NOTIFICATION
No. S.O.FD (R-II)/VII-II/2020/344-443 With the prior approval
of the Provincial Cabinet, the Government of Balochistan is pleased to make
the following Policy:-

PART I -- GENERAL

1. Short title, application and commencement,– (1) This Policy


may be called the Balochistan Civil Servants’ & Employees’ Benefits and Death
Compensation Policy, 2020.

(2) This shall be applicable to a Civil Servant & Employee or legal


heirs of :

(a) in service or died Personnel of Law Enforcement Agencies


(i.e. Police, Levies and Balochistan Constabulary);

(b) all in service or died Civil Servants of the Government of


Balochistan; and

(c) all in service or died employees of Government of


Balochistan;

(3) It shall come into force at once.

2. Definitions,- (1) In this Policy, unless there is anything
repugnant in the subject or context,-

(a) “Administrative Secretary” means the Secretary or Acting


Secretary to the Government in charge of a Department and
includes, Additional Chief Secretary, Senior Member Board of
Revenue and Chairman Chief Minister’s Inspection Team;

(b) “Attached Department” means a Department mentioned in


column 3 of Schedule II of Balochistan Government Rules of
Business, 2012;

(c) “Basic Pay Scale” means a Basic Pay Scale of pay sanctioned by
Government in which a post or group of posts is placed;

(d) “Bereaved Family” means members of the family of a deceased


employee, who have been wholly dependent and residing with
him permanently.

(e) “Compensation” means monetary benefits(s) granted as an aid


to the bereaved families.

(f) “Chief Secretary” means the Chief Secretary Balochistan;

(g) “Civil Servant” means as defined in Section 2 (b) of the


Balochistan Civil Servants Act, 1974;

(h) “Compensation package” means a monetary benefit granted to


the Families of Civil Servants & Employees who dies or injured
while in Service as a result of terrorist activity.

(i) “Competent Authority” means the authority competent to


sanction compensation as defined in Section 17 of this policy;

(j) “Death Compensation” means an amount approved by the


Government, to be paid to the family of a deceased civil servant
on his death during service;

(k) “Department” means a self-contained administrative unit in the


Secretariat shown in Column 2 of Schedule II of the Balochistan
Government Rules of Business, 2012: provided that Services and
General Administration Department shall, for the purpose of
Secretariat employees, be deemed as a Department;

(l) “Deputy Commissioner” means a District Head of the


Administration appointed by the Government.

(m) “District Compensation Committee” means a Committee


constituted under Section 13 of this Policy.

(n) “Divisional Commissioner” means the Commissioner of a
Division appointed under Section 8 of the West Pakistan Land
Revenue Act, 1967. (Act No.XVII of 1967).

(o) “Employee” means,

(i) any person who is a member of a civil service of the


Province, or who holds a civil post in connection with the
affairs of the Province;

(ii) any person appointed to the secretarial staff of the


Provincial Assembly whose terms and conditions of service
are governed by rules or Law made under the
Constitution;

(iii) Any employee of such Department, Body Corporate,


Institution, Organization or Autonomous Body, as the
Provincial Government may, by notification in the official
Gazette, specify, and includes any such person, officer,
servant or member of the staff who is:—

(a) On deputation elsewhere or on foreign


service within the meanings of the
Fundamental Rules,

(b) Undergoing study or training in or outside


Province/Pakistan,

(c) On duty or on leave within or outside the


Province/Pakistan, or

(d) Under orders of suspension, but does not


include any person who:—

(i) has attained the age of sixty years


and retired; or

(ii) the contract, ad-hoc and contingent


paid employees;

(p) “Family” means and includes the persons entitled to the


pensionary benefits of the civil servant under the Pension Rules
for the time being in force;

(q) “Financial Assistance package” means one time Financial


Assistance to the bereaved families of all the employees of
Government of Balochistan who expire during service due to
natural death.

(r) “Foreign Service” means service where a member of the Service


receives pay with the sanction of the Government from any
source other than the Consolidated Fund of Pakistan or the
Consolidated Fund of any Province;

(s) “Government” means the Government of Balochistan as defined
in Article 129 of the Constitution of the Islamic Republic of
Pakistan, 1973.

(t) “Head of Attached Department” means an officer shown in


column 4 of Schedule II of the Balochistan Government Rules of
Business, 2012;

(u) “Civilian Victim” means a person, not being a terrorist or a


personnel of a law enforcement agency on duty, who suffers harm
to body or property due to any terrorist act and, in the event of
death of the person, includes the spouse of the victim or, in
absence of a spouse but in order of precedence, a child, mother,
father, minor sibling or other legal heirs of the victim;

(v) “Natural Death” means a death occurring in the course of


nature and from natural causes as diseases, old age or an
accident, rather than from a result of violence, terrorist activity
such as ethnic, sectarian or any other subversive activity .

(w) “Provincial Law and Enforcement Agencies” (i.e. Police, Levies


and Balochistan Constabulary, which includes both Uniformed
and Non-Uniformed employees)

(x) “Retired Civil Servant” means and includes a civil servant who
opt to retire after completing twenty five (25) years qualifying
service or retired on attaining the age of superannuation i.e. sixty
(60) years or retired on medical grounds or compulsory retired
and receives the pension;

(y) “Shaheed” means a Civil Servant of Government of Balochistan


and Personnel of Law Enforcement Agencies (i.e. Police, Levies
and Balochistan Constabulary) killed in encounters including
death in bomb blasts, riots, watch and ward duties or terrorist
activities, including targeted killing, but not death in accident
and declared by the Home & Tribal Affairs Department on the
recommendations of the District Compensation Committee;

The families of the Shaheed victims not in government


service, whose bullet riddled/decomposed bodies are recovered
or killed in terrorist activities shall be entitled for grant of
compensation as applicable to the private individuals as
prescribed in the Balochistan Civilian Victims of Terrorism (Relief
and Rehabilitation) Act, 2014.

(z) “Legal Heirs of a deceased person” means a person/ persons


who established the legitimacy of the heirs and give him/them
the power to inherit shares, securities, debts, other assets and
emolument etc of the deceased through a Succession Certificate
duly issued by the competent Court of Law.

3. Claim to benefits and death compensation,-Notwithstanding
any claim made or right accrued by a civil servant after the commencement of
this policy, for the payment of any amount on account of benefits and death
compensation, shall be dealt in accordance with section 4 of this policy.

