Short Title Interpretation

This Law shall be referred to as the Aliens and Immigration Law. (1) In this Law, unless the context otherwise requires:

alien means person who is not a British subject or a citizen of the Republic of Ireland or a native of the Republic. prohibited immigrant means a person who is a prohibited immigrant under the provisions of this Law. destitute person means a person who, in the opinion of the Chief Immigration Officer is, or is likely to become incapable to support himself and its dependants or is likely to become a burden to the public funds. passport means a valid passport issued to a person by or on behalf of the Government of a State to which such person is a subject or a valid passport or another valid travel document issued to a person by a competent authority which is recognized by Her Majestys Government in the United Kingdom, such passport or document being complete having attached to it a photograph of the person to whom it relates and having endorsed thereon all particulars, endorsements and visas required from time to time by the Government or the authority issuing such passport or document and by Her Majestys Government and by any regulations for the time being in force in the territory in that behalf. s.2 of Law 66(I)/2003 Chief Immigration Officer means the Chief Immigration Officer of the Civil Registry and Immigration Department. Court means a District Court and includes a member of such court. approved port means sea or airport declared by the Council of Ministers to be a port of entry or o port of departure for the purposes of this Law. s.2 of Law 22(I)/2001 Marriage of Convenience means a wedding ceremony that took place between a citizen of the Republic or an alien permanently residing within the Republic of Cyprus and an alien for the sole and only purpose of the entry and residing of the latter within the Republic. native of the Republic means: (a) a citizen of the Republic; (b) an alien spouse of a citizen of the Republic, not divorced by a Court order, and who resides with her husband for a term not less than one year. Provided that an alien wife of a citizen of the Republic shall be considered as a native of the Republic even if she has lived with her husband for less than one year if the Chief Immigration Officer deems this to be fit according to the special circumstances of each particular case. (c) a child, step-child or adopted child, having been adopted in a manner recognized by law, of each such person under the age of eighteen years old. (d) any person of Cypriot origin from the fathers side and while the parents were permanently residing in Cyprus at the time of his/her birth. Visa means the authorization granted or the decision taken
