1 DECLARATION OF BRODY DALLE-HOMME
3 1. Declarant is the Petitioner in the within matter. I have personal knowledge of the
4 following facts, and if called upon, I could and would testify competently thereto. I submit the
5 following with respect to my requested relief.
6 2. On the evening of November 27, 2019,1 was at my home with two of my children.
7 Wolf(age 3), Camille (age 13), my sister, her boyfriend, and my husband’s mother.
8 3. 1 was in Wolfs room putting him to sleep sometime between 9:45 and 10:00 p.m,
9 when 1 heard Josh’s car screeching around the corner and into the driveway. 1 left Wolfs room and
10 went into my bedroom where 1 could see Josh sitting in a chair on the patio in the dark and he began
11 speaking to me. 1 could tell that he had been drinking based on how he was speaking. 1 had also
12 seen on our American Express statements that he had purchased alcohol that day.
13 4. 1 went downstairs to tell Josh’s mother that he shouldn’t be driving. Josh was
14 supposed to go that evening to meet up with his father and my other son Ryder for a guy’s night and
15 1 did not want him driving in his condition. When Josh came inside the house he was clearly
16 intoxicated and 1 heard his mother say to him that she could smell the alcohol on his breath and he
17 should not drive.
18 5. Josh told me that he wanted to talk to me alone so Camille and Josh’s mother went
19 into the media room so that he and 1 could speak in the kitchen. This was at around 10:15 p.m. Josh
20 started yelling at me and insulting me.
21 6. A few minutes later, my sister and her boyfriend arrived home and came into the
22 kitchen so Josh and 1 went outside onto the patio. He continued to hurl insults at me, screaming and
23 yelling, telling me that 1 was a liar and a coward. He also kept saying “you think you are so fucking
24 perfect.” 1 did not engage with him or yell back but his tone kept escalating and he appeared to be
25 getting angrier.
26 7. 1 asked Josh to be quiet since our son was sleeping and Camille was upstairs and
27 would hear him. He then looked at me and said “1 was thinking about how 1 wanted to kill you, and
28 no one would know because you would be dead.” 1 asked Josh if he was threatening me. Josh said

3 8. At this time. Josh moved towards me, and my back was against a railing so there was
4 nowhere else I could go. I turned my head to the side quickly and he head-butted me so violently on
5 the top right part of my head that my head jerked back and my knees buckled. I screamed. I was on
the floor and Josh looked at me and said “you fucking faker.

7 9. Right after I fell to the ground and screamed, he opened the sliding door to the inside
8 and yelled that I was faking it and had made it all up. Immediately after that, Camille and my sister
9 rushed outside and held me while I was on the ground shaking and crying. Josh’s mom came
10 outside too. Camille asked Josh “what did you do?” and Josh responded “I didn’t do anything, she

11 put herself there.” Camille said “but why would she do that” and Josh said “that’s your mom. Josh
12 never asked if I was okay, never helped me up, and never checked on me.
13 10. My sister took me into the guestroom on our first floor to try and calm me down.
14 Josh’s mother came in and said “He’s afraid you’re going to call the police.” I asked why he was
15 afraid if he didn’t believe he had done anything wrong.
16 11. Soon after that. Josh and his mother left the house but returned 10 to 15 minutes later
17 to retrieve his cell phone. After spending a few minutes locating the phone, they left again.
18 12. At 10:51 p.m., shortly after the incident, I texted Dr. Sophy (Josh’s therapist and our
19 couple’s counselor) to let him know what had happened and that Josh had head-butted me.
20 13. I waited until my daughter had calmed down and gone to sleep to call the police. I
21 did not want to expose her to any more trauma. At 1 a.m. I called 911 and told them that my
22 husband had attacked me. They arrived within ten minutes, took my statement, took my sister’s
23 statement, took my sister’s boyfriend’s statement and then issued an Emergency Protective Order
24 which is in place until 5:00 p.m. on Friday, December 6, 2019 and provides protection for me. A
25 true and correct copy of the Emergency Protective Order is attached hereto and marked as Exhibit A.
26 14. Right after the incident, a raised welt appeared at my hairline where Josh head-butted
27 me. I had a red circular mark above my right eyebrow. The next morning bruising appeared. After
28 a week I still had bruising and my right eyebrow remains swollen. I continue to have headaches

1 since the injury. True and correct copies of photographs taken of my injuries in the days since the
2 attack are attached hereto as Exhibit B.
3 15. This is not the first time Josh has physically hurt me or been abusive,just the most
4 recent time. 1 will have evidence of the prior incidents at the time of a hearing.