4. Payment of benefits and death compensation.- (1) At the time of


death of civil servant/employee, the amount shall be paid to him.

(2) A civil servant, dies while in service, his family shall be paid full
amount as prescribed for his grade of pay irrespective of length of service
rendered.

(3) The amount shall be paid to the civil servant in case of injuries
otherwise to his family at the time of death according to his last Basic Pay
Scale. The category wise amount of benefit/compensation in respect of civil
servants or legal heirs of those employees of Government of Balochistan who
embrace ‘Shahadat’ due to acts of terrorism or died due to natural death shall
be admissible on substantive/regular grade instead of time scale etc
irrespective of length of service rendered. In case a civil servant is given
promotion from retrospective effect after his death the differential amount shall
be paid according to the revised grade or pay, subject to payment of difference
in monthly contribution for the uncovered period; and

(4) The family of the deceased civil servant shall submit the
application on the form prescribed for the grant of benefit.

5. Financial Assistance to the Families of Government Employees who


dies while in Service,- (1) On a sudden and premature natural death
of a civil servant, the following one time financial assistance package in respect
of bereaved families of all the employees of the Government of Balochistan who
expire during service shall be paid irrespective of length of service rendered:-

(2) The Civil Servants who go missing during service and are not
recovered within a period of twelve months from the date of disappearance, and
where there is a reasonable presumption of their having died, shall be treated
at par with Provincial government employees who die during service to the
extent of payment of compensation and benefits etc., subject to the condition
that where such employee is recovered alive, before or after the date of
superannuation, the part of compensation linked to the presumption of death
during service shall be paid back to the government or adjusted against
pension payments of the employee.

(3) This will be in addition to other benefits to the family of deceased


Civil Servants as admissible under any other law/rules.

(4) The Administrative Departments or the Appointing Authorities


will issue sanction orders for such compensation in individual cases.

(5) Expenditures involved will be met out of the existing budget


grants of the Administrative Departments concerned. However, in case
additional funds are required, the case shall be referred to Finance Department
for provision of funds and Finance Department shall provide funds under the
relevant object for the purpose.

6. Compensation package to the Families of Civil Servants Employees


who dies or injured while in Service as a result of terrorist activity,-

(1) The following Compensation Package shall be paid to the


families/legal heirs of the “Shaheed” whose death take place as a result of
sectarian violence or fall victim to any type of terrorist activity such as ethnic,

sectarian or any other subversive activity irrespective of either during the
performance of their respective official duties or otherwise irrespective of the
length of service rendered:-

4 Accommodation The bereaved family of Shaheed

residing in the official accommodation
as per prescribed government policy till
the Shaheed would have reached the
age of superannuation, had he not died
with usual terms and conditions and no
deduction of House Rent shall be made.

In case the Shaheed’s family has not


been allotted official residence:

(a) the bereaved family shall either


be allotted so or allowed to hire a
private house as per prescribed

may be; or

(b) paid a monthly House Rent/

5 Employment. Whenever an employee embark

Provided that the spouse or child

shall be given employment against a
vacant post in BPS-1 to BPS-15 in the
respective department provided he/she
qualifies for the post.

If Not Married: Blood related nominee

If vacant post of that category (BPS-


1 to BPS-15) is not available of which
he/she qualifies then the Department

6 Financial Assistance:
(a) Cash Compensation

A special lump sum grant ranging from Rs. 3.000 Million to


Rs. 10.000 Million as per Ranks/Basic Pay Scales given
below:-

(c) One time compensation for government employees and
employees of Law Enforcement Agencies who sustains
Major/Serious Injury (physically impaired) irrespective of
during performance of Official duty or otherwise shall be
allowed Rs.1,000,000/- (Rupees Ten Lac Only) as per
Medical Board Report showing clearly that he/she is
physically impaired;
(d) One time compensation for government employees and
employees of Law Enforcement Agencies who sustains Minor
Injury sustained by the employee shall be paid Rs.50,000/-
(Rupees Fifty Thousand Only) as per medical report.
(e) Regular/suitable monthly special allowance Rs.30,000/-
(Rupees Thirty Thousand Only) shall be allowed for
permanently bedridden civil servants and employees of Law
Enforcement Agencies for their medical treatment and nursing
care. However, they will ceased to draw the Medical re-
imbursement charges allowed by the virtue of Medical
Attendance Rules.
7 Health facilities The family of Shaheed shall be provided
free medical treatment as per their
entitlement during service as prescribed
in Medical Attendance Rules/Policy
issued from time to time.
8 Education facilities All the enrolled (in any educational
institution) children of Shaheed
employee would be provided monthly
educational scholarship from primary to
post-graduation at the following rates:-
(a) Primary to Secondary Rs.2,000/-
level: (per child)
(b) Higher Secondary to Rs.3,000/-
Under-graduation or (per child)
equivalent degree.
(c) Master/Professional/ Rs.5,000/-
equivalent degree (per child)
For claim of above monthly educational scholarships, provision of the
following documents will be necessary:

(a) CNIC copy of Shaheed & alive parent.

(b) B-Form/CNIC of the student concerned.

(c) Certificate of enrollment from registered educational institute


concerned.

(d) Attestation of the relevant documents from B-17 or above Officer.

9 Prerequisite for facilitation In the case of Shahadat of a
of family of deceased government employee, the following

employees:-

(a) Up to date list of family members


of each employee for pension

for each employee in his/her life.
10 General Provident Fund Only payable amount from the Credit of
GP Fund shall be paid to the deceased
family/legal heirs and thereafter no
deduction is carried out.
11 Deduction of Benevolent No deduction shall be made from the
Fund and Group salaries of a legal heir of Shaheed
Insurance. Family till he draw salaries and attains
the age of superannuation.

7. Financial Assistance for burial/transportation of Dead Bodies to the


Families of Government Employees, who dies while in Service or embark
Shahadat,- (1) A lump sum payment shall be made by the Government
of Balochistan as Burial Charges to the bereaved family on the death of an
employee, if he/she dies while in service as expenses on the local burial or the

cost of transportation of dead body of a Civil Servant (BPS-1 to BPS-15) or his
wife (only one wife) to the extent indicated below:-

(a) Cases in which the dead body of the deceased Government


Servant in BPS-1 to 15 is buried locally:

The maximum limit for reimbursement of the amount for local


burial charges shall be Rs.15,000/-.

