Sustainable development is development that meets the needs of the present,


without compromising the ability of future generations to meet their own needs."

Sustainable development is an organizing principle for meeting human development


goals while also sustaining the ability of natural systems to provide the natural
resources and ecosystem services on which the economy and society depend.
Sustainable development in India encompasses a variety of development schemes in
social, cleantech (clean energy, clean water and sustainable agriculture) and human
resources segments, having caught the attention of both Central and State
governments and also public and private sectors.

India is expected to begin the greening of its national income accounting, making depletion in
natural resources wealth a key component in its measurement of gross domestic product (GDP).

India's sustained efforts towards reducing greenhouse gases (GHG) will ensure that the country's per
capita emission of GHG will continue to be low until 2030-31, and it is estimated that the per capita
emission in 2031 will be lower than per capita global emission of GHG in 2005, according to a new
study. Even in 2031, India's per capita GHG emissions would stay under four tonnes of CO2, which
is lower than the global per capita emission of 4.22 tonnes of CO2 in 2005.

The SDGs are multi-dimensional and interconnected, and the scale of the challenge at hand is vast.
From India's point of view, Sustainable Development Goals need to bring together development and
environment into a single set of targets.

There are several laws which have been passed which include

● The Water (Prevention and Control of Pollution) Act of 1974


● The Forest (Conservation) Act of 1980
● The Air (Prevention and Control of Pollution) Act of 1981
● The Environment (Protection) Act of 1986

National Green Tribunal: The legislature enacted The National Green Tribunal Act
in 2010 after attending all major environmental conferences around the world. The
tribunal aims at effective and quick disposal of cases involving multi corporal issues
related to the environment. NGT is empowered to hear all matters related to
environment and has furthered the crusade of environment protection aiming for
better and effective implementation of sustainable development goals.

Act of 1974
● The Water (Prevention and Control of Pollution) Act of 1974 is a legislation
in India that was enacted to prevent and control water pollution in the
country.
● The Act provides for the prevention, control, and abatement of water pollution
and the maintenance and improvement of the quality of water in the country.
● It also establishes the Central Pollution Control Board and the State Pollution
Control Boards to regulate and enforce the provisions of the Act. The Act
applies to all sources of water pollution, including industries, agriculture, and
domestic sewage.It also provides for the establishment of effluent treatment
plants and the monitoring of water quality. The Act has been amended several
times since its inception to keep pace with the changing needs and
requirements of the country.

● The Forest (Conservation) Act of 1980 is a legislation in India that was


enacted to conserve the country's forests and wildlife.
● The Act provides for the conservation of forests and the diversion of forest
land for non-forest purposes such as agriculture, urban development, and
infrastructure projects.
● It also establishes the procedure for granting permission for the diversion of
forest land and the compensatory afforestation that must be undertaken in
case of such diversion.
● The Act also prohibits the felling of trees and the hunting of wild animals
without permission and establishes penalties for violating these provisions.
The Act has played a critical role in the conservation of India's forests and
wildlife and has been amended several times since its inception to keep pace
with the changing needs and requirements of the country.

Act

● The Air (Prevention and Control of Pollution) Act of 1981 is a legislation in


India that was enacted to prevent and control air pollution in the country.
● The Act provides for the prevention, control, and abatement of air pollution
and the maintenance and improvement of the quality of air in the country.
● It also establishes the Central Pollution Control Board and the State Pollution
Control Boards to regulate and enforce the provisions of the Act.
● The Act applies to all sources of air pollution, including industries, vehicles,
and burning of fossil fuels. It also provides for the establishment of
monitoring stations and the monitoring of air quality.

Of 1986

● The Environment (Protection) Act of 1986 is a legislation in India that was


enacted to protect and improve the environment in the country.
● The Act provides for the protection and improvement of the environment and
the prevention of hazards to human beings, other living creatures, plants, and
property.
● The Act empowers the central government to take measures to protect and
improve the environment and to prevent, control, and abate environmental
pollution. It also provides for the establishment of environmental courts to
deal with cases related to environmental violations.

