THE RELEVANT PROVISIONS OF THE REVISED PENAL CODE BOOK

This academic paper weighing the advantages and disadvantages of


barangay ordinances within Santa Rita, Cabiao, Nueva Ecija, to determine
the possible outcome of having/enacting: ESTABLISHMENT OF
VIOLENCE AGAINST WOMEN AND THEIR CHILDREN (VAWC) and the
Implementing Rules and Regulation of RA 9710 of BARANGAY STA. RITA
CABIAO, NUEVA ECIJA
Violence against women and children is a severe public health issue
with societal consequences. Although all people are vulnerable to violence,
women and children are more vulnerable because they frequently have
less rights or lack enough protection. Certain forms of violence are socially
or legally accepted in some communities, increasing the risk to women and
children.
It is a law that aims to address the prevalence of violence against
women and their children (VAWC) perpetrated by their intimate partners,
such as their husband or ex-husband, live-in partner or former live-in
partner, boyfriend/girlfriend or ex-boyfriend/ex-girlfriend, dating partner or
former dating partner.
The Barangay ordinances was applicable within the jurisdiction of
Barangay Santa Rita, Cabiao, Nueva Ecija. It has 8 (eight) purok and the
estimated elevations above sea level: 16.0 meters (52.5 feet). The
Sangguniang Barangay was implemented the “Establishment of Violence
Against Women and their Children (VAWC)” in July 15, 2018.
All household (with the population of 8,441 as of 2020) that live in the
Barangay Santa Rita, with 8 Purok, in Cabiao, Nueva Ecija. The
Sangguniang Barangay of Santa Rita was enacted “ ESTABLISHMENT OF
VIOLENCE AGAINST WOMEN AND THEIR CHILDREN (VAWC) ” in July 15, 2018.
The estimated elevations above sea level: 16.0 meters (52.5 feet).
The fines and penalties of offenders proven in court to be guilty of the crime
shall be penalized with: imprisonment ranging from 1 month and 1 day to
20 years payment of P100,000 to P300,000 in damages mandatory
psychological counseling or psychiatric treatment.

The problems encountered by the barangay officials in implementing


VIOLENCE AGAINST WOMEN AND THEIR CHILDREN (VAWC) and the
RA 9710

The Advantage of having ESTABLISHMENT OF VIOLENCE AGAINST


WOMEN AND THEIR CHILDREN (VAWC)” are:
 To preserve the rights of women and children in the community.
 To raise the gender equality of a women as a part of society.
 To prevent the violence and abusive power of men towards to the
women.
 A court-issued order preventing women's husbands or partners from
harassing, irritating, telephoning, contacting, or otherwise engaging
with them
 Develop an understanding of violence against women and children as
being inextricably linked to the goal of social work, which is to assist
and empower vulnerable people.
 Raising awareness of violence against women and children as a
global issue.
 Identify and analyze the ideas used to explain the presence of
violence against women and children.
 Understand the many stages of VAWC prevention, such as primary,
tertiary, and secondary prevention.

The disadvantage of having ESTABLISHMENT OF VIOLENCE


AGAINST WOMEN AND THEIR CHILDREN (VAWC)” are:
 A deficiency or inadequacy of the barangay's budget or resources
 Lack of or insufficient training for barangay authorities
 Facilities for barangay authorities are lacking or insufficient
 The victims' or relatives' lack of cooperation or motivation in pursuing
the case;
 unfavorable consequences of linked legislation; and
 Inadequacy or scarcity of livelihood programs
The victim-survivors mentioned inefficient assistance and the lack of
initiative to provide help from the Barangay.

This academic study examined the execution of Republic Act No.


9710, or the institution of violence against women and children, in the
barrio of Sta. Rita Cabiao NuevaEcijaa. In terms of the extent of
implementation of RA 9710, the following areas of assessments were fully
implemented: applications for barangay protection orders (BPO),
preparation for and acceptance of BPO applications, services for and
assistance to victim survivors, facilities and resources, personnel as VAWC
service providers, and referral of victim survivors and data to approvers.
Residents and barangay officials encountered the following issues
during the implementation of RA 9710: a lack or insufficiency of budget or
resources; a lack or insufficiency of trainings; a lack or insufficiency of
facilities; a lack of cooperation or interest from victims or relatives in
pursuing the case; an adverse impact of related laws; and a lack or
insufficiency of livelihood programs.
As a result, trainings or seminars, the provision of facilities,
coordination and assistance from other agencies, the provision of funds, a
re-study of the effects of related laws on the implementation of RA 9710,
improved implementation of RA 9710 by officials themselves, and people
unity are required to maintain peace and order.

RECOMMENDATIONS
 In order to increase the level of compliance of RA 9710 in Barangay
Santa Rita Cabiao Nueva Ecija. The barangay authorities, need
constant training and awareness initiatives. Coordination amongst
law enforcers is required.
 To decide whether aid should be provided, barangay authorities must
grasp the difference between a typical disagreement and a case of
Violence Against Women and Children (VAWC).
 Trainings will be held, facilities will be provided, and laws will be
enacted to give further instructions in the execution of RA 9710.
 Suggestions from implementing agencies must be taken into account.
 Consideration must be given to the planned action plan. The
government and the general people must work together to offer
comprehensive protection and aid to victims and survivors.
 Prevention of VAWC requires public awareness. The government
must establish a committee dedicated to the management of VAWC
matters.