(b) Charges of Crating (Wooden Box):

The maximum rate shall be Rs.4,800/-.

(2) Cases in which the dead body of deceased Civil Servant (BPS-1
and above) is transported to Home Town,-

(a) Charges of Crating (Wooden Box) at the maximum rate as


allowed at (1) (b) above, shall be paid by the Government

(b) If the dead body is transported by Rail:

Actual cost of transportation of the Dead Body of the


deceased from his last station of duty to his home town
shall be met by the Government.

(c) If the dead body is transported by road:

Actual cost of such transportation shall be met by


Government, as per personal Taxi engagement charges @
Rs.10/- per Kilometer or as the rate may be fixed by the
Government are allowed. The distance shall be calculated
from the residence of the deceased in his last station of
duty to his Home Town.

(d) Transportation of the dead body by Air:

Such transportation will be permissible only in cases


where transportation by rail or road would involve a trip
exceeding twelve hours; in such a contingency actual cost
of transportation by air shall be admissible. For journey
from such an Air Port Dead Body shall be transported by
road at the rate prescribed at (2) (c) above.

If the dead body is transported by air, one single fare


by economy class will also be allowed for the attendant, if any,
accompanying the dead body. This concession shall, however,
be availed only by a member of the family of the deceased
Civil Servant and the air fare claimed on this account shall be
in lieu of the attendant’s normal entitlement.

(3) Financial assistance for burial/transportation of dead bodies
should in all cases be afforded on the application of the family of deceased
Government servant and only to the extent applied for, subject to the
maximum limits indicated above.

8. Procedure for payments of those who were on deputation and had


died due to natural death or embarked Shahadat,- On the death of a Civil
Servant, who was on deputation with Federal Government or other provinces
or an autonomous body, he/she would be considered repatriated to his/her
parent Department/lending organization where all the of his post death
financial matters shall be processed and finalized. (All deductions, shall be
stopped except Income Tax). The borrowing organization/autonomous body
concerned shall make necessary payments of pension contribution to the
parent Department of the deceased Civil servant of the period he/she remained
on deputation with the borrowing organization.

9. Payment of the sum assured,— On the death of an employee, the


Sum Assured shall be paid under Section 14 of the Balochistan Provincial
Employees Group Insurance Act, 2009 to legal heirs in addition to payments
made under this policy.

10. Payment of Benevolent Grant,— On the death of an employee,


the amount of Benevolent Grant payable shall be paid under Section 12 of the
Balochistan Government Employees Benevolent Fund Act, 2018 to legal heirs
in addition to payments made under this policy.

11. Mode of payments,- All payments to the family/legal heirs shall


be made through their respective Bank Accounts. No payment shall be made
through DDOs or any other channel except of Bank Accounts.

12. Fraudulent payments,- (1) If, within three years of any payment
made under this Policy, it transpires to the Department or the Deputy
Commissioner that payment has been made under the Policy on the basis of
any fraud or misrepresentation, the Department or the Deputy Commissioner
may, apart from taking any other action under any law, recover the amount

paid to the person who was not entitled to receive it after affording the person
an opportunity of hearing.

(2) Any person, aggrieved from the decision of the Department or the
Deputy Commissioner under sub-Section (1), may, within thirty days from the
date of communication of the decision prefer an appeal to the Chief Secretary
whose decision on such appeal shall be final.

(3) If an appeal preferred under sub-Section (2), the Chief Secretary


or his nominee shall afford an opportunity of hearing to any interested person
and shall, through a speaking order, decide the appeal within thirty days from
the date of filing the appeal

13. Declaration of Shaheed on the recommendations of the District


Compensation Committee,- There shall be District Compensation Committee
headed by a Deputy Commissioner, as under:-

a. Deputy Commissioner concerned Chairman


b. Superintendent of Police (CTD) Member
c. Superintendent of Police concerned Member
d. Medical Superintendent of concerned Hospital Member
e. Police Surgeon (Optional) Member
f. Representative of Municipal Corporation (Optional) Member
g. Additional Deputy Commissioner (General) Member
h. Executive Engineer, C&W Department Member
i. Representative of Livestock Stock/Agriculture Member
(Optional)

j. Assistant Commissioner concerned Member/Secretary

14. The recommendations of the District Compensation Committees shall


be forwarded within 15-days to the Home & Tribal Affairs Department for
scrutiny/ authentication and declaration of “Shaheed”.

15. If there is no adult legal heir (i.e. grand father/mother, Father and
real brothers/sisters) or minor(s) dependents to be eligible for compensation,

the amount of compensation shall be invested by the Department concerned
in a better profitable scheme (preferably Government based scheme) for a
period of 10 years or till eligible person should reach to the age of 18 years,
whichever less. On attaining the age of maturity (18 years), the amount/share
shall be released alongwith profit earned to the eligible person subject to
production of 1st Class Magistrate Certificate regarding correctness of his legal
claim as well as release of compensation amount and computerized valid
C.N.I.C.

16. In addition to above, the following facilities shall also be permissible


for the welfare of bereaved families of Employees:-

(a) Writing off the balance full amount outstanding on account of


House Building, Motor Car & Motor Cycle Advances.

(b) Writing off the balance amount of medical treatment


maximum upto Rs.300,000/- outstanding on account of any
type of advances to employees.

17. The authority competent to declare “Shaheed” and sanction


“Compensation” and other “Emoluments” in respect of various class of
employees shall be as follows:-

19. Removal of difficulties.- (1) If any difficulty arises in giving
effect to any of the provisions of this policy, Chief Minister Balochistan
may make such orders, not inconsistent with the provisions of this
policy, as may appear to him to be necessary for the purpose of
removing the difficulty.

20. Relaxation of Policy,– The Chief Minister may, in a case of


hardship, relax all or any of the provision of this policy:

Provided that such relaxation shall not be less favourable to any


benefit available to a Civil Servant or employee under this policy.

21. Repeal,- All existing Policies or rules or order shall be


deemed to have been rescinded or modified to the extent indicated in
this policy and the existing rules, Policies and orders are hereby
repealed.

AN
ACT

to provide for establishment of a Board for the common benefit of the


Provincial employees of the Government and to provide for their group
insurance and the matters connected therewith or ancillary thereto.

