeding on November
23, 2015 . Please contact this office if there are any remaining funds to be returned to Apex.

We appreciate the Secretary and Examiners' assistance during the pre-application phase of
this proceeding.
