DEED OF ADJUDICATION, WAIVER AND

AGREEMENT OF PARTITION

KNOW ALL MEN BY THESE PRESENTS:

We, LUIS T. SALAZAR, widower, resident of 23 Fortunata St., Iloilo City,


ANNA LIZZA SALAZAR-MAÑALAC married to Marvin Mañalac, resident of
Angeles City, Pampanga, LYNDON Y. SALAZAR married to Leah Salazar, resident of
Brgy. Calubihan, Jaro, Iloilo City, LAURENCE Y. SALAZAR married to Rubilyn
Salazar, and MA. LORENA SALAZAR, single, residents of 23 Fortunata St., Iloilo
City, all of legal age and Filipinos, are the forced, legal and surviving heirs of the late
Lucila Y. Salazar who died intestate and without will or debts to be paid on June 1, 2016 in
Iloilo City;

During her lifetime, she is the co-owner of the following real properties, all situated in
the City and Province of Iloilo, as follows:

“A parcel of land (Lot 147-C-8-6-6 of the subdivision plan (LRC)


Psd-14815, being a portion of Lot 147-C-5-C described on plan, Psd-
45060, LRC Record Nos. 5913 and 9739), situated in Iloilo City, Island
of Panay. Bounded on the NE., points 5 to 1 Lot 147-C-8-B, Psd 45060;
and point 1 to 2 by Lot 147-C-8-C-5 of the subdivision plan and on the
SE., points 2 to 3 by Lot 146, Iloilo Cadastre and points 3 to 4 by Lot

Ungka, Municipality of Jaro, Province of Iloilo, Island of Panay.
Bounded on the NW., and NE points 4 to 6 and 6 to 1 by Lot 19 (Road);
on the SE., points 1 to 2 by Lot 7, both of the consolidation-subdivision
plan and points 2 to 3 by Lot 194, Jaro Cadastre; and on the SW., points
3 to 4 by Lot 5, all of the consolidation-subdivision plan.Beginning at a
point marked “1”; containing an area of ONE THOUSAND (1,000)
SQUARE METERS, more or less.

That pursuant to Section 1, Rule 74 of the Revised Rules of Court of the


Philippines, we hereby adjudicate unto ourselves the share of the late Lucila Y. Salazar
over the real properties described above including the improvements respectively
standing thereon, free from all liens and encumbrances;
That further, I, LUIS T. SALAZAR, do hereby renounce, abdicate and waive my
shares and interests over the same real properties including the improvements
respectively standing thereon in favor of my children Ma. Lorena Salazar, Anna Lizza
Salazar Mañalac, Laurence Salazar and Lyndon Salazar, whereby we likewise agree that
for an orderly and convenient distribution of said properties without need of any judicial
action, we do hereby partition the listed properties in the following manner, to wit:

1. TRANSFER CERTIFICATE OF TITLE NO. T-23130 in favor of Laurence Y.


Salazar, married to Rubilyn Salazar;

2. TRANSFER CERTIFICATE OF TITLE NO. T-53309 in favor of Anna Lizza


Salazar-Mañalac, married to Marvin Mañalac;

3. TRANSFER CERTIFICATE OF TITLE NO. T-32238 in favor of Ma. Lorena


Salazar;

4. TRANSFER CERTIFICATE OF TITLE NO. (T-32237) 095-2017002349 in


favor of Lyndon Y. Salazar, married to Leah Salazar; and

5. TRANSFER CERTIFICATE OF TITLE NO. T-124237 in favor of Luis T.


Salazar.
The PARTIES, by this adjudication and agreement of partition, expressly
undertakes to cause the preparation and notarization of this instrument, the settlement of
the legal fees appurtenant thereto and the delivery of the original owner’s copies of the
respective titles to the respective waives. Thereafter, the payment of taxes including,
documentary stamp tax, and all other expenses necessary for the transfer of title to each
of the parties shall be for their sole, exclusive and individual accounts.