Preamble. WHEREAS, it is expedient to provide for
establishment of the Balochistan Provincial
Employees Group Insurance to regulate the Group
Insurance of the Provincial employees of the
Government of Balochistan and to promote and
protect their legitimate interests in the same; and to
provide for their group insurance and the benefits
attach therewith;

It is hereby enacted as follows: —

CHAPTER-I
PRELIMINARY

Short title, 1. (1) This Act may be called the Balochistan

every employee wherever he may be.

(3) It shall come into force at once.


Definitions. 2. In this Act, unless there is anything repugnant
in the subject or context, —

(a) “Act” means the Balochistan Provincial


Employees Group Insurance Act,2009;

(b) “Board” means the Board of Trustees set


up under section 4 of this Act;
(c) “Employees” means any person who is a
member of civil service of the Province or
who holds a civil post in connection with
the affairs of the Province; and includes
any such person, officer, servant or
member of the staff who is -

(i) on deputation elsewhere or on


foreign service within the
meanings of the Fundamental
Rules;

(ii) undergoing study or training in
or outside Pakistan;

(iii) on leave; or

(iv) under orders of suspension.


(d) “family” means -

(i) in the case of a male employee, the


wife or wives, and in the case of
female employee the husband of
the employee, and

(ii) mother;

(iii) father;

(iv) unmarried sisters below the age of


21 years and widowed sisters; and

(v) brothers below the age of 21 years.


(e) “Government” means the Government of
Balochistan.
(f) “Group Insurance” means the Provincial
Employees Group Insurance established
under section 10 of this Act;
(g) “Insurance Fund” means the Provincial
Employees Insurance Fund established
under section 12 of this Act;
(h) “Member” means a member of the Board
of Trustees.
(i) “Prescribed” means prescribed by rules;

(j) “Retired Government Employee”

(k) “Rules” means rules made under this
Act;

affect the right to receive any pension, provident fund,
gratuity or other benefits accruing to an employee on
his retirement or invalidation or to his family upon his
death otherwise than under this Act.

CHAPTER-II
BOARD OF TRUSTEES

Board to be body 5. The Board shall be a body corporate having

(f) to invest moneys held in the Group
Insurance in profitable ventures;
(g) to appoint or employ such persons as it
considers necessary for the efficient
performance of its operations on such
terms and conditions as it may
determine; and

(h) to do or cause to be done all things


ancillary or incidental to any of the
aforesaid powers or to the purposes of the
Group Insurance.

Meeting of the 8. (1) The meetings of the Board shall be held at

the Board, the number of members present shall be

(3) Unless otherwise prescribed by this Act,


all orders and decisions of the Board shall be with a
majority view for which each Member shall have one
vote; and in the event of equality of votes on any
matter, the Chairman shall have a casting vote.

(4) The meetings of the Board shall be


presided over by the Chairman and in his absence by
the Finance Secretary.

(5) All orders and decisions of the Board shall


be authenticated by the signature of the Chairman or
of such other member as may have been authorized by
the Board.

(4) All payments made under section 10, the


expenses on any arrangement entered into by the
Board with any insurance company or other insurer as
provided for in section 11 and all expenses on the
administration of the Insurance Fund shall be defrayed
from the Insurance Fund.

(5) Any sums remaining in the Insurance


Fund after defraying the expenses referred to in
sub-section (4) may be utilized for such purposes
connected with the benefit of the employee and their
families as the Board may direct.

him, and any premium remaining unpaid due to
inadvertence or negligence of the employee or
otherwise shall be recoverable from him in such
manner as may be determined by the Board.

(3) Default in the payment of premium


either for the reason that the pay of the employee
was not drawn or due to his negligence or fault or
for any other reason whatsoever shall not affect the
right of the employee or his family to receive the
sum assured in the event of his retirement or
death of the employee, but the premium remaining
unpaid at the time of his retirement or death may
be recovered from the assured amount.

CHAPTER-IV
GENERAL PROVISIONS

Savings. 20. (1) Notwithstanding anything contained in


any other law, upon coming into force of this Act
everything done, action taken, obligations or liabilities
incurred, rights and assets acquired, persons
appointed or authorized, jurisdiction or powers
conferred, endowments, bequests, funds or trust
created, donations or grants made, Scholarships or
privileges granted and orders issued under any of the
provisions of the Provincial Employees Group
Insurance Ordinance, 2007 (Ordinance No. XII of 2007)
or other legislative instruments or the statutes, the
Regulations and the Rules made or deemed to have
been made thereunder, shall if not inconsistent with
the provisions or the Rules made under this Act, be

continued and, so far as may be deemed to have been
respectively done, taken, incurred, acquired,
appointed, instituted, granted, and issued under this
Act, and any documents referring to any of the
provisions of the said Ordinance, other legislative
instruments or statutes the Regulations, and the Rules
first referred shall so far as may be, be considered to
refer to the corresponding provisions of the Ordinance
or the statutes, the Regulations and the Rules made,
under this Act.

(2) The offices of the Board functioning in


terms of the provisions of the Provincial Employees
Group Insurance Ordinance, 2007 (Ordinance No. XII
of 2007), or other legislative instruments shall continue
to function in terms of the said Ordinance.

(3) Any statutes, Regulations or Rules made


or deemed to have been made under the Provincial
Employees Group Insurance Ordinance, 2007
(Ordinance No. XII of 2007) or other legislative
instrument shall, if not inconsistent with the
provisions of this Act, be deemed to be statutes,
Regulations or Rules made under this Act having
regard to the various matters which by the Ordinance
have to be regulated or prescribed by Statutes
Regulations and Rules respectively, and shall continue
to be in force until they are repealed, rescinded or
modified in accordance with the provisions of the Act.

to provide for institutionalized response to redress the hardships


faced by the civilian victims and their families; to provide for timely recognition
and assistance for civilian victims of terrorist acts; recognize right of civilian
victims to receive state assistance for relief, healthcare and rehabilitation;
arrange for adequate funds for such assistance; create an effective mechanism
to track, investigate and analyze civilian harm in terrorist acts; and to deal with
ancillary matters;

Preamble. WHEREAS it is necessary to take measures for providing
institutionalized response for relief and rehabilitation of civilian individuals and
their families who fall victims terrorists acts and matters connected and
identical thereto;

It is hereby enacted as follows:

CHAPTER 1
PRELIMINARY

1. Short title, extent and commencement.- (1) This Act may be


called the Balochistan Civilian Victims of Terrorism (Relief and Rehabilitation)
Act, 2014.

