1. PURPOSE AND SCOPE

The object of this document is to describe the HSE Requirements for VENDORS to be followed
in the execution of the Engineering and Procurement (EP) phase of the Project.

The document serves to ensure consistency and conformity in the supply of VENDOR
equipment and/or services in relation with the Health, Safety and Environmental requirements
applicable to the PROJECT.

This document neither abrogates nor modifies the contractual agreements between the
CLIENT and CONTRACTOR but provides the mechanism for carrying out the normal working
relationship between the parties during the Project execution.

Any Deviation to these requirements shall be clearly identified in the VENDOR´s Proposal.

This document addresses the following key HSE issues in relation to the supply of equipment:

• Health, Safety and Environmental requirements directed to VENDORS.

• Provision of data on hazardous substances.

• Material restrictions included in the scope of supply.

• Environmental, Ergonomic / Human Factor Engineering and Sustainability aspects,


which shall be addressed by VENDORS.

VENDORS supplying equipment and/or services shall observe the specifications established
in this document with the purpose of complying with the operational and HSE requirements
according to their scope of supply.

In case of discrepancy among codes, standards and specifications, it shall be the responsibility
of the VENDOR to bring it to the attention of the CONTRACTOR in writing for decision on
which document shall be followed. The ones which provide a higher level of safety to the
people and environment shall prevail until the resolution is officially communicated by
CONTRACTOR.

VENDORS supplying equipment and/or services must observe the specifications established
in this document with the purpose of complying with the operational and HSE requirements
according to their scope of supply.

2. DEFINITIONS

2.1 GENERAL

CONTRACT: Contract num FMI/SFSLRC/001/2022 subscribed between


CLIENT and CONTRACTOR for the completion of the PROJECT.

the attention of CONTRACTOR by VENDOR for resolution.

VENDORS shall comply with Project specifications, laws and Mexican regulations as
applicable. In addition, full consideration will be given to industry-accepted codes and

VENDORS shall observe also their amendments, updates and modifications, applying the
latest. VENDOR shall also comply and ensure compliance with the applicable industry
standards and good practices listed in the above documents.

4. DEVELOPMENT

4.1 LEGISLATION COMPLIANCE

VENDOR is obliged to be aware of, and comply with all applicable Mexican legislation, even if
is not mentioned in this document.

4.2 VENDORS POLICY AND HSE MANAGEMENT SYSTEM

VENDORS shall refer to their Corporate HSE Policy, Plan and Procedures, and can be
requested to provide a copy for information.

VENDOR shall submit a copy of his HSE policy and/or HSE Management System certification
(ISO 14001, ISO 45001).

4.3 VENDOR’S ACTIVITIES ON SITE

Any VENDOR (advisor, technician) entering in the Project site shall comply with all applicable
rules and regulations concerning HSE in Construction for the Project (CONTRACTOR and
CLIENT).

Any field services regarding only supervision works by VENDOR in the Project will require the
submission by VENDOR of the Risk Assessment of this activity for review and approval of

CONTRACTOR prior to be authorized to enter to the Site. An HSE responsible will be


nominated in order to be the focal point from HSE notifications in the Project (this role can be
assumed by one of the advisor or VENDORS in charge).

Any VENDORs whose supply includes works involving assembly, installation, visits,
inspections, on-site testing, etc. shall comply with all the requirements of the facility and provide
the necessary documentation to access Site as per HSE PLAN for Construction and Site
Project Procedures, and present all of the permits required by SEMARNAT, CONAGUA or
other applicable Mexican Ministry or Department.

4.4 HEALTH

4.4.1 Hazardous Substances

4.4.1.1 General

Hazardous materials are defined as any item or agent (biological, chemical, physical) which
has the potential to cause harm to humans, animals, or the environment, either by itself or
through interaction with other factors.

Whenever technically possible, hazardous materials or substances that are part of the
equipment, or are used in normal operation by them, must be substituted by others that are
not or less hazardous.

4.4.1.2 Substances list and SDS

VENDORS shall supply a list with all substances, 70240-INT-091-PD-0001-TMP02, being part
of the equipment, supplied materials or related to their normal operation- that could be
hazardous to human health and/or to the environment.

VENDORS shall provide copies of all Safety Data Sheets (SDS), with complete information of
substances supplied which could be hazardous for a person exposed, or with the potential to
be exposed, during transportation, storage, assembly or operation.

The SDS shall be provided in Spanish (Mandatory) and English.

The SDS shall also include the hazard identification signal according to the NOM-018-STPS
last version (a color-coded array of four numbers or letters arranged in a diamond shape).

