SUBJECT: Spot Report: VIOLATION OF ALARM AND SCANDAL (Art. 155)
DATE: December 3, 2022

1. Please be informed that on December 2, 2022 about 9 PM in the evening at Purok Tres of BRGY
Alua Cabiao, Nueva Ecija, a complainant identified as Abrahim Abdul Asis, 30 years of age, complained
one of his neighbor identified as Jordi El Niño, 56 years old, retired Police officer who was fired a 38
revolver on the said time and date.

2. Initial investigation disclose that the suspect is under the influence of intoxicating liquor and was
observed unruly. According to the complainant, Jordi El Niño was creating an alarm and scandal by
discharging firearms in the front of his house on the said place, which result to disturbance to the
peace of its neighborhood. Abrahim Abdul Asis reported the incident in the Cabiao Police Station. The
responding Team of PNP went to the house of Jordi El Niño; the PNP team filed an appropriate charge
in court.

1. Reference: Spot Report dated December 3, 2022 pertaining on firing a firearms incident
transpired at Purok Tres Brgy Alua, Cabiao, Nueva Ecija

The signatory Chief of Police of Cabiao Post-Script would like to inform that the appropriate
complaint filed against Jordi El Niño for Alarms and Scandal (article 155 RPC) at the Office of
the Provincial Prosecutor of Nueva Ecija with NPS NO. XIV-01-INQ-19D-00132 and VII-01-INQ-
00445 under Atty. Abdul Jerome Salsalani, Public Prosecutor.

III. FACTS OF THE CASE

7. On December 2, 2022 at about 9:00 o’clock in the evening, a complainant named Abrahim
Abdul Asis walked into the police station to report the incident at Purok Tres Brgy Alua, Cabiao, Nueva
Ecija.

Under investigation of Police Officer Archie Gutierrez, on the said time and date, retired police officer
was fired his firearms identified as Jordi El Niño, he was a 56years old resident of Purok Tres Brgy
Alua, Cabiao, Nueva Ecija, that incident was reported by Abrahim Abdul Asis, according Abrahim
Abdul Asis; on that particular time and date while Jordi El Niño is under the influence of alcohol,
according to one of the friend of Jordi El Niño identified as Ray Angelo Pineda, he stated that Jordi El
Niño wants to show off his old firearms which is 38 revolver, in addition, he own this during his term
as a police officer, he also admitted that they are drinking alcohol every single day since the said
officer has been retired.

8. After Abrahim Abdul Asis reported the incident to the police station, a complaint was filed
against Jordi El Niño for Alarms and Scandal (art 155 RPC) at the Office of the Provincial Prosecutor of
Nueva Ecija with NPS NO. VII-02-INQ-19D-00488 and VII-02-INQ-19D-00489 under Atty. Jerome Abdul
Salsalani, Public Prosecutor.
IV: DISCUSSIONS/FINDINGS

9. In this case under investigation, both parties have a respective allegation with the incident that:

1. Jordi El Niño allegedly fired a 38 revolver

2. Jordi El Niño was intoxicated at the time of incident
3. Jordi wants to show off his old firearms
4. Jordi has a habitual drinking addiction
5. Ray Angelo Pineda testified that Jordi El Niño fired his firearm (3 times)

V: CONCLUSION

10. After a careful investigation surrounding the event it was revealed that the incident was result
of showing off his old firearms to his peer group that turns into a scandal for his other neighborhood.

VI: RECOMMENDATION:

11. Therefore, in the view of the foregoing, the undersigned respectfully recommends that the
case must be filed in the court having a jurisdiction for trial for determination of criminal and civil
liabilities of involved personalities.

 COMPLAINT

The undersigned chief of police of Cabiao Police Station, Cabiao, Nueva Ecija, after having
been duly sworn in oath in accordance with law, hereby accuses Jordi El Ni ño of the crime of
Alarm and Scandal, defined and penalized under Article 155 of the Revised Penal Code,
committed as follows:

That on the 2nd day of December 2022, at around 9:00 o’clock in the evening at Brgy Alua, in
the Municipality of Cabiao, Province of Nueva Ecija, Republic of the Philippines, and within
the jurisdiction of this Honorable Court, the above-named accused did then and there
willfully, and unlawfully fired gun in front of the house of Abrahim Abdul Asis, which result to
disturbance to the peace of its neighborhood.