(2) It extends to whole of the Province except the Tribal Areas.

(3) It shall come into force at once and shall be deemed to have
taken effect on and from 14th May 2013.

2. Definitions.- In this Act, unless there is anything regnant in the


subject or context,-

(a) “Act” means the Balochistan Civilian Victims of Terrorism (Relief


and Rehabilitation) Act, 2014;

(b) “Civilian Victims” means a person, not being a terrorist or a


personnel of a law enforcement agency on duty, who suffers harm
to body or property due to any terrorist act and, in the event of
death of the person, includes the spouse of the victim or in
absence of a spouse but in order of precedence, a child, mother,
father, minor sibling or other legal heirs of the victims;

(c) “Commissioner” means the Commissioner of a Division or an


area;

(d) “Family Member” means spouse, dependent child, dependent


parent and a dependent sibling;

(e) “Government” means the Government of Balochistan.

(f) “Healthcare” includes diagnosis and treatment of an illness,


psychological care and treatment of trauma;

(g) “Law Enforcement Agency” means, Police, Levies and Frontier
Corps or any other law enforcement agency notified by the
Government.

(h) “Notified Officer” means the principal administrative officer of


a district or any other person in the service of Pakistan notified
by the Government as notified officer for the district;

(i) “Prescribed” means prescribed by the rules made under the Act;

(j) “Schedule” means the Schedule appended to the Act;

(k) “Terrorist” means a person who has committed, attempts to


commit or is accused of the commission of a terrorist act; and

(l) “Terrorist Act” means an unlawful act using any explosive,


weapon or any other means of force or show of force by a terrorist
against a person or property to intimidate or coerce public, a
section of public, the Government, Federal Government or any
agency or authority of a Government in furtherance of political,
sectarian, religious, ethnic or social objectives and includes a
suicide attack, sectarian violence and an armed conflict between
a terrorist and a law enforcement agency.

CHAPTER II
RIGHT OF CIVILIAN VICTIMS.

3. Right of civilian victims. (1) Notwithstand i ng anything


contained in any other law a civilian victims shall be entitled to a minimum
grant specified in the Schedule for the harm caused to body or property due to
a terrorist act.

(2) The Government may, by notification in the official Gazette,


amend the Schedule such as to enhance the minimum amount of grant
payable to a civilian victim or to add any other category of harm and to fix the
minimum amount of grant for such harm.

4. Civilian victims fund. (1) The Government shall, by notification,


establish the civilian victims fund within the Provincial Consolidated Fund for
timely payment of grants to the civilian victims.

(2) The Government shall ensure availability of sufficient amount in


the civilian victims fund in order to discharge its obligations under the Act.

5. Rehabilitation. The Government shall, in the prescribed manner,
direct the notified officer to undertake a scheme for the rehabilitation of a class
of civilian victims and their family members with special emphasis on
education of dependent children, continue healthcare and provision for
livelihood of the civilian victims and their family members.

CHAPTER III
PROCEDURE FOR RELIEF AND REHABILITATION.

6. Ascertainment of a civilian victims.- (1) The notified officer shall,


as soon as possible preferable within fifteen days of a terrorist act,
communicate the details of the terrorist act and civilian victims to the
Government.

(2) The details of a terrorist act may include—

(a) time, date, place and nature of the terrorist act;

(b) bomb, explosive or inflammable substance, firearm or


other means of force used in the terrorist act;

(c) a statement about terrorist or alleged terrorist and


objectives of the terrorist act;

(d) the law enforcement agency which conducted the


operation and name of the terrorist against whom the
operation is conducted;

(e) name with details of a civilian victim and nature of injury


to body or property of the civilian victim;

(f) name with details of the spouse and other close relatives
of the civilian victim;

(g) entitlement of the civilian victim to payment of


compensation under Section 3;

(h) additional or monthly compensation which may be paid to


a civilian victim with reasons for such recommendations;
and

(i) reports of a law enforcement agency; health, building and


livestock departments.

(3) The Government shall, within seven days from the receipt of
communication from the notified officer and under intimation to the notified
officer, transfer the requisite compensation payable to the civilian victim in an
account which may be operated by the notified officer.

(4) The notified officer shall, within three days of the receipt of
intimation under sub-section (3), make payment to the civilian victim through
cross cheque, demand draft or banker’s cheque payable to the civilian victim.

(5) Subject to the rules, the Government shall, on periodic basis,


circulate forms or other details to the notified officers, specifying means of
communication between the notified officers and the government in order to
ensure speed and authenticity of the communication.

7. Healthcare of civilian victims;-- (1) The notified officer shall


ensure immediate free medical treatment of a civilian victim from a hospital
owned or controlled by the Government, local authority or any entity or agency
of the Government.

(2) If the notified officer is satisfied that medical treatment of the


civilian victim in a private hospital is justified, the notified officer shall send
request to the government for transfer of the requisite amount required for
immediate medical treatment and healthcare of the civilian victim.

8. Rehabilitation of civilian victims.- (1) In addition to medical


treatment of and payment of compensation to the civilian victim, the notified
officer may, for reasons to be recorded in writing, recommend measures to the
government for rehabilitation of the civilian victim.

(2) The measures under sub-section (1) may include:

(a) monthly grants to the civilian victim for a specified


periods:

(b) education or vocational training of the civilian victim or


his family members at the Government’s expense; and

(c) continued healthcare of the civilian victim and his family
members.

(3) If the Government receives any recommendation under this


section, it may, wholly or partially, accept the recommendation of the notified
officer.

9. Mode of payments.- (1) All payments made under the Act to a


civilian victim or, for treatment of the civilian victim, to a private hospital shall
be made by the notified officer through a cross cheque, demand draft, banker’s
cheque or any other mode ensuring authenticity of payment.

(2) The notified officer shall, in the prescribed form, maintain a


detailed record of the payments made to the civilian victims or, for treatment
of the civilian victim or his family members, to a private hospital and shall also
send a copy of a such record to the Government.

10. Application to notified officer.-- (1) A person may file an


application to the notified officer claiming:

(a) to be the civilian victim entitled to compensation under the Act;


or

(b) that any person declared as a civilian victim is not a civilian


victim and is not entitled to any payment or part of payment
under the Act.

