TENANCY AGREEMENT

FOR UNIT No : NO. 3, JALAN MADAH U2/33, TAMAN TTDI JAYA, 40150
SHAH ALAM, SELANGOR
AN AGREEMENT OF TENANCY made the day and year stated in Section
1 of the Schedule A hereto

BETWEEN the First Party whose name and description are stated in
Section 2 of the Schedule A hereto (hereinafter called “ the Landlord”
) of the one part.

AND the Second Party whose name and description are stated in
Section 3 of the Schedule A hereto ( hereinafter called “ the Tenant”)
of the other part.

WHEREAS THE Landlord ( owner ) is letting the Premises described in


Section 4 of the Schedule A hereto ( hereinafter reffered as “ the Said
Premises”).WHEREAS IT IS AGREED subject to the accompanying
General Conditions, the Landlord lets and the Tenant takes the Said
Premises together with all those fixtures and fittings for a Term stated
in Section 5 of the Schedule A hereto commencing on/deemed to have
commenced on the date stated in Section 6 of the Schedule A hereto
at the monthly Rent stated in Section 7 of the Schedule A hereto
payable on or before the day stated in Section 8 of the Schedule A
hereto of every month in advance.
GENERAL CONDITIONS

I. The Tenant hereby agrees and covenants with the Landlord as


follows:-

1. To deposit with the Landlord the sum stated in Section 9(a)


& (b) of the “ Schedule A “ hereto ( the receipt of which
the Landlord hereby acknowledges ) as and by way of
deposit or security for the due performance and observance
by the Tenant of all and singular the several covenants on
the part of the Tenant herein contained. The said sum shall
not be deemed to be payment for rent in advance nor shall
it be treated or used by the Tenant as payment for rent due
under this Agreement without prior consent of the Landlord
and shall be retained by the Landlord until the expiration
of the term hereby created but the said sum or any part
thereof may be applied in or towards payment of fees,
charges outstanding or for making good any breach of this
agreement on the part of the Tenant BUT SUBJECT as
aforesaid shall be refunded to the Tenant without interest
thereon upon the expiration of the term hereby created.

2. To pay the monthly rent at the time and in the manner as


set out in Section 8.

3. To apply at his own expense and to pay for the telephone,


water and electricity supplied to the Said Premises.

4. Not to make any structural alterations in or additions to the


Said Premises without the prior written consent of the
Landlord.

5. Not to do or permit to be done on the Said Premises
anything which will or may infringe any of the by-laws or
regulations in force or which may be or become a nuisance
or annoyance or inconvenience to the Landlord or to the
Tenants or occupiers of the adjacent or neighbouring
residential units.

6. Not to store or permit to be brought or stored on the Said


Premises arms, ammunitions, illegal drugs, or unlawful
goods, gunpowder, or any combustible substance or any
goods which in the opinion of the Landlord is of a noxious
or dangerous or harzardous nature and not to use the Said
Premises for any immoral activities.

7. To keep the Said Premises and all the Landlord’s


installations therein in good and tenantable repair and
proper working order, fair wear and tear expected.

8. To use the Said Premises for the purpose(s) stated in


Section 10 of the Schedule A hereto only.

9. Under the determination of this Tenancy to deliver up to


the Landlord the Said Premises in a good state of repair
condition order and preservation and in the same state and
condition (fair wear and tear expected) as that in which the
Tenant took possession and with all locks, keys and
fastenings complete.

10 . The Tenant is to deliver to the Landlord the Said
Premises in a clean and tidy condition ( i.e. no rubbish kept in
the apartment) upon determination of the Tenancy.

11. Not to Sub – Let or part with possession of the Said Premises
without the Landlord’s prior written consent.

12. During the entire period of the above Tenancy , the Tenant,
hereby, agrees that he will not request for any extra or
additional fixtures or fittings or furniture or electrical
appliances from the Landlord.

II. The Landlord hereby agrees and covenants with the Tenant as
follows:-

1. To pay all quit rents, taxes, assessments, maintenance fees, and


other outgoings which are or may hereafter be charged or imposed
upon the premises and payable by the Landlord.

2. The Tenant paying the rent and performed and observing the
convenants herein contained and or the Tenant’s part to be
performed and observed shall peaceably hold and enjoy the
premises during the said term without any lawful interruption or
disturbance from or by the Landlord or any person rightfully
claiming under or in trust fior the Landlord.

3. The Landlord shall ensure that the premises are adequately


insured.

III. PROVIDED ALWAYS and it is hereby agreed as follows:-

1. On the expiry of the term hereby created and subject to the Tenant
then not being in breach of any provision of this Agreement and
subject further to the Tenant having given due notice of his intent
to renew the Tenancy, the Landlord shall grant the Tenant a further
term as provided in Section 11 of the Schedule A hereto upon terms
and conditions to be mutually agreed upon.

2. That if any rent shall be in arrears for seven (7) days ( whether
formally demanded or not) or if the Tenant shall omit to perform
or observe any stipulations herein contained on his part, then, it
shall be lawful for the Landlord at any time thereafter to re-enter
upon the Said Premises and this Tenancy shall determine but without
prejudice to the right of action of the Landlord in respect of any
breach of the Tenant’s covenants herein contained.

3. All cost of and incidental to the preparation and execution of this


Agreement, including the stamp duty thereof, shall be borne and paid
by the Tenant.

4. The Tenant shall give two (2) months’ prior written notice of his
intention to exercise the option to renew this Tenancy before the
expiry of the term of this Tenancy.

5. The Tenant and the Landlord may by giving two (2) months’ notice
in writing re-terminating this Tenancy, provided that this right of
termination may not be exercised or notice given prior to the expiry
of ONE(1) year from the commencement of this Tenancy.

6. The Landlord shall refund to the Tenant the Said Deposit on the
expiry of the term of this Tenancy ( or the renewed term thereof if it
is has been renewed), less such sum/s of utility bills( show proof if
payments has been made) as may then be owing by the Tenant to the
Landlord including the costs of restoring the premises to its original
condition (fair wear and tear expected)

7. At the end of the Tenancy or sooner determination, the Tenant shall


return to the Landlord the keys to the Said Premises, failing which, the
costs for such replacements will be borne by the Tenant.

8.This Agreement shall be binding upon the heirs, personal


representatives, and assigns of the parties hereto.

AS WITNESS WHEREOF the parties hereto have hereunto set their


hands the day and year first above stated.
