Complainant, an Deputy District Attorney, being first duly sworn on oath, deposes and says
that:

Count 1: CRIMINAL DAMAGE TO PROPERTY

The above-named defendant on or about Sunday, January 29, 2023, in the City of Green Bay,
Brown County, Wisconsin, did intentionally cause damage to the physical property of another,
belonging to ADL Monitoring Solutions LLC, without that person's consent, contrary to sec.
943.01(1) Wis. Stats., a Class A Misdemeanor, and upon conviction may be fined not more
than Ten Thousand Dollars ($10,000), or imprisoned not more than nine (9) months, or both.

Count 2: BAIL JUMPING

The above-named defendant on or about Sunday, January 29, 2023, in the City of Green Bay,
Brown County, Wisconsin, having been charged with a felony in Oconto County case 22CF8
and having been released from custody under Chapter 969 Wis. Stats., did intentionally fail to
comply with the terms of his bond, contrary to sec. 946.49(1)(b) Wis. Stats., a Class H Felony,
and upon conviction may be fined not more than Ten Thousand Dollars ($10,000), or
imprisoned not more than six (6) years, or both.

Count 3: BAIL JUMPING

The above-named defendant on or about Sunday, January 29, 2023, in the City of Green Bay,
Brown County, Wisconsin, having been charged with a misdemeanor in Oconto County case
21CM177 and having been released from custody under Chapter 969 Wis. Stats., did
intentionally fail to comply with the terms of his bond, contrary to sec. 946.49(1)(a) Wis. Stats.,
a Class A Misdemeanor, and upon conviction may be fined not more than Ten Thousand
Dollars ($10,000), or imprisoned not more than nine (9) months, or both.

Count 4: BAIL JUMPING

The above-named defendant on or about Sunday, January 29, 2023, in the City of Green Bay,
Brown County, Wisconsin, having been charged with a misdemeanor in Oconto County case
21CM104 and having been released from custody under Chapter 969 Wis. Stats., did
intentionally fail to comply with the terms of his bond, contrary to sec. 946.49(1)(a) Wis. Stats.,
a Class A Misdemeanor, and upon conviction may be fined not more than Ten Thousand
Dollars ($10,000), or imprisoned not more than nine (9) months, or both.

Complainant is an Deputy District Attorney with the Brown County District Attorney’s Office and
knows of the above offense(s) on information and belief based upon:

PROBABLE CAUSE:

The complainant, being duly sworn on oath, swears that she has had the opportunity to review
the police reports of the Green Bay Police Department and other documents supporting this
complaint, which are the types of reports and documents kept in the ordinary course of
business, which complainant believes to be truthful and reliable because they have proven to
be truthful and reliable on numerous occasions in the past.

The complaint further asserts that based upon her review of the reports and/or supporting
documents, the incidents alleged in Brown County, Wisconsin.

1. Your complainant's review of the reports of Officer Steven Meisner of the Green Bay Police
Department, who indicates: On Sunday, January 29, 2023 I, Officer S. Meisner was notified of
a suspicious death investigation and responded to assist.

As part of the investigation I gained information that a person of interest in the case, Richard
Wendell Sotka DOB: /1974 had open cases out of Oconto County and an active
restraining order on him. Said reports indicated that as part of Sotka’s bond conditions in his
Oconto case, he was ordered to wear an electronic monitoring device which confirmed his
physical location. Said reports indicated that this device was being monitored by ADL
Monitoring Solutions.

Officer Miles Ganz and I accompanied Detective Phil Scanlan to ADL Monitoring Solutions
where Officers met with Tammy Ziegle and Rob Korth, agents with ADL Monitoring. They were
able to pull up GPS location records for Sotka and on review of those GPS records officers
learned that the monitoring device in which Sotka was wearing as part of his bond conditions in
Oconto County had been cut off and last pinged on the exit from US-41 southbound and
Freedom Road off-ramp in the City of Depere.

After meeting with ADL Monitoring, Officer Ganz and I responded to the monitoring devices
last known location. On arrival, Officer Ganz was able to locate the monitoring device in the
ditch between the off-ramp and US 41, City of Depere, Brown County, Wisconsin. I
photographed the monitoring device and Detective Biller came and collected the device as
evidence.

2. Your complainant's review of the reports of Det. Craig Pakkala of the Green Bay Police
Department, who indicates: On January 30, 2023, Detective Brad Biller and Detective Kevin

Kempf traveled to the Mississippi County Detention Center in Arkansas to interview Richard W.
Sotka DOB: /74. Said reports indicate Sotka was tracked, via the on-board data system on
the vehicle he was driving, stopped by the police, and arrested on a temporary felony warrant
entered into the system. From the information myself and other detectives obtained, Sotka was
on an electronic monitoring device and he left 1657 Elkay Lane in the City of Green Bay,
Brown County, Wisconsin at 2:35 AM and traveled through town and the monitoring bracelet
was disconnected at 2:54 AM on January 29, 2023 near US 41/CT Hwy S. In his interview,
Richard Sotka admitted to investigators he recalled "chucking" or "throwing" the bracelet out
the window of the truck but did not recall where. Based on the information collected, I am
referring a charge of Criminal Damage to Property to the Brown County District Attorney’s
Office. The electronic monitoring bracelet was located in the jurisdiction of Brown County.

3. Her review of the report of Captain Gary Richgels of the Green Bay Police Department
who indicates that the electronic monitoring bracelet of Richard Sotka was cut or torn off his
person causing damage to the device and making it inoperable. Said reports state that the
value of the bracelet is estimated at $500.00.

4. Her review of the Wisconsin Circuit Court Access Program (CCAP), which have been used
in the past and found to be reliable as they are records kept in the ordinary course of
departmental business. Said records indicate that on or about January 12, 2022, the
defendant, Richard W. Sotka (d.o.b. -74), was charged with felony/misdemeanor charges
of Stalking, misdemeanor Bail Jumping, Disorderly Conduct and Violate/Harassment
Restraining Order, and allowed to be released on bond with the condition that the defendant
commit no new crimes in Oconto County Case 22CF8. Said reports indicate that the Court
modified the Defendant’s bond on June 17, 2022 and included a condition that the Defendant
“must be on a bracelet”. Said bond and its conditions were in effect on or about January 29,
2023.

5. Her review of the Wisconsin Circuit Court Access Program (CCAP), which have been used
in the past and found to be reliable as they are records kept in the ordinary course of
departmental business. Said records indicate that on or about January 5, 2022, the defendant,
Richard W. Sotka (d.o.b. -74), was charged with misdemeanor Bail Jumping, and allowed
to be released on bond with the condition that the defendant commit no new crimes in Oconto
County Case 21CM177. Said bond and its condition were in effect on or about January 29,
2023.

6. Her review of the Wisconsin Circuit Court Access Program (CCAP), which have been used
in the past and found to be reliable as they are records kept in the ordinary course of
departmental business. Said records indicate that on or about July 28, 2021, the defendant,
Richard W. Sotka (d.o.b. -74), was charged with misdemeanor Battery-DVO and
Disorderly Conduct-DVO, and allowed to be released on bond with the condition that the
defendant commit no new crimes in Oconto County Case 21CM104. Said bond and its
condition were in effect on or about January 29, 2023.

Complainant believes the information received from the records of Wisconsin Circuit Court
Access Program (CCAP), the Brown County District Attorney’s Office and Clerk of Courts to be
true and accurate in that they are records kept in the ordinary course of business and it is in
the ordinary course of business to keep said records.
