NOTIFICATION

Bhubaneswar, dated 27th November, 2020

No. 6146--LESI-LL2-FM-0010-2019-LESI.-Whereas the draft of certain rules further

to amend the Odisha Factories Rules, 1950 was published as required by section 115 of
the Factories Act, 1948 (63 of 1948) in the extraordinary issue No.1130 of the Odisha
Gazette dated the 21st September, 2020 under the Notification of the Government of
Odisha in the Labour and ESI Department No. LL2-FM-0010-2019-4819/LESI, dated 18th
September 2020, for information of all persons likely to be affected thereby and
objections and suggestions were invited in respect of the said draft within a period of
forty-five days from the date of publication of the said notification in the Odisha
Gazette;
And whereas, no objection or suggestion is received from any person within the
period so stipulated above in respect of the said draft;
Now, therefore, in exercise of the powers conferred by section 112 of the
Factories Act, 1948 the State Government do hereby make the following rules further to
amend the Odisha Factories Rules, 1950, namely:

1. (1) These rules may be called the Odisha Factories (Amendment) Rules, 2020.
(2) They shall come into force from the date of their publication in the Odisha
Gazette.

2. In the Odisha Factories Rules, 1950 (hereinafter referred to as the said rules), in
rule 7,
(i) in sub-rule (2), after the words “application for the renewal of a license
shall be”, the words “made online and” shall be inserted; and
(ii) after sub-rule (2), the following sub-rule shall be inserted, namely:-
“(2-a) The license shall be deemed to be renewed provided that the
application and the fee for renewal of license is received online with self
declaration in form 2A certifying no change in manpower, installed power,
factory layout, manufacturing process, occupier and manager”.

3. In the said rules, after Form 2, the following Form shall be inserted, namely:-
“Form 2A
[see rule 7(2-a)]
(Self declaration by the Occupier and Manager for renewal of Factory License)

situated at ____________________ P.O. ________________/ P.S.- ___________,
Dist- __________________, PIN- _____________ .
2. That , Sri / Smt. _____________________ is the manager of the factory.
3. That, the factory license for the preceding year, i.e. _____________ is in force for
______________ KW and manpower of ________________ .
4. That, there is no change in manpower and installed power in the factory.
5. That there is no change in factory layout and manufacturing process; no addition
and alternation made with reference to plan approved in letter No.____________
dated _______________ of the ________________________.
Further, we undertake that, we will be held liable for penal action, if the
information furnished above are found to be false at any stage in future.
