NOTICE OF MOTION: APPLICATION FOR LEAVE TO INTERVE

KINDLY TAKE NOTICE that the Economic Freedom Fighters hereby make application

to the Constitutional Court for an order in the following terms:

1 that the Economic Freedom Fighters (“EFF”) is granted leave to intervene as the

sixth respondent in these proceedings, in terms of Rule 8 of this Court’s Rules;

2 that the EFF is granted permission to present written and oral submissions;

3 any party opposing this application is ordered to pay costs, including the costs of

two counsel; and

4 further and/or alternative relief.

TAKE FURTHER NOTICE that the accompanying affidavit of Floyd Shivambu, which

incorporates opposition to the main application, is attached setting the basis of

intervention.

TAKE FURTHER NOTICE that the EFF has chosen Ian Levitt Attorneys, The Leonardo,

Office Level 12, 75 On Maude Street, Sandton, 2196 at which delivery and service of all

processes and documents in these proceedings will be accepted.

TAKE FURTHER NOTICE that the EFF is also willing to accept all documentation and

communication via email to save costs and expedite the matter. This includes any

directive from this Court’s registrar or Chief Justice. The email address is:

TAKE FURTHER NOTICE that any further conduct of this application will be as per the