VENDOR shall provide any and all necessary documentation to obtain the importation and
transport permits that will be required and shall coordinate with the forwarder appointed by
CONTRACTOR the attainment of such permits.

VENDORS assume all responsibility for its failure to supply CONTRACTOR a complete SDS
and required documentation for all potential hazardous substances included within their scope
of supply.

SDS shall conform to the signalling and labelling requirements exhibited in Appendix C of the
NOM-018-STPS last version.

4.4.1.3 Labelling

All chemical containers, e.g. storage tanks, barrels, bottles, shall be labelled with a name that
is traceable to its content and the SDS. Labelling must comply with NOM-018-STPS last
version and any other Mexican Regulations including appropriate hazard warnings.

The use of pictograms characterizing the hazards improves the communication. Labels shall
be in Spanish Mandatory and English and comply the signage requirements.

4.4.1.4 Transportation

Please refer to Packing, Marking and Shipping Instructions and Specific Conditions of the
Supply.

4.4.2 Restriction on Use of Substances

The use of the following substances is prohibited on the Project:

• Halons, Chlorofluorocarbons (CFCs), Hydrofluorocarbons (HCFC), In accordance with


the Montreal Protocol.

• 1,1,1-trichloroethane (methyl chloroform), Methyl bromide or


Hydrobromofluorocarbons (HBFCs) or any other substance defined in the Montreal
Protocol (and subsequent amendments to it).

• Polychlorinated biphenyls (PCB) including (PCT), Polychlorinated triphenyls and


similar substances.

• Asbestos.

• Carbon Tetrachloride (CCl4).

• Chromium-based corrosion inhibitors for cooling water treatment.

• Sulphur Hexafluoride (SF6)

VENDOR shall justify the selection of the refrigerants in the equipment, considering primarily
(if technically appropriate) those with a lower Global Warming Potential (GWP). This is to
minimize the greenhouse emissions during operations, and to minimize the potential for cost

increase in the supply and procurement difficulties due to new regulations and bans in
Fluorinated greenhouse gas (in particular hydrofluorocarbons HFC).

No Supply provided by VENDOR should contain any polychlorinated biphenyls (PCBs), and
NOM-133-SEMARNAT-2015 shall be applied.

VENDORS shall provide appropriate Safety Data Sheets (SDS) for chemicals and any other
hazardous materials used during the PROJECT performance.

Regarding NOM-165-SEMARNAT-2013, which establishes the list of substances subject to


reporting for emissions and pollutant transfer, VENDOR shall report to CONTRACTORS any
substance or material included in the Regulation.

4.4.3 Ionizing Radiation

Radioactive instruments or elements shall be avoided.

If used, specific and detailed information giving full details of radioactive sources shall be
provided, including procedures for safe maintenance. VENDORS shall apply appropriate
precautions in the handling and application of all equipment capable of radioactive exposure
or contamination of personnel. VENDOR shall provide warning signs with indication of the risks
according to applicable standards.

VENDOR shall provide a plan for the management and recovery of radioactive residues,
according to Mexican legislation.

Radioactive instruments or elements shall be avoided. If used, specific and detailed


information giving full details of radioactive sources shall be provided.

VENDOR shall apply appropriate precautions in the handling and application of all equipment
capable of radioactive exposure or contamination of personnel. VENDOR shall provide

Additionally, if radioactive sources are to be used VENDOR shall provide any and all
necessary documentation, certificates, etc., to obtain the importation and transport permits
that will be required and shall coordinate with the forwarder appointed by CONTRACTORS
the attainment of such permits.

VENDOR shall provide a plan for the management and recovery of radioactive residues.

4.4.4 Noise

4.4.4.1 General noise emission limits

In order to guarantee health of workers and ensure the protection of the environment,
VENDORS shall design the equipment within their scope of supply to comply with the
maximum Sound Pressure Level (SPL) limits, requirements, attenuation measures and
guaranties noise values included below.

Noise pressure requirements in working areas defined according to NOM-011-STPS-2001 are


included in the table:

The outside noise shall be reduced by a silencer before air handling unit or after air handling

Noise generated by the control valves except for emergency depressurizing and short period
steam venting applications shall not exceed 80 dB(A) included any tolerance measured at 1
meter distance downstream of the valve under their three operating conditions, (90% opening
at maximum flow, 70% opening at normal flow and 20% opening at minimum flow).

In case of exceeding the specified noise limit, any remedial action is considered as part of the
scope of the VENDOR

The estimated noise level shall be verified by EPC CONTRACTOR based on final design
criteria and VENDOR’s final calculations.

