AN ORDINANCE MANDATING SALT IODIZATION, PROVIDING PENALTIES


THEREFOR AND FOR OTHER PURPOSES’, BY PROVIDING FOR THE
CREATION OF BANTAY ASIN TASK FORCE

BE IT ORDAINED by the Sangguniang Panlalawigan of Oriental Mindoro in session


duly assembled: |

Section 1. DECLARATION OF POLICY. - It is hereby declared the policy of the


provincial government to promote and protect the health of the people through salt
iodization.

Section 2. PURPOSE.

a. To contribute in the elimination of iodine deficiency disorders through the


promotion and mandatory the use of iodized salt.

Section 3. APPLICABILITY. - This ordinance shall apply to salt producers,


manufacturers, traders, distributors, food outlets, restaurants and stores.

Section 4. STRATEGIES. - The purpose may be achieved through any but not
fimited to the following strategies:

a. By requiring all component cities/municipalities through their health officers


to check and monitor the quality of food grade salt being sold in the
market, in order to ascertain that such salt is properly iodized.

b. By monitoring and ensuring that all food outlets, restaurants and stores will
only use and sell iodized salt.

Section 5. CREATION OF BANTAY ASIN TASK FORCE. - A Bantay Asin Task


Force is hereby created and shall be composed of the following:

1. Provincial Health Office (PHO) - Chairman


2. Board Member (Committee on Health) - Co-chairman
3. Provincial Assistance for Community Development - Member
4. Food and Drug Administration (FDA) - Member
5. Department of the Interior & Local Government (DILG) - Member
6. Philippine National Police (PNP) - Member
7. Department of Trade and Industry (DTI) - Member
8. Department of Education (DepEd) - Member
9. Department of Science and Technology (DOST) - Member
10. Philippine Port Authority (PPA) - Member
11. Bureau of Customs (BOC) - Member
12. Provincial Information Office (PIO) - Member
13. Maritime Police - Member
14. President - League of Municipal Mayors - Member
15. President - League of Barangay Captains - Member
16. Provincial Legal Office - Member
17. Provincial Planning and Development Office - Member

Section 6. FUNCTIONS OF THE BANTAY ASIN TASK FORCE.

1. Manage and coordinate the Provincial Salt Iodization Program (PSIP) in the
cities/municipalities through formulating the annual operation plan, organizing
the Bantay Asin Task Force, and coordinating with stakeholders like salt
producers and traders.

2. Lead in the advocacy campaign for full and effective implementation of the
ASIN law in the province including ensuring sustainable support and program.

3. Monitor and evaluate program implementation.

4. Disseminate and promote through organized and systematic and province


wide information campaign which shall involve major sectors of society to be
spearheaded by the Provincial Health Officer (PHO) in cooperation and
coordination with other Local Government Units and concerned agencies.

5. Serve as policy making body on Provincial Salt Iodization Program (PSIP).

6. Network with other stakeholders at the provincial level.

Section 7. SECRETARIAT. - The Secretariat of the Asin Task Force shall be


composed of Competent staff headed by nutrition program coordinator of the
Provincial Health Office.

Section 8. IMPLEMENTING AGENCY. - In the proper implementation of this


ordinance the Provincial Health Office (PHO) is designated as the head
implementing agency which shall formulate the implementing Rules and Regulations
(IRR) of this Ordinance.

Section 9. MISCELLANEOUS PROVISIONS. –

a. Salt producers/manufacturers shall register with the BFAD and iodized salt
produced/manufactured shall conform to the standards set by the BFAD to
meet the nutritional needs of the consumers.

c. All food-grade salt shall be labelled in a manner that is true and accurate,
not likely to mislead purchasers and in accordance with the requirements
prescribed by the BFAD. Those establishments shall be monitored by the
Provincial Health Office (PHO).

Section 10. APPROPRIATION. - Funding requirement for the implementation of this


ordinance shall be charged to the current appropriation of the office concerned.

Section 11. PENALTY CLAUSE. - Any person natural or juridical who shall violate
any of the provisions of this Ordinance or its Implementing Rules and Regulations
shall be punished by a fine of not less than One Thousand Pesos (PhP1,000) nor
more than Five Thousand Pesos (PhP5,000) upon the courts discretion.
However, if the violation is committed by any officer of a juridical entity, such officer
responsible therefore shall be personally liable for the fine. Accordingly, such violator
shall suffer a revocation of its business permit.

Section 12. SEPARABILITY CLAUSE. - If any provisions of this Ordinance are


declared invalid or unconstitutional the provisions not so declared shall continue to
remain in full force and effect.
