BETWEEN

AND WHEREAS the LICENSEE has requested the LICENSOR allow the
L I C E N S E E t o u s e o f t h e s a i d fl a t w i t h i n s t a l l a ti o n s a tt a c h e d t h e r e o f o r
l a y i n g t h e r e i n ( t h e s a i d fl a t t o g e t h e r w i t h t h e s a i d F i x t u r e s e t c . ) b e i n g
h e r e i n a ft e r c o l l e c ti v e l y called “ the said premises “ on a LEAVE &
LICENSE BASIS and the Licensor has acceded to the said request.
1. The Licensor herein hereby grants the Leave and License to the
L i c e n s e e t o e n t e r i n t o , u s e , l o o k a ft e r a n d o c c u p y t h e F l a t p r e m i s e s f o r
a period of 11 (ELEVEN) MONTHS commencing from 10th MAY, 2011, and
which shall come to an end on the 10th APRIL, 2012, which is the
essence of this Agreement. It is being made very clear to the License
that the said premises are taken by the Licensee for the exclusive use
a n d o c c u p a ti o n o f h i s / h e r f a m i l y o n l y .
4. T H E L I C E N S E E s h a l l p a y t h e c h a r g e s f o r t h e c o n s u m p ti o n o f E l e c t r i c i t y
and Car Parking Charges if any, and all other charges such as service
outgoings will be paid by the Licensor.
5. THE LICENSEE shall keep the said premises for his personal use of
residence and shall not permit any one else to use occupy the said
premises.
6. THE LICENSEE shall be liable to pay the Licensor all the costs,
Expenses, or otherwise for any damages, caused due to negligence and
damages, caused due to negligence and carelessness of the said Licensee
while making use of the said premises or any part thereof or to the
fi x t u r e s a n d fi tti n g s t h e r e i n a n d t h e L i c e n s e e s h a l l k e e p t h e l i c e n s o r
i n d e m n i fi e d i n r e s p e c t o f s u c h l o s s o r d a m a g e s .
8. T H E L I C E N S E E s h a l l o b s e r v e a l l t h e r u l e s a n d r e g u l a ti o n s a n b y e - l a w
t h e s o c i e t y t o t h e u s e r o f t h e s a i d p r e m i s e s i n p a r ti c u l a r a n d t h e
Building and Society in general.
10. THE LICENCE is not transferable and is covered under the Transfer
of property ACT.

11. T H E L I C E N S E E i s e n ti t l e t o p a y e l e c t r i c i t y c h a r g e s p a y a b l e b y t h e
l i c e n s e e a t t h e ti m e h e v a c a t e t h e p r e m i s e s o u t o f t h e s e c u r i t y d e p o s i t
a n d s h a l l p a y t h e b a l a n c e a m o u n t t o t h e L i c e n s e e a t t h e ti m e h e v a c a t e s
the premises if is unpaid by the licensee for the said period.
12. T h e L i c e n s e e i n d e m n i fi e s t h a t a n y d o c u m e n t i s s u e d a t t h e r e q u e s t
of Licensee will be used by him for that purpose only.
13. T H E L I C E N S E E i s a l s o e n ti t l e d t o s u r r e n d e r t h e s a i d p r e m i s e s f r e e
t h i s a g r e e m e n t i n i t s f a v o r b y g i v i n g o n e m o t h n o ti c e i n w r i ti n g o f i t s
i n t e n ti o n to do so addressed to the Licensor and delivered at the
residence of the Licensor.
14. Since the Leave and License Agreement is entered into by the
p a r ti e s s t r i c t l y i n t e r m s o f t h e n e w l y i n t r o d u c e s e c ti o n o f t h e B o m b a y
Rent Act and the licensee hereby agrees that the licensor shall be
e n ti t l e d to recover possession of the Licensed premises within the
m e a n i n g o f s e c ti o n 1 3 ( A ) ( 2 ) o f t h e B o m b a y R e n t A c t 1 9 4 7 .

contained herewith and each of them fully above contained and in
w i t n e s s w h e r e o f t h e p a r ti e s h e r e t o s u b s c r i b e d t h e i r h a n d s a n d s e a l t h e
d a y a n d y e a r fi r s t h e r e i n a b o v e w r i tt e n .