Note 5: Flare

Pumps of Flare Units shall comply with pumps trains’ noise requirements.

Compressor of Flare Unit shall comply with compressors trains’ noise requirements.

Note 6: Vents & PSV discharging to atmosphere

Vents intended for continuous service (or normal operation) shall not exceed 115 dB(A) in work
areas or manned platforms.

Vents intended for intermittent service (including start-up services) shall not exceed 115 dB(A)
at nearest work area or manned platform.

PSV VENDOR shall provide the following noise data sheet for each valve included in their
scope of supply:

• SWL values (Sound Power Level).

• SPL (Sound Pressure Level) vented in dB(A) through valve outlet nozzle.

• SPL (Sound Pressure Level) vented at 30 meters from valve discharge, according to
API 521 calculation standard.

• SPL (Sound Pressure Level) radiated in dB(A) through valve body at 1 meter from valve
surface.

Note 7: Acoustic restriction zone signage

When noise level exceeds 105 dB(A), there will be acoustic restriction zone signage. The use
of acoustic protection equipment will be mandatory.

4.4.4.3 Mitigation measures

When the estimated overall sound pressure level expected without noise control measures
exceeds the requested level, mitigation study, shall be provided by VENDOR upon
CONTRACTOR approval, at no additional cost.

VENDOR shall supply:

• Detailed design of proposed measures (special design and/or acoustic treatment).

• Details of noise reducing features (e.g. materials of construction, installation drawings,


and mounting / dismounting instructions, etc.), together with a copy of the defeating
materials SDS (if required).

• Calculations to prove the effectiveness of such control measures.

• Noise emission shall be indicated with and without noise reduction.

• The design / installation of acoustic insulation measures shall be applied following


International recognized standard.

The mitigation measures cost shall be provided by VENDOR for CONTRACTOR’s further
evaluation.

Noise control measures applied to equipment shall not interfere with the operation, efficiency,
safety, accessibility and running maintenance of the equipment. They shall, where appropriate,
be constructed so that they can be dismantled and reassembled at site without affecting their
acoustic properties.

In the case that silencing measures are necessary to meet the specified noise limits but outside
VENDOR’s scope, VENDOR shall indicate any such requirements as well as its basic details
in order to allow others to design the item.

4.4.4.4 Information to be submitted with the quotation

Information supplied by the VENDOR with his quotation shall include the following:

• Guaranteed sound pressure levels in dBA and octave bands (31 Hz – 8 KHz) at 1m
from the equipment surface for equipment of standard design and of special design or
with noise control features as appropriate.

• VENDOR shall state the operating conditions for his equipment at which noise levels
emitted by the equipment are at maximum (normally full load). Guaranteed noise levels
will apply at sated conditions unless otherwise agreed by the CLIENT.

• Details of noise-reducing features included in the supply and information on experience


with these features.

• If silencing measures outside the VENDOR’s scope are necessary to meet the
specified noise limits, the VENDOR shall state any such requirements.

4.4.4.5 Documentation to be provided by VENDOR

VENDORS shall provide filled Equipment Noise Data Sheets according to 70240-INT-091-PD-
0001-TMP01, additional information shall be provided on separate sheets when required.

VENDOR shall guarantee the values indicated in the Noise Data Sheet.

For Pressure Relief and Control Valves, VENDOR shall provide the following noise data for
each valve included in its scope of supply:

• SWL values (Sound Power Level)

• SPL (Sound pressure) vented in dB(A) through valve outlet nozzle.

• SPL (Sound pressure) radiated in dB(A) through valve body at 1m from valve surface

Calculation methods, standards, codes, etc. considered to obtain these parameters shall be
provided by VENDOR within the noise data sheet.

Depending on the size, the complexity and the distribution of the noise sources within the
package, VENDOR may be required to provide a noise level study of the complete package.
This is for example the case for Fired Heaters, where additional to the Noise Data Sheet, a
complete noise study including heaters casing, ducting, all burners in operation and stack,
shall be provided.

If applicable, guaranteed sound power levels in dBA and octave bands (31 Hz – 8 KHz) for
equipment of standard design and of special design or with noise control features. The
calculation method shall be shown in detail. Where equipment sound pressure levels
guaranteed by VENDOR exceed 85 dBA, sound power levels shall also be supplied even if
not specifically required by the data sheet or requisition.

Expected or measured noise levels in dBA and octave bands (31 Hz – 8 KHz) for equipment
of standard design and of special design or with noise treatment.

VENDOR shall state whether the noise source exhibits distinctive narrow band or impulsive
characteristics and indicate the dominant frequencies.

