of MS. B

This Judicial Affidavit of Ms. B is executed to serve as her direct testimony in

the instant case.

This Judicial Affidavit is being offered to prove:

A) All the allegations in the case including all annexes appended thereto,

which she respectfully requests to be correspondingly marked as exhibits in
this case; and
B) All other related matters, facts and circumstances related thereto, with
reservation to present additional exhibits in the course of the proceeding of the
instant case.

This Judicial Affidavit was taken at the office of Atty. Alvi Shane Nava at Unit
7827, JL Tower, 108 Montinola St., Legaspi Village, Barotac Viejo.

Questions were propounded by Atty. Alvi Shane Nava and these questions are
numbered consecutively and each question is followed by the answer of the
witness.

Q: Do you swear to tell the truth and nothing but the truth?

A: I do.

Q: Are you aware that you may face criminal liability for false testimony or
perjury if you will not tell the truth?

A: I am.

Q: Please state your name, age address and occupation?

A: I am Ms. B, 41 years old, married, and residing at 888 Montinola St.,
Legaspi Village, Barotac Viejo.

Q: Are you the same Ms. B, the victim in this case?

A: Yes.

Q: Do you know the Accused in this case, Ms. A?

A: Yes, she was my friend.

Q: Where were you on the 8th day of January 2000, at around 8:30 in the
evening?

A: I was in 759 Craig St., San Juan Village, Barotac Viejo. Ms. A’s house.

Q: What were you doing there?

A: We were hanging out, watching movies, with two other friends.

Q: What are the names of those other friends?

A: Jax Palmejar and MJane Cecil.

Q: What happened next?

A: I felt drowsy and must have fallen asleep.

Q: What transpired next?

A: I think I heard Jax and MJane say they had to head out.

Q: What did you do after?

A: I was not sure what was going on. I was half asleep, I think, at that point and
decided to just take a nap.

Q: What do you remember happened after?

A: I woke up half naked and I saw her (Ms. A.) rubbing of her private parts with
mine.

Q: What happened next, if any?

A: I started yelling and I think it shocked her because she was not able to
react.

Q: What did you do after, if any?

A: I immediately ran away as fast as I could.
