Ulticon Builders, Inc. (UBI), a Quadruple “A” and ISO Certified General Contractor with principal
place of business in Don Julian Rodriguez Sr. Avenue, Ma-a Davao City, counts on its Survey Section to
spearhead its construction activities in various DPWH-implemented projects in Regions X, XI, and XIII. As
such, it is imperative that survey activities be done with utmost haste and professionalism as any delay in
accomplishing our target survey date would absolutely result in the delay of the overall actual construction
activities in any UBI-awarded project.
It has come to my attention that on October 29, 2022, you left your designated workplace
assignment at Bukidnon. In your private message pertaining to the said act (sent through facebook
messenger Oct 29, 2022), you stated that “nag-uli nako sa amoa sir, di nako mubalik bukidnon wa nako
kasabot didtoa, laay na kaayo”. Upon further inquiry, Admin Officer (A.O.) Jill Bura-ay confirmed that you
indeed went home to Davao Last Saturday (October 29) after you only worked half-day without approval,
and that until as of October 3, 2022 you still have yet to report back to work in your designated workplace
assignment. As such, under our UBI Code of Conduct (Page 45 on Specific Guidelines for Application for
Leave of Absence), “Employees on continuous three (3) days or more absence without notice and
approval shall be considered AWOL (absence without official leave)”. As a result, you shall be considered
AWOL if you do not report to duty in your designated workplace assignment on October 4, 2022. If you
cannot report to work during the said date or later than said date, “the immediate head should submit a
report to HR, and after due investigation, an invalid explanation shall be sufficient ground for disciplinary
action (with the 1st Offense penalized by a 3-day suspension)”.
In addition, we would also like to remind you that under the terms and conditions of your duly
signed employment contract (Dated May 6, 2022), provision no. 3 provides that “You agree that all times
during and for a period of twelve (12) months after your employment with the Company, you will not seek
or accept employment with, or in any manner render any services, directly or indirectly and in whatsoever
capacity, to any person or entity engaged in similar businesses to include business partners of the
company”. If you otherwise wish to resign, you are bound by the said clause the agreed employment
contract, which shall be in effect up to twelve (12) months after you end your employment with the
company. If you should pursue said course of resigning or be dismissed from employment due to
cumulative AWOL violations (Up to 5th offense), said act shall be considered as a breach of contract
wherein the company has an option to pursue a civil action in court against you, as well as other remedies
that may be provided by law.
As such, UBI would like to immediately seek a response from you regarding this matter as soon
as you receive this letter.