Wherever possible noise test reports should be submitted, since this may enable CLIENT to
waive the requirements for any noise acceptance testing. In any case additional costs
associated with noise acceptance testing should be stated.

4.4.4.6 Measurement and guarantees

VENDOR shall state noise guarantees for the equipment included in the scope of supply.

CONTRACTOR maintain the option to verify the sound level data of the equipment at the
VENDOR plant prior to shipment, at the CLIENT test facilities, or after installation. All costs
associated with noise testing shall be shown as separate line items in the VENDOR’s bid
package.

If the sound level of the equipment exceeds the data quoted by the VENDOR, it will be the
VENDOR’s responsibility to make all the necessary corrections to the equipment to meet the
quoted sound levels. VENDOR performance responsibility will be for the duration of the stated
warranty period.

Noise measurements procedures shall be of technical standard and be subject to approval by


CLIENT / CONTRACTOR.

4.4.5 Ergonomics / Human Factor Engineering

4.4.5.1 Access and egress

Equipment supplied shall comply with following specifications:

• Project Piping Design Basis

• Project - General Requirements for Packaged Units

• Project - Ladders and stairs standard drawings

VENDOR design shall consider adequate access and egress for personnel, materials, and
equipment, provided via an appropriate arrangement of access ways, ladders, passages,
stairways, walking / working surfaces, decks, platforms, ramps, etc. based on the requirements
of Project specific standards as well as official regulations.

VENDOR drawings will be reviewed and commented by CONTRACTORS as applicable.

Adequate access and egress for personnel, materials, and equipment, shall be provided via
an appropriate arrangement of access ways, ladders, passages, stairways, walking / working
surfaces, decks, platforms, ramps, etc. in accordance with the Official Mexican Regulation
NOM-001-STPS-2008 and with OSHA requirements, Codes, Standards and PROJECT
specific requirements.

Manually operated valves shall be positioned at optimal height and reach for operation and
maintenance. Instrument displays, gauge glasses and viewing ports shall be located,
wherever possible, at eye level for the user while the user is in the normal viewing position.

Power operated valves shall also include equipment for manual operation by means of a
handwheel or other suitable device which shall be interlocked with, and fixed to, the power
unit.

Instruments shall be positioned at suitable height and reach, or ease of maintenance and
calibration, without compromising operational requirements.

Pressure vessels shall include man-holes, hand-holes and/or other openings for inspection,
to examine and clean the vessel, unless they are provided with removable cap wide enough
for that aim. Exception is made to those vessels in which inspection holes are not feasible.
Access to man-holes shall be possible from grade, from their own platforms or from one stage
of scaffolding.

All necessary platforms, kickplates, ladders, stanchions, handrails, chains, and all associated
fittings shall be supplied to provide a safe installation.

Platforms shall be provided around equipment as required for maintenance work, testing,
inspection and safe operation. Platforms shall be sized to facilitate safe and ergonomic
operation of manual valves and equipment between waist and shoulder level of a standard
man. Relief valves shall be grouped together, and an access platform provided. Operating
valves which cannot be serviced from a platform shall be operated by other means as agreed
with CONTRACTORS / OWNER.

All valves, equipment, instruments, actuators, etc. shall be capable of being actuated from an
operating floor level and all the instruments shall be readable and accessible from an
operating floor level. Alternatively, platforms for operation and maintenance shall be provided.

Ladders and stairways shall meet the more stringent of Local Regulation, OSHA
requirements, Codes and Standards, or the PROJECT requirements.

Access ladders and emergency egress ladders shall be provided as required in NOM-001-
STPS-2008 and other applicable regulations.

Handrails shall be provided on each side of the stairways.

Whenever load exceeds 25 kg weight, lifting aids shall be provided.

Health signals shall comply with the Official Mexican Regulation NOM-026-STPS-2008.

4.4.5.1 Operation and maintenance

possible, at eye level for the user while the user is in the normal viewing position. Instruments
shall be positioned at suitable height and reach, or ease of maintenance and calibration,
without compromising operational requirements.

Pressure vessels shall include man-holes, hand-holes and/or other openings for inspection, to
examine and clean the vessel, unless they are provided with removable cap wide enough for
that aim. Exception is made to those vessels in which inspection holes are not feasible.
Adequate access to man-holes shall be provided.

Machinery and equipment which requires regular / frequent attention shall be positioned at
optimal height and reach for the user operator, maintenance and inspection.

Equipment, such as blinds, heat exchanger tube sheets and heat exchanger bonnets, which
only require access during maintenance, shall be provided taking into account that
maintenance work can be safely performed from their own platforms or from one stage of
scaffolding.

