Proposed Resolution Introduced by

HON. LEVY LLOYD B. ORCALES


A RESOLUTION ENJOINING THE BAGUIO GENERAL HOSPITAL AND MEDICAL
CENTER IN PARTNERSHIP WITH THE MENTAL HEALTH SERVICE PROVIDERS
AND ORGANIZATIONS TO REINSTITUTE ITS MENTAL HEALTH PROGRAMS
FOR THE PATIENTS ESPECIALLY THOSE WHO ARE IN CRITICAL CONDITIONS.

WHEREAS, the World Health Organization (WHO) defines mental health as “a state of
well-being in which the individual realizes his or her own abilities/potential, can cope with the
normal stresses of life, can work productively and fruitfully, and is able to make a contribution to
his/her community” which refers to the foundation of the well-being and effective functioning of
individuals;

WHEREAS, Section 15 Article II of the 1987 Constitution states that the State shall protect
and promote the right to health of the people and instil health consciousness among them;

WHEREAS, Republic Act No. 11036 otherwise known as the “Mental Health Act” provides
that the basic right of all Filipinos to mental health as well as the fundamental rights of people
who require mental health services shall be promoted ensuring that persons with mental health
conditions are able to fully exercise their rights without any form of discrimination and
stigmatization at work or in the community;

WHEREAS, before the Covid-19 pandemic hit us, the Baguio General Hospital and Medical
Center implemented mental health programs that were designed to accommodate and provide
support to its patients who were under critical conditions;
WHEREAS, due to the pandemic, the implementations of the mental health programs for
patients who were in critical conditions were interrupted in accordance with the restrictions
imposed by the Inter-Agency Task Force for the Management of Emerging Infectious Diseases
(IATF – EID) to prevent or limit the spread of the virus;
WHEREAS, the adverse effects of the pandemic to the patients, especially those who are in
critical condition gravely affected their health. Particularly, their mental health went down low
due to various circumstances;
WHEREAS, there is a desperate need to address the mental health concerns of the patients
by reinstituting the mental health programs for critically-ill individuals;
WHEREAS, the latest issuance of the IATF provides for the allowance to conduct limited
activities that require face-to-face interactions;
WHEREAS, on February 14, 2022, the IATF issued Resolution No. 161-A Series of 2022
approving the recommendations of the sub-Technical Working Group on Data Analytics placing
the Cordillera Administrative Region (CAR): Abra, Apayao, Baguio City, Benguet, Ifugao,
Kalinga, Mountain Province to Alert Level 2 effective 12 February 2022 until 28 February 2022;
WHEREAS, the Section 5 of the IATF Resolution No. 161-A Series of 2022 provides
guidelines for areas under alert level 2, particularly:

5. Intrazonal and interzonal movement shall be allowed. However, reasonable
restrictions may be imposed by the LGUs, which should not be stricter as those
prescribed under higher alert levels and subject to the oversight, monitoring, and
evaluation of their respective RIATF.
a. Venues for meetings, incentives, conferences, and exhibitions (MICE);

WHEREAS, the gradual easement of the health protocols eventually allows the possible
implementation of the suspended programs that provide mental health assistance to the patients
who are critically ill;
NOW THEREFORE, on motion of Hon. Levy Lloyd B. Orcales, duly seconded, be it
RESOLVED, as it is hereby resolved, enjoining the Baguio General Hospital and Medical
Center in partnership with the mental health service providers and organizations to reinstitute its
mental health programs for the patients especially those who are in critical conditions.

RESOLVED FURTHER, to enjoin other mental health service providers, educational


institutions, and other mental health organizations to participate in the programs that provide
assistance and guidance to the patients who are in critical conditions.

RESOLVED FINALLY that copies of this resolution be provided to the Baguio General
Hospital and Medical Center.