(2) If an application is filed under sub-section (1), the notified officer


shall, after such enquiry as may be necessary according to facts and
circumstances of the case, decide such application within fifteen days from the
date of receipt of the application.

11. Equal treatment.-- (1) Subject to the reasonable restrictions


as may be prescribed, the assistance under the Ordinance shall be available
to all civilian victims and the assistance shall not be denied on the basis of age,
gender, religion, race, creed, colour or place of residence.

(2) The notified officer, Commissioner or the Government shall not
discriminate against any civilian victim solely on the basis of age, gender,
religion, race, creed, colour or place of residence.

12. Appeal.-- (1) Any person aggrieved from any decision of the
notified officer may, within thirty days from the date of communication of the
decision, prefer an appeal to the Commissioner or any other officer delegated
with such powers by Government, whose decision on such appeal shall be
final.

(2) The Appellate Authority shall afford an opportunity of hearing to


any interested person and shall, through a speaking order, decide the appeal
within thirty days from the date of filing the appeal.

13. Residuary powers of Government.-- (1) The Government may, at


any stage and for reasons to be recorded in writing, declare a person as civilian
victim and direct the notified officer to make payment to the civilian victim in
accordance with the provision of this chapter.

(2) Subject to the Act and the rules made under the Act, the
Commissioner and the notified officer shall be bound by the directions of the
Government.

14. Fraudulent payments. (1) If, within three years of any payment
made under the Act, it transpires to the notified officer or the Commissioner
that payment has been made under the Act on the basis of any fraud or
misrepresentation, the notified officer or the Commissioner may, apart from
taking any other action under any law, recover the amount paid to the person
who was not entitled to receive it after affording the person an opportunity of
hearing.

(2) Any person, aggrieved from the decision of the Commissioner


under sub-section (1), may, within thirty days from the date of communication
of the decision, prefer an appeal to the Government whose decision on such
appeal shall be final.

(3) If an appeal preferred under sub-section (2), the Government
shall afford an opportunity of hearing to any interested person and shall,
through a speaking order, decide the appeal within thirty days from the date
of filing the appeal.

CHAPTER IV
MISCELLANEOUS

15. Assistance to officers. (1) All officers and agencies of the


Government and local governments shall be bound to assist the Commissioner
and the notified officer in the performance of their functions under the Act.

(2) In the performance of their functions under the Act, the


Commissioner or the notified officer may call for any information from any
agency of the Government or a local Government and such agency shall be
bound to provide the requisite information.

16. Communication of the law.-- (1) The Government shall conduct


a periodic publicity campaign in order to develop awareness about rights,
procedures and grievance redressal mechanisms under the Act in electronic,
radio and print media.

17. Performance audit.-- (1) The Government may conduct or cause


to be conducted performance audit of the services rendered and payments
made or periodic basis under the Act.

(2) The performance audit shall include the detail of quality of


services provided by the notified officers, Commissioners and the Government
to the civilian victims, along with the identification of weaknesses and
recommendations for future improvements.

18. Act not in derogation of other laws.-- (1) Save as otherwise


provided in the Act, the provisions of the Act are in addition to but not in
derogation of any other law.

(2) Notwithstanding anything contained in the Act, the right to
compensation of any person shall not be extinguished or varied and the
Government or any of its functionaries shall not be absolved from any liability
under any other law.

19. No legal liability. Notwithstanding anything contained in any


law, any payment made to a civilian victim under the Act shall not be
construed as admission of any wrong on the part of the Government or any
functionary of the Government.

20. Training of staff. The Government shall, in regular intervals,


arrange training of the notified officers, Commissioners and personnel of law
enforcement agencies; health, building and livestock departments for achieving
the purpose of the Act.

21. Annual report. (1) The Government shall, within three months
of the close of a financial year, submit to the Provincial Assembly of
Balochistan an annual report.

(2) The annual report shall consist of:

(a) details of the civilian victims along with a comprehensive


statement of the payments made during the preceding
financial year;

(b) reasons for delay, if any, in making payments to the


civilian victims and proposed solution;

(c) performance audit report, if any; and

(d) other matters considered appropriate by the Government


or as may be prescribed.

22. Rules.-- (1) The Government may by notification in the official


Gazette, make rules for carrying out the purposes of the Act;

(2) In particular and without prejudice to the generality of the


forgoing power, such rules may provide for all or any of the following matters:-

(a) submission of application to a notified officer;

(b) mode, manner and periodicity of the payments made to a
civilian victim or any of his family member;

(c) repair or construction of a dwelling unit of a civilian


victim;

(d) compensation for loss of livestock or for loss to business


establishment of a civilian victim;

(e) details of communications between the notified officers


and the Government for timely payments to the civilian
victims and authenticity of communication;

(f) rehabilitation of the civilian victim and his family


members;

(g) medical treatment of the civilian victims;

(h) maintenance of records and publication of information


under the Act;

(i) procedure for decision of applications and appeals under


the Act; and

(j) maintenance of accounts.

23. Repeal and Saving.- (1) The Balochistan Civilian Victim of


Terrorism (Relief & Rehabilitation) Ordinance, 2013 (Ordinance No. 1 of 2013)
is hereby repealed.

(2) Notwithstanding the repeal of the Balochistan Civilian Victim of


Terrorism (Relief & Rehabilitation) Ordinance 2013 (Ordinance No. 1 of 2013)
(hereinafter referred as the repeal Ordinance), anything done, action taken,
orders and notifications issued, inquiry or proceeding commenced, person
authorized, powers conferred, payments or order made for the relief and
rehabilitation of civilian victims under any of the provisions of this Act, shall
continue to be in force and deemed to have been done, taken, incurred,
commenced, authorized, conferred, made, released or issue under this Act,
until they are rescinded, withdrawn, cancelled, replaced or modified in
accordance with the provisions of this Act.

ACT

to provide for the establishment of a Board for the


common benefit of the provincial employees of
Government of Balochistan; and to a mechanism provide
for their Benevolent Fund and the matters connected
therewith or ancillary thereto.

Preamble. WHEREAS, it is expedient to provide for
establishment of the Balochistan Government
Employees Benevolent Fund to regulate the
Benevolent Fund of the Provincial employees of the
Government of Balochistan and to promote and
protect their legitimate interests in the same; and to
provide for their benevolent fund and the benefits
attached therewith:

It is hereby enacted as follows: —

Short title, 1. (1) This Act may be called the Balochistan

(2) It shall apply to every employee wherever
he may be.