The location of lubrication and seal buffer systems shall not occupy the free space required for
operation, maintenance, inspection, and testing. Grease nipples shall be easily accessible.

The height and position to which the equipment and instruments are placed shall be adequate
for safe operation and maintenance and shall also ensure the ergonomics of these operations
for the personnel. The Safety and Health signage will comply with Mexican Official Standard
NOM-026-STPS-2008.

Workplaces, passageways and stairways will comply with Mexican Official Standard NOM-
001-STPS-2008

4.4.5.2 Load handling

All equipment, equipment parts, piping items (such as valves, strainers, removable spools, line
blinds, etc.) which exceeds twenty-five (25) kg and requires dismantling for maintenance, shall
be provided with appropriate lifting aids such as to allow for use of lifting and transportation
equipment

4.4.5.3 Requirements for Sampling

Process sampling systems, if any, must be designed by VENDOR in such a way that the risk
of exposure of the operator to the hazardous process fluid is minimized.

The process sampling systems must be closed systems and designed in such way that the
exposure of operators to hazardous substances processed in the equipment, package unit,

etc. is minimized. Wherever possible, sampling positions shall be set to be accessible at


ground level and at the optimal height for the operator, normally between elbow and shoulder
level.

The process sampling systems shall be closed systems and designed in such way that the
exposure of operators to hazardous substances processed in the equipment or package unit
is minimized. Wherever possible, sampling positions shall be set to be accessible at ground
level and at the optimal height for the operator, normally between elbow and shoulder level.

The stack shall be provided with safe access to sampling points for the continuous emissions
monitoring system (CEMS).

An eyewash and emergency shower shall be installed in the vicinity of the Sampling systems.

4.4.5.4 Controls and Displays

Instrument displays, indicator dials and gauges shall be consistent in their logic and arranged
such that, under normal operational conditions, all indicators shall point in the same direction.
The graduations shall be static and the pointers moveable. Displays, control switches and
buttons shall be arranged to optimize ease of operation and be prioritized according to
importance.

Displays and arrangements of push buttons or indicators shall mimic the orientation of the
components on the unit to present the operator with a logical sequence of operations relative
to the process. All labels display and signs shall be easily readable at eye level from the normal
position of the operator, for example, standing or seated.

The following shall be considered for displays:

• The ratio of the size of the features on the display to the viewing distance.

• The contrast of the features against the background.

• The illumination levels to ensure good readability and avoid glare from natural light.

• The form of the display (for example, graphic, letters or figures).

• The font size and type (for letters and figures).

• Duration of the display (where applicable).

• Combinations of colours.

• Push buttons to have clear covers to prevent accidental operation.

4.4.5.5 Skid Mounted Units

In the design and installation of packaged units the following guidelines shall be followed:

• All equipment, instrumentation, etc. that require regular maintenance must be located
as close as possible to package limits. If this is not possible, safe access should be
provided for the operator to equipment, valves, etc. Furthermore, the height of these
items of equipment, valves, etc., should assure the most ergonomic operation for
personnel.

• All screens and instrumentation visualization elements must be installed at operator


eye level, such that they can be observed in a sequential manner by the operator and
from only one point of observation. The screens must be protected from the sun or
correctly illuminated, if necessary.

• All junction boxes are to be easily accessible.

• All electric and instrumentation cable conduits, drainage trays, etc. should be set in
such a way to not represent an obstacle to operation and maintenance of valves,
pumps, etc.

• The package units must have steps or access ramps at package level.

• VENDORS of package units should indicate, if it is necessary, to have free access


around its package unit area.

• Drains and closed vents of the package unit and equipment must be conducted to the
battery limit of the equipment or package unit.

• VENDORS of package units must have indicated the total weight.

4.5 SAFETY

4.5.1 Operation and maintenance manual

VENDOR shall include all the instructions about safe operation, maintenance and assemble
of equipment in the Operations and Maintenance Manual.

The safety requirements must contain all permissible hazard types and shall be specified so
as to ensure safety throughout its service life.

All engineering solutions and occupational safety, industrial safety, fire safety and
environmental protection measures shall conform to current laws and regulations.

The minimal content of the Operations Manual shall be the following:

4.5.2 Certificates and permits

VENDOR shall provide the licenses, certificates and any other document required as per local
regulations, Project regulations, codes and standards referenced in any document of the
requisition.

This applies to pressure equipment, explosive atmospheres among others.

4.5.3 HAZOP and SIL Studies for Packaged Equipment or Units

HAZOP, SIL assignment, or other HSE Reviews can be conducted when VENDOR
documentation is mature enough, and according to CONTRACTOR scheduling.

