Facts:

On 01 May 2021 at around 10:00 in the morning, a certain "AMINA" was apprehended
in a buy-bust operation conducted by PDEA-BARMM in front of McDonalds along
Parang Road, Cotabato City. Seized from the suspect is 500 grams of shabu with a
street value of P1,000,000.00.

PDEA was informed by the confidential informant that the dealer of the alleged drugs, a
certain "AMINA" was looking for a buyer.

Immediately, they set up a buy-bust operation with Intelligence Officer Christopher


acting as the poseur-buyer with driver IO Regatta as the arresting Officer. The back-up
operatives were led by Investigator Salazar.

After several phone calls, Amina arrived at the designated meeting place with Norjana.
They entered the parked vehicle of the civilian agents near the Catholic church. Upon
giving the marked money, Amina handed five (5) sachets of shabu to Officer
Christopher while the driver pressed the hazard button to signal that the sale was
consummated. The other operatives surrounded the vehicle and arrested the two (2)
accused.

IO Regatta prepared the Inventory of Seized Properties/Items and the inventory was
conducted before Kagawad Santos and Rey Daldal, a media representative. Both Kgd.
Santos and Rey signed the certificate of inventory for the five (5) transparent plastic
sachets. Afterwards, accused were brought to the PDEA office at PC Hill, Cotabato
City. IO Regatta turned over the confiscated items to their investigator, Officer Cortes,
who prepared a Request for Laboratory Examination of the subject specimens.
Thereafter, IO Regatta submitted the evidence to the crime laboratory for examination,
which gave positive results to the tests for shabu.

Prepare the following:

1. Complaint prepared by the PDEA (together with the judicial affidavits of


arresting/seizing officers)
2. Subpoena from the Prosecution directing the two (2) accused to submit their
counter affidavit
3. Resolution denying the counter affidavit of accused
4. Information
5. Pre-trial Brief for the Prosecution and Defense
6. Formal Offer of the prosecution
7. Comment/Demurrer of the Defense
8. Decision of the Court
