ABSTRACT
The woman (wife) has the obligation to carry out an ihdad (period of mourning) for a period
of four months and ten days due to her husband's death. The wife should show her grief by
not making fun of herself, not leaving the house and not turning a blind eye, which is meant
as a tribute to the death of her husband. If the mourning period is over, then there will be no
more barriers to mocking themselves, making invitations, and even carrying out a marriage
contract for women. Ihdad for women in the Compilation of Islamic Law (KHI) was studied
using gender analysis. This study also intends to find out ihdad in terms of the Qur'an and
Hadith, which is whether ihdad is one of the rules of Islamic or customary law in Arab
society, because when the Qur'an and al-Sunnah came down as sources of law The highest
community activities are different from the 'URF or customary communities. Library
research is a suitable method to be used in this research, because it is aimed at and
emphasized on library-based research, with the problem of ihdad as a relation. The results of
this study show that the provisions for ihdad are included in Article 170, CHAPTER XIX,
regarding the period of iddah in the Qur'an and Hadith according to its provisions. This is in
accordance with the provisions of ihdad (a period of mourning), which applies not only to
women but also to men, although the methods and forms are different. Talaq (divorce) is also
discussed in this study, because it is a shari'a stipulation that determines various expectations
for women and men, there are legal norms and etiquette values that distinguish the roles of
men and women, meaning Talaq (divorced) in the future. mourning in the Compilation of
Islamic Law applies to anyone, be it male or female.