KARNATAKA INDUSTRIAL AREAS DEVELOPMENT BOARD VS
SRI C. KENCHAPPA & ORS (Supreme Court Of India)

Case Backround: Farmers who possessed grazing lands for cattle, were affected by the acquisition
of lands by KIADB. They filed a petition under Article 226 for restraining appellant from converting
land of for any industrial or other purpose as they wanted to retain their land for grazing of cattle.
● The Karnataka High Court quashed the acquisition proceedings under Section 3 (1) of the
Karnataka Industrial Areas Development Board Act, 1966 to extent of land which were reserved
for grazing cattle, agricultural and residential purpose.
● It held that for maintaining ecological equilibrium and pollution free atmosphere of the villages,
KIADB had to leave land of 1 km. as a buffer zone from the outer periphery of the village in
order to maintain a green area towards preservation of land for grazing of cattle, agricultural
operation and for development of social forestry.
● The Court had also directed that whenever there was an acquisition of land for industrial,
commercial or non-agricultural purposes, except for the residential purposes, the authorities must
leave 1 km. area from the village limits as a free zone or green area to maintain ecological
equilibrium.
● An appeal was made to Supreme Court by the Farmers.

Judgement:

Supreme Court ruled in favour of the farmers and said that it comes under the The
Environment (Protection) Act of 1986.

Clearance should be obtained from State Pollution Control Board and the Department of
Ecology and Environment before execution of an industrial activity.

A 20 acre government land was also allotted to a R&D firm named “Gee India Technology
Center Pvt. Ltd.” by the government. establishment of Gee India Technology Centre Pvt.
Ltd. and its activities, is essential for the growth of the computer industry and research and
development in information technology, the Court did not wish to disturb the allotment of
lands made to Gee India Technology Centre Pvt. Ltd.

Villagers of Kudgi vs Ministry of Environment and Forest Go, change the world

Case Background: In this case, the plaintiffs, a villager, challenged the order of the Ministry of
Environment and Forests granting Environmental Clearance for a project setting up a Thermal Power
Project near the village Kudgi in Bijapur District Karnataka.

The plaintiffs claimed that they could not properly participate in the decision making process and that
they were not offered enough money to compensate the loss of their agricultural fields where the
power plant was planned.

Judgement: The National Green Tribunal held that if the planned power point was crucial for the
development of the region, the order still needed to be redrafted to integrate pollution mitigation
measures. Also, the judges stressed that the procedure provided by the law needed to be followed and
that, as a result, public authorities had to give public notice and hear the project affected people.
Consequently, the Tribunal remanded the order to the Ministry of Environment and Forests

Poverty
Poverty and a degraded environment are closely interrelated, especially where
people depend for their livelihoods primarily on the natural resource base of
their immediate environment.
Population
The growing population demands more natural resources and need for faster
city expansions, hampering sustainable development.
Lack of Education
Education is an essential tool for achieving sustainability. People around the
world recognize that current economic development trends are not sustainable
and that public awareness, education, and training are key to moving society
toward sustainability.

Lack of integrated Policy


First and important step of sustainable development requires an integrated
policy for development. Such policy must be made with consultation with
local people as their consultation makes themselves responsible for execution
of such policies.

Lack of proper basic amenities


Lack of proper healthcare, proper basic education may lead to migration of
population from rural areas to cities. Such migration results in over burden of
infrastructures in cities which may also be the cause of many kinds of
pollutions.

To conclude, it can be said that sustainable development brings out stability in the
requirements of the environment. Shepherding the achievements of the SDGs is an
enormous task that requires the involvement of every sector and each level of society. The
experiences of the pilot countries illustrate the opportunities the platform can create for India
to build meaningful and lasting state-philanthropy partnerships to achieve the prime
minister’s vision of “sabka saath, sabka vikas (collective effort, inclusive growth).

Although No Poverty is just one of the SDGs, it may be the most important to help us
achieve all the others. Perhaps that is why it is goal #1.

A final conclusion is that in order to achieve a more satisfactory relationship between society
and its environment, timely provision should be made for the changes that human activities
and competition over use of resources may bring about in order to minimize potential
conflicts