For package units or equipment such as (but not limited to) compressors, furnaces, turbines,
chemical injection packages, water treatment, or others, VENDOR will be requested to:

• Ensure the attendance of appropriate personnel for the study sessions at


CONTRACTOR´s offices (Madrid) and or videoconference.

• Supply all necessary information of the equipment for the correct development of the
study.

Information to be provided for the appropriate development of safety studies includes, but is
not limited to:

• Piping and Instrumentation Diagrams (P&IDs).

The attendance to these studies as well as the provision of required information shall be
integral part of VENDOR’s supply and provided, as required, at no additional cost.

VENDOR shall provide the support required by CONTRACTOR to close the recommendations
generated during the different safety studies and shall update the affected documents with the

incorporation of the agreed (and approved by CLIENT) solutions to these actions, at no


additional cost.

4.5.4 Review of Layout Drawings by CONTRACTORS

VENDOR shall respond positively to CONTRACTORS requirements ensuring that all aspects
of operation, maintenance and safe spacing in the layout are addressed according to local
Regulation NOM-001-STPS-2008, PROJECT Standards and Specifications. Draft installation
layout drawings and piping general arrangement drawings shall be provided to the
CONTRACTORS for review before layout is concluded.

4.5.5 Machinery Guarding

Moving parts of motors, pumps, compressors, fans, wheels, gears, etc. shall be covered and
with adequate protection guards. Machine guarding requirements and design shall be in
accordance with the applicable Safety Rule or Standard.

• Machinery guarding shall be solid and made of:

a) Metal or solid perforated metal plates or expanded metal or woven wire mounted
on iron frames, iron tubes or iron solid bars.

b) Wood, plastic or any other material, as long as it is appropriate to the aim that it is
going to be used.

• If a special coating, painting or treatment is required for machinery materials, it should


be taken into account for the guard itself to avoid its corrosion or damage.

• Guards located in hazardous areas, where flammable or explosive mixtures may be


present, shall be designed so that they will not create a source of ignition, according to
the section “Hazardous Area Classification” in this document.

• All dangerous moving parts from machines for filling, packing, labelling, weighing, etc.
shall be provided with guards which avoid operator fingers, or any other part of the
body or clothing can be trapped.

Machinery protections shall comply with Mexican Official Standard NOM-004-STPS-1999.

4.5.6 Insulation for Personnel Protection

VENDOR shall apply the personal protection insulation measures for pipes and equipment
included in Project Specification for Insulation.

Personnel protection insulation shall be used to prevent contact between hot / cold operating
surfaces and personnel working near the equipment. The following requirements apply to all
piping, equipment and surfaces to which personnel could be exposed to:

• Pieces of equipment and piping having a surface temperature above 60°C in normal
operation shall include personnel protection or heat conservation insulation according
to process requirements.

• Pieces of equipment and piping having a skin temperature below -7 ºC shall also be
insulated with cold insulation. These insulations could be applied also as a personal
protection.

• Insulation for personnel protection shall be confined to areas of piping and equipment
within two and a half (2.5) m vertical or one (1) m horizontal reach of walkways, working
platforms and access ladder.

The scope of insulation inside the equipment or package unit supplied by VENDOR must be
specified in the Requisition. VENDOR shall assure package design is in compliance with the
requirements mentioned above and therefore necessary provision for insulation installation
within package battery limit shall be foreseen.

4.5.7 Packages Safety Signs

Packages VENDOR shall identify and signpost the hazards and risks according to applicable
legislation / regulation.

The Safety and Health signs will comply with Mexican Official Standard NOM-026-STPS-2008.

4.5.8 Hazardous Area Classification

VENDOR shall comply with all safety requirements to be demanded by the area in which the
equipment or packaged unit will be installed.

The area in which the equipment or packaged unit will be installed shall be specified by
CONTRACTOR in the equipment data sheets.

VENDOR shall satisfy all legal requirements relevant to risk evaluation, documentation to be
supplied, necessary certifications, etc.

VENDOR shall provide the electrical protection certificates of the equipment. VENDOR will
satisfy all legal requirements and protection system for potentially explosive atmospheres
indicated in the applicable regulation. Also, if applicable, CE, UL or GOST applicable marking.

Electrical certificates and declarations of conformity will be requested by CONTRACTOR when


applicable.

For those packages where, different sources of release are present so as to generate a specific
classified area, VENDOR shall carry out and provide Hazardous Area Classification Drawings
of the whole package.

