 Vision:

 An economy that is free from Optical Media Piracy and where there is a level playing field for
all legitimate players. 

Mission 

To protect and promote intellectual property rights in digital form. 

 Service Pledge

 Optical Media Board promises to help develop a booming and robust industry free from optical
media piracy. Monitor compliance with R.A. 9239 with your assistance through Hotline (02)
7905-1678 and its website www.omb.gov.ph. Be responsible and answerable to the public by
ensuring efficient and accurate service and with courteous employees to attend to your needs
Mondays to Fridays with No Noon Time Break.

1. The mandate of the office

                       Under the R.A. 9239 or the Optical Media Act of 2004, the Videogram Regulatory
Board (VRB) shall be reorganized into Optical Media Board (OMB) to ensure the attainment of
the objectives of the said Act, which will be attached to the Office of the President and be
responsible for the following:

 (a) Formulate and implement such policies and programs are necessary for the accomplishment
of the purposes of this Act;

 (b) Evaluate the qualifications of any individual, establishment, or other entity to engage in the
mastering, manufacture, or replication of optical media. For this purpose, the OMB shall require
such a person to substantiate his capability to engage in said activities;

 (c) Supervise, regulate, grant, or renew licenses for specific periods, or deny, suspend, or cancel
the same, subject to such conditions as it may impose, for the activities enumerated in Section
13(a), (b) and (c); 
(d) Conduct inspections, by itself or in coordination with other competence agencies of the
government, at any time, with or without prior notice, of establishments or entities, including
those within the economic zones engaged in the activities as provided in Section 13(a), (b) and
(c) of this Act and employ reasonable force if the responsible person or persons of such
establishment or entity evades, obstructs, or refuses such inspection. For this purpose, the agents
of the OMB shall be considered agents in authority;

 (e) Apply for or obtain search warrants from any court of law or take into preventive custody
any optical media and material or equipment, including parts, accessories, and paraphernalia
used for the mastering, manufacture, or replication of visual media which are found in any
premises if the OMB has reasonable ground to believe or suspect that these are evidence of a
violation of the provisions of this Act;

 (f) Act as the complainant in the criminal prosecution of violators of this Act; 

(g) Hear and resolve administrative cases against violators of this Act and impose administrative
sanctions including, but not limited to, the imposition of fines and penalties; confiscation of
optical media; and suspension, nonrenewal, or cancellation of the license to operate and closure
of establishments or entities that violate the four provisions of this Act. For this purpose, the
Board shall have the power to issue subpoena or subpoena duces tecum to compel the attendance
of witnesses and production of documents and other effects;

 (h) Call upon law enforcement agencies and the managing authorities in the economic zones for
assistance in the implementation and enforcement of its decisions, orders, rules, and regulations;

 (i) To deputize, whenever necessary, provincial governors, city and municipal mayors, and
representatives of the national government agencies, organizations representing copyright
owners, neighboring rights owners, and concerned sectors to help monitor compliance with and
report to the OMB any violation of this Act; 

(j) Require persons, establishments, and entities engaged in the activities in Section 13 to keep
and maintain for at least five (5) years accurate and complete records of all activities related to
the conduct of its business. For this purpose, the Board may, at any time, require the production
of such documents and samples of optical media from each mastering, manufacturing, or
replicating line;

 (k) Levy, assess and collect, and periodically adjust and revise the rates of fees for the issuance
of licenses granted under this Act 

 (l) Establish support offices as may be necessary; 

(m) Create and maintain a database and regularly publish data containing the list and activities of
registered and licensed optical media and other related establishments. Any enforcement agency,
including the Bureau of Customs, may refer to this database for enforcement and seizure; 
(n) Prescribe the internal and operational procedures for the exercise of its powers and functions,
the performance of its duties and responsibilities, and other related matters; and 

(o) Exercise such other powers and functions as may be necessary or incidental to the attainment
of the purposes and objectives of this Act and perform other related duties and responsibilities as
may be directed by the President.