1 Josh and I were married on December 3, 2005. I filed for divorce in November 2019. Our
27 Custody Judgment was filed in October 2020 and our Further Judgment resolving all financial
28 issues was signed earlier this summer. It has been submitted to the Court but I understand it has
not been filed. Our marital status has not been terminated.

1 2. Josh has a long history of substance abuse problems and aggressive behavior. He
2 entered an in-person drug and alcohol rehabilitation program in December 2019 and then
3 represented for many months that he was attending Alcohol Anonymous. He also agreed to drug
4 and alcohol testing. During the time period that he was testing, there was evidence of tampering
5 and at least one positive test. Soberlink suspended his account at one point as a consequence of the
6 tampering. Josh's behavior during our marriage was affected by his substance abuse issues. There
7 are several examples which have been reported in the media that demonstrate how he can behave
8 when intoxicated. I tolerated Josh's controlling and abusive behavior during our marriage, until I
9 no longer could.
3. Shortly after filing for divorce, after an incident at our home on November 28, 2019,
12 Order in December 2019. A Department of Child and Family Services investigation was opened
13 and ultimately a Dependency Court case was opened as well. I was accused of failing to protect my
14 children from Josh's abuse. Instead of pursuing a permanent Domestic Violence Restraining Order
15 against Josh, I focused on our children. Josh and I were able to reach a final child custody and
16 visitation agreement at the urging of our co-parenting counselor. I hoped that reaching resolution
17 would reduce Josh's anger and hostility toward me, and therefore make our children's lives more
18 peaceful, but it has not. It has not even shielded our children from Josh's abuse.
19 4. Over the last several months, Josh's troubling behavior has escalated. Some of
20 these behaviors are discussed in detail below. Until now, at the beginning of Josh's time, our
21 children tell me that they do not want to go to Josh's house but ultimately, at least Wolf and Ryder
22 would go. But it gets harder and harder each week. Wolf holds on to me tightly. Ryder says no.
23 Camille often simply refuses to leave the house. Then, during our custodial exchange and in front
24 of our children, Josh consistently calls me names such as "cunt," "cow," "liar," "bitch," "crazy,"
25 and "backstabber."

1 the afternoon of Friday, August 26, 2021. I cannot send them back to their father when they
2 are saying that they are scared of him, and scared that he will hurt me and them. Someone
3 needs to help our children which is why I am asking that the Court appoint minors' counsel.
4 6. On August 26, 2021, Camille informed me that in early August Josh told her that he
5 would "kill himself' if she and her brothers kept "stabbing him in the back" by telling me what he
7 7. On August 24, 2021, Ryder shared with Gunner what has been happening at his
8 father's home in detail. Ryder's statements to Gunner are contained in his declaration (attached
9 hereto). Our 10 year old son is afraid that his father will hurt his mother and him.
10 8. On August 20, 2021, our children returned to my home pursuant to our parenting
11 schedule. Camille and Ryder told me that they were scared at Josh's house when they were with
13 9. On June 18, 2021, I was dropping Ryder and Wolf at Josh's home. Camille refused
14 to go. When we arrived at approximately 5:00 p.m., Josh was standing in his driveway. He was on
15 his phone and seemed agitated. I parked several houses from Josh's home and Ryder and Wolf
16 started getting out. Josh walked to the passenger side of the door and punched the car window,
17 yelling "Where's my fucking daughter?" He demanded to know where Camille was and said that I
18 had filled her head with shit. Josh then called me a "cow" and a "cunt" in front of Ryder and Wolf.
19 He would not let me close my car door. Josh was so close to my face that I could see the bags under
20 his eyes. I moved further inside my car because I was scared that he was going to hurt me. Finally,
21 he let go of my door. I closed the door and Josh turned around and yelled "hey Brody fuck you"
22 and gave me the middle finger. I could see Ryder and Wolf at the top of Josh's driveway and they
23 looked scared.
24 10. Over the last few months, Ryder has told me the following:

5 1. Josh demanded that Ryder go downstairs and get him tequila. Ryder was scared
11 n. Wolf asked Josh why he yelled at me, and Josh said, "Because I'm fucking sick
12 of her."
13 11. In addition, our children and I need protection because of the following behaviors.
14 a. Josh has punished our children when he is upset at me by taking their phones
15 away so that they could not contact me. This happened on May 22, 2021 and
16 June 7, 2021, and several times over the summer. While at Josh's house's,
17 Camille has called me in secret because Josh has said they cannot call me.
18 b. In front of our children, Josh has threatened to take them away from me if my
20 c. Josh threatened to "kill" Gunner, "shoot" Gunner, and "fucking murder" Gunner.
21 This happened in early June 2021 in front of Camille. She refused to see Josh

