Chapter 4 Forests and forest land management, PD 705

1. DENR Secretary et al v Mayor Yap et al (Boracay)

 PD 705 classifies all unclassified land of Public Domain as Public Forests
 Public forest land being unclassified land of public domain belongs to the state
under the Regalian Doctrine
 Public forest land is inalienable and cannot be subject to Judicial confirmation of
imperfect title
 Pursuant to PD 705 only the executive branch has the authority by positive act to
release lots for disposition
 Forest here is a legal status not a descriptive appearance

2. People vs. Dator and Genol, Telen (Dude cuts trees from his
motehr’s land without government permit)
 Any person that shall cut, collect, replace and possess forest products from any forest
land or timber from alienable and disposable public land or private land without legal
documents required shall be punished under the RPC