           Figure I shows the three (3) levels of the organizational structure of OMB.

The functional description of the organization is as follows:

The Board  - is the policy-making body of the agency.

The Chairman and CEO oversee the effectiveness and efficiency of policy implementation,
plans, and programs as determined by the Board by RA 9239 and its implementing rules and
regulations. 

Executive Director - He serves as the OMB secretariat to assist the Chairman and CEO in
supervising and directing the agency's day-to-day operations.
Board Secretary - Is in charge of preparing the meeting minutes of the Board, coordinating the
time and venue, and maintaining the Board Resolutions and Issuances. 

Internal Audit Services - Manages the review of internal controls and the process to ensure
efficiency and improvement. 

III. Organizational Change

           Under R.A 9239 Section 7, "The Chairperson and regular members of the Board shall
hold office for three (3) years unless sooner removed by the President for cause…."
      

           Based on those mentioned above, the complete control in changing the organization's
leadership shall be in the hands of the President of the Philippines. However, the organizational
change that the author of this paper wants to convey is the behavior of the existing members of
the organization, as each individual has their kind of strategy and plans in terms of leadership
and management.

IV. Leadership

Leadership is universally desired. However, it isn't easy to define. Many scholars have found
their studies on theories and principles about leadership. However, the culture and the people are
vital in determining leadership. 

Regardless of the theories and studies about and definitions of leadership, words must be put into
action. 

As mentioned, the power and duties of the Chairman and CEO of OMB is clearly defined under
R.A 9239 Section 11 a to f. The management and functions as stated therein do not define the
leadership of the Chairman. 

V. Management and Control

Under the Quality Management System of the Optical Media Board, they outsource some
services to perform such duties as they need more workforce. Equipment and Technical Know-
how. 

Currently, the agency uses the PESTLE Analysis to guide decision-making. The decision of
implementation and monitoring of such action plans are being made through annual planning
sessions, 

Therefore, the author noticed that despite the team members' promising talents and skills,
funding is a big concern as the agency is a non-income-generating organization focusing more on
regulations.

One of the strengths of the organization is its demographic profile. The OMB has a diverse
background composed of different generations, which helps balance the organization's culture.
Due to the team's hard work, they could partner with other stakeholders to deliver their services. 

The pandemic has a relative impact on the organization as no enterprises are operating. Since the
start of the pandemic, OMB has continuously sought for alternatives to be relevant and ensure
that in the rise of digitalization, all contents and resources must comply with the regulations. Due
to the policies in terms of safety protocols, the agency has set up sub-offices with their partners'
help to ensure that their services will still be accessible to their clients. 

The main office of the Optical Media Board is located in Quezon City; some clients need help
with complying with some documents to be submitted physically in their office. In addition, the
agency must also upskill their people to ensure that they can cope with changes that they have to
implement due to the pandemic, and that is to be technologically oriented and skilled; however,
the budget limits them from hiring people to meet their requirements and plans. 
The threat identified in this study is that many people in the workforce are retiring. Thus, people
are resistant to complying with the changes implemented as they think they cannot further
contribute because they will leave the organization sooner. 

1. Major Issues

           The significant issues of the organization are the workforce and budget. Force is vital to
the organization as they are the working agents to materialize all the plans and goals of the
organization. However, they cannot resolve this problem because they also need more money to
pay the workforce. 

VII. Recommendations

The author of this paper recommends the following.

1. It is suggested to have a thorough analysis regarding the right-sizing of the workforce as


many workers are placed through job orders. The management may review the existing
job orders and contractual and time of service personnel to maximize the budgetary
payroll requirements of the organization. 
2. Conduct a one-on-one consultation with the President of the Philippines, as he can
allocate additional funding, and shall be processed through legislation. 
3. Consult with the Commission on Civil Service to make a policy that will allow the
agency to hire high-caliber talents to meet the requirement of the organization that will
discuss the compensation and benefits aside from the existing salary grade and benefits
implemented by the CSC.