26 12. There is also video and audio recordings of Josh being abusive, and harassing texts

25 3. On August 24, 2021, Ryder confided in me about concerning incidents involving his
26 father, Respondent Josh Homme (“Josh”). Ryder and I were spending time together at Brody’s
27 home and planned to go to a gym near her apartment complex, as we usually do. I observed that
28 Ryder seemed visibly upset, anxious and scared so I asked Ryder what was on his mind. Ryder told

1 me he was feeling scared, that he hated his dad and did not want to go back over to his house. This
2 is not the first time Ryder has expressed fear of his father or not wanting to be in his father’s care,
3 but he seemed particularly distressed on this day. Ryder proceeded to confide in me that he did not
4 want to go to the gym because he did not want to leave his mom alone in the apartment but changed
5 his mind after I suggested a little movement might help him work through his emotions. While at
6 the gym, Ryder expressed to me that he had a lot of stuff that he was holding in but was afraid no
7 one would believe him and that if his dad found out, and he had to go back there, he would hurt him
9 4. I could tell Ryder was holding a lot in and he was visibly distressed so I encouraged
10 him to get things off his chest if he felt comfortable. Ryder’s voice sounded like he was nervous as
11 he spoke to me. He again said he was scared and angry and wanted to stay with his mom and that
12 he did not want to go to his dad’s house anymore. I suggested that he talk to his dad and
13 communicate how he was feeling by a phone call, letter, or text. He laughed and said: “You don’t

16 “whenever we’re gone I’m scared that dad is going to hurt Mom. I’m always scared that he’s going
17 to come here and hurt Mom, that’s why I was hesitant of coming to the gym. Because if he comes
18 here and we’re gone he’s gonna hurt mom. I’m the one who takes the brunt of everything.”
19 6. I asked Ryder why he would think that and he told me that he has seen his dad punch
20 his mom, scream in her face, throw her down, trip her, head butted her in her face, threaten her,
22 7. Ryder also confided in me that he is scared that Josh would come to Brody’s house
23 to hurt him and his siblings. I then asked Ryder why he thinks Josh would hurt him and Ryder told
24 me that his dad has hurt him before. Ryder said: “Because he already has. He has hit me, yelled at
26 8. Ryder also told me that his Josh manipulates and bribes Wolf, the parties’ five year
27 old son, to say hurtful things about me and Brody, and then films Wolf saying those things with his
28 phone.

1 9. Ryder continued to sound worried and fearful and told me: “I don’t want my dad to
2 get in trouble, but I don’t want him to do this. I just want him to stop doing all of this.” Ryder said:
3 “My dad says I’m not allowed to share my feelings or be scared of him or be sad. I feel bad for
4 Wolf. …My dad says he’s going to do something to my mom. He said that it’s time for war. That’s
6 10. I asked Ryder what he thinks would happen if he talked to his dad to tell him how he
7 felt. He responded: “I’m scared he’s going to try and hurt me, or everyone and will camp outside
8 the apartment.” He then got excited in remembering when we heard something in the bushes outside
9 of the apartment earlier that day and stated: “Maybe it was him we heard in the bushes?!” He
10 continued to say: “he is scary, he’s a scary dude. He’s big, tall and strong. I imagine a scene from
11 the Shining, where he would break the window because dad has a big axe that he keeps in the house.”
12 11. Ryder then told me that he has observed five bottles of whiskey at this dad’s house
13 at the beginning of every custodial week, and that there is only one left by the time he leaves. He
14 also said that he has found two bottles of vodka in the freezer. Ryder also described Josh leaving
15 the house in his car with a bottle in a paper bag. He believes Josh is drinking when he decides to go
17 12. I asked Ryder if Josh ever has a bottle in a paper bag while he is driving with Ryder
18 and his siblings and he responded: “it wasn’t in a paper bag. But he drinks while we are in the car.
19 The car is parked and it’s a cocktail you can buy, like a hard seltzer.” I asked Ryder if Josh then
20 drives around with the kids after he has been drinking and Ryder responded: “Yep!”
21 13. Ryder also told me that Josh “smokes everywhere” even when he and his siblings
22 are at the house. He also shared that, “He also calls me a liar and says I don’t have asthma cause it
23 hurts to breathe around the smoke. And I don’t like to talk about it because he calls me a liar.”
24 14. Ryder confided in me about his father for about an hour. After we spoke, he was
25 visibly relieved as if he had been holding in all his fears for a while. You could see the change in
26 his face.
27 15. Based on my past interactions with Josh and what I know about him, I believe Josh
28 is a dangerous person, especially when he is under the influence of drugs and alcohol.
