MOTION TO FIX and POST BAIL
Respondents, through the Public Attorney’s Office, assisted by the undersigned counsel
and unto this Honorable Court most respectfully avers and states THAT:

1. Respondents were arrested on April 5, 2018 by elements of the Criminal Investigation

and Detection Group (CIDG), XXX in relation to the above-captioned case;

2. Thereafter, respondents were subjected to inquest proceedings and they opted to avail of
their right to undergo Preliminary Investigation. Consequently, they executed a waiver of
their rights under Article 125 of the Revised Penal Code;

3. At present, accused are detained at the XXXX Police Station;

4. Considering that the offense for which they are charged is a bailable one, respondents
most respectfully manifest their intention to avail of their right to bail;

5. Under the Bail Bond Guide of the National Prosecution Service, the amount of bail for
the offense for which the respondents are charged is TEN THOUSAND PESOS
(Php10,000.00)

6. Thus, respondents humbly implore the kind indulgence of the Honorable Court that the
bail for their provisional liberty be fixed at the said amount and that thereafter, they be
allowed to post bail;

7. Respondents undertake to appear before the Honorable Court whenever required and they
have no intention to evade from the prosecution of the above-captioned case;

PRAYER

WHEREFORE, premises considered, it is most respectfully prayed of the Honorable

Court that this motion be granted and that an Order be issued FIXING the amount of TEN
THOUSAND PESOS (Php10,000.00) EACH as bail for the provisional liberty of the
respondents and that thereafter, they be allowed to post bail in the said amount.

Other reliefs just and equitable under the circumstances are likewise prayed for.