WHEREFORE, in consideration of the sum of FIFTEEN MILLION PESOS
(P15,000,000.00), Philippine Currency, in hand paid by the BUYER to the full and entire
satisfaction of the SELLERS, the latter do hereby SELL, CEDE, TRANSFER AND
CONVEY unto the herein ROBERTO S. TAJANLANGIT, JR., his heirs, assigns and
successors-in-interests, by way of absolute sale, the above-described parcel of land
including all the improvements standing thereon, free from all liens and encumbrances of
whatever nature including real estate taxes as of the date of this sale.

The SELLERS, by this absolute sale, expressly undertakes to cause the


preparation and notarization of this instrument, the settlement of the legal fees
appurtenant thereto and the delivery of the original owner’s copy to the BUYER. The
rest, including the payment of capital gains tax, documentary stamp tax, and all other
expenses necessary for the transfer of title to the BUYER shall be for the sole and
exclusive account of the latter.

ADDENDUM TO THE DEED OF ABSOLUTE SALE

This Addendum refers to the Deed of Absolute Sale executed by JELFA


INTEGRATED LENDING INVESTORS, INC., with principal place of business at 2/F
Central Market Bldg., Iznart St., Iloilo City, as Vendor, in favor of HILARY L.
CATEDRAL, of legal age, married to Marriane F. Catedral, Filipino and a resident of
Abordo St., Janiuay, Iloilo, per Doc. No. 185; Page No. 38; Book No. XVIII; s. 2018
dated December 7, 2018, subject of which is Lot 824-B-1-A consisting of 250 Sq. M.,
covered by Transfer Certificate of Title No. T-152292 and situated in Jaro, Iloilo City.

By this addendum, it confirms and certifies that the subject lot has been inspected
and the documents related thereto properly evaluated prior to the execution and signing
thereof and that the sale for the consideration of ONE MILLION FIVE HUNDRED
THOUSAND PESOS (P1,500,000.00) includes the existing structures and
improvements standing thereon.

Sir:

I am the true and lawful owner of one (1) unit TOYOTA RAV4 2014 with Plate No. AAL-
8354, Serial/Chassis No. JTMYF9EV90J011471 and Engine No. 2AR-E846475.

The registered owner is my cousin. I purchased this motor vehicle for my mother the late
Nelida Uy-Dellota in 2017 when she became sickly so that she can use the same for her
hospital visits. After the sale, and because my mother will be the one to use the same,
he delivered the original Certificate of Registration (CR) and Official Receipt (OR) as well
as the Cancellation of Mortgage from BDO to her. My mother died on March 14, 2019.

After her demise, we started using this motor vehicle until my son Neil Warren Uy
Dellota was flagged down May 24, 2019 by the elements of your police unit and this MY
unit impounded. It was then that we discovered that the original CR/OR, the original
cancellation of mortgage earlier given by my cousin Derrick Uy Chua and the previous
copy of the Deed of Sale he issued to me were all misplaced due to the fact that my
mother went in and out of the hospital for one year before she finally succumbed to her
illness.

There was never an intention to conceal anything by reason of the sale of this motor
vehicle to us by our cousin Derrick Chua. In fact, we were able to check with the Land
Transportation Office (LTO) and verified the vehicle history of this TOYOTA RAV4 2014
with Plate No. AAL-8354 and the same does not bear any alarm and that it showed that
it was purchased from a legitimate source having also shown the Vehicle Sales Invoice
for the said MV unit.

We fervently request therefore that you may be kind enough to release the same MV
unit from your custody so that we can properly reconstitute and straighten once and for
all the documents covering the herein motor vehicle.

As a sign of good faith, the registered owner Derrick Chua executed yet another Deed of
Absolute Sale in my favor if only to confirm the legitimacy of the sale. We will also be
transferring the ownership of this MV unit as soon as the relevant documents are put into
place.

This is of course with the undertaking that we will always make the same unit available
in case you need it for further investigation.