Hazardous Area Classification shall be in accordance with:

• NOM-001-SEDE Last Version

4.5.9 Escape routes

If VENDOR supplies shelter / structure / stairs / ladders with the possibility of workers access,
the following minimum requirements shall be applied, as well as all applicable standards and
regulations:

• Escape routes shall take the most direct route away from a hazardous area to a safe
haven
• Minimum horizontal clearance for access ways (on grade and elevation) and elevated
walkways shall be 0.9 m
• Minimum horizontal clearance for thoroughfare shall be 1.2 m. Thoroughfare is one
which is routinely used by people passing in both directions e.g. main access ways.
• Minimum head clearance over walkways and platforms shall be 2.2 m.
• Escape ways shall permit the transfer of injured people including those who may
require transport by stretcher.
• Escape routes shall be identified to ensure that they remain unobstructed as the design
progress.
• Escape routes shall be identified at all working elevations.
• Escape routes dimensions shall be 1.2 x 2.2 m.

4.6 ENVIRONMENT

VENDORs shall confirm compliance with all PROJECT, National and Local Environmental
Requirements and Regulations, as well as any other applicable requirement, and apply them
in their design and within their scope of work.

VENDOR shall follow the latest editions of any other regulation or requirement as required by
authorities of Mexico or any local authorities.

VENDOR shall comply with the Environmental Impact Assessment Study (MIA), the DGIRA
Resolution and the Environmental Permits for this PROJECT. The most restrictive
requirements must be considered and complied.

4.6.1 Noise

The VENDOR shall provide their equipment within the noise limits requested in section 4.4.4
of this document. The VENDOR shall provide all the noise data required by Contractor, in order
to minimize the effect of the Plant activities on the surrounding areas and to guarantee that the
Environmental Noise Levels on site boundary Plant comply with the limits required by the local
Regulation NOM-081-SEMARNAT-1994.

The design of the equipment to be installed in the Project must consider that, during the
operation stage, the maximum permissible noise level of 65 dB (A) will not be exceeded from
22:00 to 06:00 hrs, and 68 dB (A) from 06:00 to 22:00 hrs, measured in the perimeter of the
plant and considering the joint operation of the equipment in operation.

4.6.2 Emissions to Air

All potential sources of emission (for point sources and for fugitive sources) shall be identified
and described in detail by VENDOR.

For each emission source, VENDOR shall provide detailed information on all the emission
sources by filling the table enclosed at the end of this document as 70240-INT-091-PD-0001-
TMP03:

• Quantity emitted (by period of time) in normal operation, during site installation,
commissioning, start-up, shutdown, maintenance, and in any abnormal operation.

• Composition and frequency of emission (chemical species adapted to the applicable


framework: limit emission values).

• Characteristics of the source: i.e. continuous, emergency

These data shall be provided for normal operation, start-up, unusual and emergency
operations. CONTRACTOR reserves the right to request VENDOR to provide these data for
any additional condition / operation.

The following emission limits shall be applied:

a) Natural Gas
Atmospheric emissions from gas turbines, under 51% to 100% load, must not exceed the
following limits.

laboratory under the terms of the Federal Law on Metrology and Standardization, which must
be approved by the Employer prior to contracting.

Water injection is NOT acceptable in this case, nor is the installation of Selective Catalytic
Removal type emission control systems.

4.6.2.1 Air Quality

VENDOR shall provide all the necessary data for CONTRACTOR to check compliance with
requirements. If values are expected to be exceeded, VENDOR shall include mitigation
measures proposed the estimated emission expected values out of his equipment for
CONTRACTOR’s evaluation and acceptance.

VENDOR shall collaborate- under the scope of its air pollution sources – with the applicable
air quality standards.

VENDOR shall confirm that emissions from their package or equipment do not result in
pollutant concentrations that exceed the ambient air quality standards and listed in NOM-022-
SSA1-2010, NOM-025-SSA1-2014 and NOM-023-SSA1-2021 regulations. If values are
expected to be exceeded, VENDOR shall propose the estimated emission expected values
out of his equipment for CONTRACTORS’ evaluation and acceptance.

4.6.2.2 Emissions from Exhaust Stacks

Gaseous emissions from any equipment or package shall comply with:

VENDOR shall also ensure compliance with the above-mentioned regulation, Official Mexican
Regulation NOM-085-SEMARNAT last version, when selecting emission performance test
methodology.

VENDOR shall confirm that emissions from their package or equipment do not result in
pollutant concentrations that exceed the ambient air quality standards and listed in the above
mentioned NOMs, as well as the emissions are as low as reasonably achievable (including
fugitive emissions).