(3) It shall come into force at once.

Definitions. 2. In this Act, unless there is anything repugnant


in the subject or context, —

(a) “Act” means the Balochistan Government


Employees Benevolent Fund Act, 2018;

(b) “Board” means the Board of Management as


set up under section 4 of this Act;

(c) “Employees” means any person who is a


member of civil service of the Government
and who holds a civil post in connection
with the affairs of the Government (except
employees of Balochistan Police/Levies/Jails
or a class of employees as so determined by
Government from time to time in the official
gazette); and includes any such person,
officer, servant or member of the staff who
is,_

(i) on deputation elsewhere or on foreign


service within the meanings of the
Fundamental Rules;

(ii) undergoing study or training in or
outside Pakistan;

(iii) on leave; or

(iv) under orders of suspension;

(d) “family” means,_

(i) in the case of a male employee, the


wife or wives, and in the case of
female employee the husband of the
employee;

(ii) parents, sisters and minor brothers,


if residing with and wholly dependent
upon him or her;

(iii) Legitimate children and step children


less than twelve years old;

(iv) Legitimate children and step children


not less than twelve years old, if
residing with and wholly dependent
upon him or her;

(e) “Government” means the Government of


Balochistan;

(f) “Provincial Government Employees


Benevolent Fund” means the Balochistan
Government Employees Benevolent Fund
established under section 10 of this Act;

(g) “Board of Management” means the Board


of Management established under section 4
of this Act;

(h) “Prescribed” means prescribed by rules


made under this Act;

(i) “Retired Government Employee” means


and includes an employee who opts to retire
after completing 10 years pension-able
service or 25 years qualifying service or who
has attained the age of superannuation;

(j) “Rules” mean rules made under this Act;

(k) “Department” means the Services &


General Administration Department
(S&GAD) Government of Balochistan;

(l) “Death” means death of employee during
the service/employment;

(m) “Shaheed” means an employee who has


been declared Shaheed by the Government
of Balochistan, Home & Tribal Affairs
Department after an incident of terrorism;

(n) “Funeral Charges” means the funeral


charges, as prescribed by rules; and

(o) “Maintenance Allowance” means


Maintenance Allowance as prescribed by
rules.

Act to override 3. The provisions of this Act shall have effect


other laws.
notwithstanding anything to the contrary contained in
any other law for time being in force and the rules
made thereunder:

Provided that nothing herein contained shall


affect the right to receive any pension, general
provident fund, group insurance, gratuity or other
benefits accruing to an employee on his retirement or
invalidation or to his family upon his death otherwise
than under this Act.

moneys or properties in the Benevolent
Fund;

(d) to sanction expenditure connected with


the administration and management of
the Benevolent Fund;

(e) to make arrangement for the Lump Sum


Payment to the employees to give effect to
the provisions of this Act;

(f) to invest moneys held in the Benevolent


Fund in profitable ventures;

(g) to appoint or employ such persons as it


considers necessary for the efficient
performance of its operations on such
terms and conditions as may be
prescribed by the rules; and

(h) to do or cause to be done all things


ancillary or incidental to any of the
aforesaid powers or to the purposes of the
Benevolent Fund.

Assurance/ 9. Subject to the provisions of this Acts in the

administered by the Board.

(2) All Benevolent Fund contributions


received from the employees and any interest or profit
accruing thereon shall be credited to the Benevolent
Fund.

(3) The moneys credited to the Benevolent


Fund shall be kept in such banks/financial institutions
as the Board may decide.

(4) All payments made under section 10, the


expenses on any arrangement entered into by the
Board and all expenses on the administration of the
Benevolent Fund, shall be defrayed from the
Benevolent Fund.

(5) Any sums remaining in the Benevolent


Fund after defraying the expenses referred to in
sub-section (4) may be utilized for such purposes
connected with the benefit of the employee and their
families as the Board may direct.

(3) Default in the payment of contribution


either for the reason that the pay of the employee was
not drawn or due to his negligence or fault or for any
other reason whatsoever shall not affect the right of the
employee or his family to receive the Benevolent Fund
in the event of his retirement or death of the employee,
but the premium remaining unpaid at the time of his
retirement or death may be recovered from the
Benevolent Fund benefit/amount.

Savings. 20. (1) Notwithstanding anything contained in
any other law, upon coming into force of this Act
everything done, action taken, obligations or liabilities
incurred, rights and assets acquired, persons
appointed or authorized, jurisdiction or powers
conferred, endowments, bequests, funds or trust
created, donations or grants made, Scholarships or
privileges granted and orders issued under any of the
provisions of the Balochistan Government Servants
Benevolent Fund Ordinance 1960 (W.P. Ordinance XIV
of 1960) or other legislative instruments or the
statutes, the Regulations and the Rules made or
deemed to have been made thereunder, shall if not
inconsistent with the provisions or the Rules made
under this Act, be continued and, so far as may be
deemed to have been respectively done, taken,
incurred, acquired, appointed, instituted, granted, and
issued under this Act, and any documents referring to
any of the provisions of the said Ordinance, other
legislative instruments or statutes the Regulations, and
the Rules first referred shall so far as may be, be
considered to refer to the corresponding provisions of
the Ordinance or the statutes, the Regulations and the
Rules made, under this Act.

(2) The offices of the Board functioning in


terms of the provisions of the Balochistan Government
Servants Benevolent Fund Ordinance 1960 (W.P.
Ordinance XIV of 1960), or other legislative
instruments shall continue to function in terms of the
said Ordinance.

(3) Any statutes, Regulations or Rules made
or deemed to have been made under the Provincial
Employees Group Insurance Ordinance, 2007
(Ordinance No. XII of 2007) or other legislative
instrument shall, if not inconsistent with the
provisions of this Act, be deemed to be statutes,
Regulations or Rules made under this Act having
regard to the various matters which by the Ordinance
have to be regulated or prescribed by Statutes
Regulations and Rules respectively, and shall continue
to be in force until they are repealed, rescinded or
modified in accordance with the provisions of the Act.

Fund Act, 2018 (Balochistan Act No. XV of 2018), the Government of
Balochistan is pleased to make the following Rules, namely:-

Short Title and 1. (1) These Rules may be called the


Commencement.
Balochistan Government Employees Benevolent Fund
(Disbursement) Rules, 2020.

