MOTION FOR APPROVAL OF 


COMPROMISE AGREEMENT

PARTIES, assisted by their respective counsels, respectfully


submit unto this Honorable Court that:

The parties have come to an amicable settlement and have


executed a compromise agreement, dated October 29, 2020, with the
following terms and conditions:

1. In order to avoid protracted litigation, to buy peace of mind


and to help declog dockets of the court, parties have agreed
to settle this case amicably;

2. Defendants shall pay the plaintiff the total amount of SIX


HUNDRED NINE THOUSAND SIX HUNDRED PESOS AND
0/100 (Php609,600.00) representing their total obligation, in
the following manner:

2.1. P12,700.00 per month from October 2020 up to


September 2024, payable every 30th day of the
month
3. All payments made by defendants shall be transacted only at
Bank of the Philippine Islands / BPI Family Branches, BPI
Express Online or BPI Express Phone.

4. In the event that the defendant fails or refuses to comply with


the terms and conditions of the Compromise Agreement, or
to pay the plaintiff any of the stipulated installments on or
before its due date, the whole obligation still outstanding
shall become due and demandable, and shall earn interest
per month and penalty, each at the rate of 1% per month
until payment is made. In addition, plaintiff shall be entitled to
the issuance of a Writ of Execution to enforce the judgment;

5. In the event that the plaintiff is compelled to resort to the


Court to the enforcement and execution of this agreement,
defendant shall be liable to pay the plaintiff all expenses,
incidental and necessary, that may be incurred by the latter
in connection herewith;

6. Further, the parties have confirmed that they entered into


this Compromise Agreement freely and voluntarily and that
they carefully read and completely understood the content
thereof.

The parties agree that the approval of this agreement by the


Court shall put an end to this litigation, except for purposes of
execution in case of default.

PRAYER

WHEREFORE, premises considered, the parties respectfully pray


that the court approve this compromise agreement and
render judgment on the basis thereof.