VENDOR shall provide all the necessary data for CONTRACTORS to check compliance with
Mexican Regulations. All potential sources of emission (for point sources and for fugitive
sources) shall be identified and described in detail by VENDOR. For each emission source,
VENDOR shall provide at least the following information:

• Quantity emitted (by period of time) in normal operation, during site installation,
commissioning, start-up, shutdown, maintenance, and in any abnormal operation.

• Composition and frequency of emission.

• Characteristics of the source.

Where direct release to atmosphere is possible, vent exhaust shall be located at Safe Location.

Whenever applicable, VENDOR shall provide detailed information on all the emission sources.

4.6.2.3 Fugitive Emissions

All equipment and components must be designed to prevent or minimize the Volatile Organic
Compounds (VOC) and organic HAPs fugitive emissions.

The emission of VOCs shall be limited through the utilization of good maintenance and
inspection procedures as well as monitoring of potential VOC emission points.

Fugitive emissions from pumps, compressors, flanged joints, etc. shall be minimized
by state of-the-art technologies:

• Connections number is to be limited to the minimum required for safe and practical
operation and maintenance;

• Where applicable, the pumps should use double mechanical seals or seal-less and
compressors should use dry gas seal;

• Hydrocarbon vapours should be either contained or routed back to the process system,
depending on process pressure level.

VENDOR shall provide all the necessary information for CONTRACTOR to check compliance
with the applicable standards and Mexican Regulations.

VOCs’ air emission levels from oil/water separators shall comply the requirements established
in Official Mexican Regulation NOM-075-SEMARNAT-1995.

4.6.3 Liquid effluents

The composition of the liquid effluents generated by any equipment supplied by VENDORS
shall meet the requirements of Manifiesto de Impacto Ambiental (MIA) and correspondent
Resolutivo.

VENDORS must comply with the provisions of current environmental legislation applicable to
the discharge of wastewater from the Plant, as indicated in other state and municipal
provisions, agreements, etc., with the provisions of the Particular Discharge Conditions
indicated in the Discharge Concession as well as with NOM-001-SEMARNAT in its latest
version at the signing of the Contract, the foregoing for the parameters that are not specified
in the discharge title.

Any direct dumping or discharge of effluents to the sea/river, soil or groundwater is not allowed.
The effluents shall be properly collected in order to carry out final treatment and disposal.

VENDOR shall clearly identify and quantify the effluents generated by its equipment in normal
operation (in each operating case, if more than one case), during installation, commissioning,
start-up, shutdown, maintenance and in any abnormal operation. VENDOR shall be fully aware
and responsible of any change of the above required limits discharges in what it comes to the
impact of wastewater treatment plant design.

VENDOR shall clearly identify and quantify the effluents generated by his equipment in normal
operation (in each operating case, if more than one case), during installation, commissioning,
start-up, shutdown, maintenance and in any abnormal operation.

When direct discharge is permitted, applicable for wastewater treatment plants, VENDOR the
following regulations shall be complied:

• NOM-001-SEMARNAT-2021, for water bodies direct discharge.


• NOM-002-ECOL-1996, for urban or municipal sewage system discharge.
Prior to its discharge, it will be corroborated the effluents meet the quality standards set forth
with the maximum permissible limits set in the above-mentioned standards and regulations,
with respect to the monitoring, the volume and quality of water sent to the discharge point.

The most stringent limits shall apply per each parameter.

4.6.4 Waste Management

VENDORS shall identify the nature and quantity of waste that will be generated during the
lifetime of the equipment supplied. All efforts shall be made in order to minimize the generation
of waste. VENDOR shall advise disposal options for waste that will be generated, specifically
considering options for prevention, reduction, re-use, recycle, treatment and recovery.

VENDOR shall recommend the best available method for reuse, recycle or removal of all
residues generated during the whole life cycle of the package unit, equipment or component
supplied.

Segregation, collection, handling, storage, transportation, treatment and disposal of waste are
specified to be in accordance with local legislation. The classification, handling and disposal
of a waste shall comply with the Official Mexican Regulation NOM-052-SEMARNAT-2005, as
well as NOM-161-SEMARNAT-2011.

This minimum information to be provided by Vendor includes:

• Waste identification (Name, identification number)

• SDS data (if Available)

• Kind of waste (dust, liquid, particles, solids, etc.)

• Quantity

• Handling

• Conditions and storage requirements

• Recommendation regarding the best available techniques for the reuse, recycle or
disposal

A table similar to the one provided at the end of this document as 70240-INT-091-PD-0001-
TMP04 shall be used by the VENDOR to provide the required data for each identified waste.
