RESOLUTION RECOMMENDING THE USE OF NEGOTIATED PROCUREMENT
METHOD FOR THE PROCUREMENT OF ADJACENT OR CONTIGUOUS TO AN ON
GOING INFRUSTRUTURE PROJECT

Resolution No. ____________________

WHEREAS, pursuant to project “CONSTRUCTION OF STALLS & FAÇADE OF THE


PUBLIC MARKET, TAPAZ, CAPIZ the Office of the Municipal Engineer recommends the
performance of additional electrical works, mezzanine floor, concrete canal, rolled-up
doors, roof framing, ceiling and other accessories.

WHEREAS, such incorporation of additional works would result to the following:


a. Improvement of sanitation;
b. A secure and safe individual space for the lessee;
c. Less electrical related fire hazards

WHEREAS, section 53.4 of the Revised IRR of R.A. 9184 states that Negotiated
Procurement may be resorted for Adjacent or Contiguous Infrastructure Project, and set
forth the conditions for the use of the said alternative modality;

WHEREAS, section 53.4 of the Revised IRR set forth the condition for the use of the
said alternative of modality to wit:

53.4. Adjacent or Contiguous. Where the subject contract is adjacent or


contiguous to an ongoing Infrastructure Project or Consulting Service where
the consultants have unique experience and expertise to deliver the required
service: Provided, however, That (a) the original contract is the result of a
Competitive Bidding; (b) the subject contract to be negotiated has similar or
related scopes of work; (c) it is within the contracting capacity of the
contractor/consultant; (d) the contractor/consultant uses the same prices or
lower unit prices as in the original contract less mobilization cost; (e) the
amount of the contiguous or adjacent work involved does not exceed the
amount of the ongoing project; and (f) the contractor/consultant has no
negative slippage/delay: Provided , further , That negotiations for the
procurement of the contiguous or adjacent work are commenced before the
expiry of the original contract.

WHEREAS, reference to the aforesaid citation, the BAC did further inquiries and was
able to establish the following:

WHEREAS, the BAC, in its evaluation, considered the factual circumstances presented
by the Municipal Engineering Office;
NOW THEREFOR, the member of the BAC, hereby RESOLVE as it is hereby
RESOLVED:

1. declare and recommend to the Head if the Procuring Entity to approve and
proceed with the performance of additional electrical works, mezzanine
floor, concrete canal, rolled-up doors, roof framing, ceiling and other
accessories.

2. recommend to the Head of the Procuring Entity to award the herein present
undertaking to E.D Libunao Construction and Trading;

3. recommend the foregoing to the Head of the Procuring Entity (HOPE) for
approval.