(2) It shall apply to every employee of the


Provincial Government wherever he may be.

(3) It shall come into force at once.

Definitions. 2. (1) In these Rules, unless there is anything


repugnant in the subject or context:-

(a) “Act” means the Balochistan Government


Employees Benevolent Fund Act, 2018;

(b) “Assets” mean the assets of the Benevolent
Fund acquired or developed through the
benevolent fund or granted to the Fund;
(c) “Assistant Fund Manager” means the Assistant
Fund Manager of the Fund Management Unit of
Finance Department, established under the
Rules of Business of Government of Balochistan,
2012;
(d) “Board” means the Board of Management as set
up under section 4 of the Act;
(e) “Government” means the Government of
Balochistan;
(f) “Provincial Government Employees
Benevolent Fund” means the Balochistan
Government Employees Benevolent Fund
established under section 10 of the Act; and
these rules;
(g) “Retired Government Employee” means and
includes an employee who opts to retire after
completing 10 years pension-able service or 25
years qualifying service or who has attained the
age of superannuation;
(h) “Department” means the Services and General

(j) “Direct Credit System” means a system of
online transfer of amount from the bank
account of the Benevolent Fund to the bank
account of the beneficiary;
(k) “Family” means,-

(i) in the case of a male employee, the wife


or wives, and in the case of female
employee the husband of the employee;
(ii) parents, sisters and minor brothers, if
residing with and wholly dependent upon
him or her;
(iii) legitimate children and step children less
than twelve years old;

(iv) legitimate children and step children not
less than twelve years old, if residing with
and wholly dependent upon him or her;
(l) “Schedule” means schedule appended with
these rules;

(m) “Shaheed” means an employee who has been


declared Shaheed by the Government of
Balochistan, Home & Tribal Affairs Department
after an incident of terrorism;
(n) “Funeral Charges” means the funeral charges,
as prescribed by these rules; and
(o) “Maintenance Allowance” means Maintenance
Allowance as prescribed by these rules.
(2) Terms and expressions used but not
defined in these rules shall have the same meaning as
defined in the Act or any other Rules framed under the
Act.

(2) In case of absence of a Secretary of a


department, an officer not below the rank of Deputy
Secretary (BPS-18) shall represent the Department.

F u n ctio n an d 4. The Board shall have the following powers:-

(a) to settle claims for Lump Sum Payment under
the Act and all matters connected with such
claims;
(b) to sanction grant from the Benevolent Fund to
the employees or their families in accordance
with the provisions of the Act and the rules
made there under;

(c) to do or cause to be done all acts and things

management of the moneys or properties in the
Benevolent Fund;

(d) to sanction expenditure connected with the


administration and management of the
Benevolent Fund;
(e) to make arrangement for the Lump Sum
Payment to the employees to give effect to the
provisions of the Act;

(f) to invest moneys held in the Benevolent Fund in


profitable ventures;

(g) to appoint or employ such persons as it
considers necessary for the efficient
performance of its operations on such terms and
conditions as may be prescribed by the rules;
and
(h) to do or cause to be done all things ancillary or
incidental to any of the aforesaid powers or to
the purposes of the Benevolent Fund.

supervision of the Board, the Secretary shall be
responsible for:-

(a) compilation and maintenance of assets and


liabilities of the Fund;

subsequently disbursed to the Fund
Management of the Finance Department;
(c) preparation and presentation of budget of the
Fund for each financial year to the Board; in
consultation with the Assistant Fund Manager
of the Finance Department.
(d) receiving of application forms from the
pensioners, verifying the documents and
compiling employee and scale wise lists of
beneficiaries for presentation to the Board for
approval;
(e) ensuring that the admissible amount payable to
the employees or their families have been
transferred to their accounts accordingly;

(f) annual review of the amount of monthly


contribution from the employees and amount of
disbursement at the time of retirement or death
in consultation with the Fund Management
Unit;

(g) preparation of annual accounts including details
of investments, assets and liabilities, getting it
audited and its presentation to the Board in
liaison with Assistant Fund Manager;
(h) preparation of a control check list for the
documents required from the pensioners or their
families for submitting application for
withdrawal of Benevolent Fund amount;

(i) develop a data base of the pensioners who have


been paid the amount of Benevolent Fund;
(j) preparation of the agenda and all matters
ancillary to the meetings of the Board; and
(k) the performance of such other functions as may
be assigned to him by the Board/Chairman

request being made in writing by the employee
finds that deduction of the amounts (as per
Schedule-I) remaining unpaid will result in any
hardship to the employee, the amount may be
deducted in such number of installments, not
exceeding eight, as the Board may decide.
(2) An amount, at the rate provided in
Schedule-I, shall be deducted from the Basic Pay of
employees on monthly basis, as defined in these rules.

(3) The amount of subscription paid shall at
first instance be recovered in the Public Account of
Government of Balochistan and shall be forwarded to
the Balochistan Employees Benevolent Fund Account

than or more than thirty years, he/she shall be paid
proportionate amount of the admissible amount of
return as calculated.

of the pensioners or to their families.

11. Order for payment of the sum assured in

case may be. If no objection is received to the
Board within 30 days of receipt of such orders, the
Board shall make payment to the recipient of
pension of the deceased.

Budget of the 14. The Secretary of Board, in consultation with the


Benevolent Fund. Assistant Fund Manager shall prepare annual budget
estimates for the expected disbursement during a
financial year, the expected return on investments and
operational costs of the fund during the year, and
present the budget to the Board for review and
approval.

Investments. 15. (1) The Assistant Fund Manager shall be
responsible for the management of the investments of
the Benevolent Fund with due diligence and care and
shall carry out appropriate risk assessments before
making any investments.

(2) Any investments shall be made with the


approval of the Benevolent Fund Investment
Committee, presented to it in form of proposals and
risk assessments. The decisions of the committee shall
be written in form of minutes duly approved by the
Committee.

(3) The Fund Management Unit shall develop


an investment policy which shall be approved by the
Investment Committee and subsequently presented to
the Board for approval. The investment policy shall
emphasize on investing in a portfolio of investments
and shall provide for risk management and risk
mitigation policies and procedures, accounting and
auditing procedures, criteria of investments and
intervals of holding of meetings of the Committee.
