That's sad to hear that there has been confusion about SeaQuest being allowed to operate a petting zoo at this
location. Thank you for helping us to resolve this matter!
SeaQuest Stonecrest is only renting a portion of the building. Our leased area is 44,908 square feet total and the
aquarium exhibition area is 20,658 square feet.

Please see the attached files:
1. "SeaQuest Stonecrest - Current Census 2022-03-07": list of all animals on site currently, generated from our
animal care program. Each animal is listed by scientific name and common name and the report includes the
exhibit each animal is located in.
2. "SeaQuest Stonecrest Main Plans Drawing Revision 2": floor plan that indicates all animal exhibits by the
animal's common name. The exhibit labelled "armadillo" is currently inhabited by a tortoise as we do not have
an armadillo at this time.
It's important to note that all our animals are kept for exhibition, entertainment, and educational purposes only. Our
livestock species are not kept for agricultural purposes; they are kept only as petting zoo animals, not for the
production of eggs, milk, meat, skin, or fur. If we were to acquire donkeys, horses, or alpacas, they too would be for
petting and feeding only, not for use as pack animals, riding, or other agricultural labor or use. In the same manner,
some of our other animals which are considered game species, such as largemouth bass, are kept only for exhibition,
petting, and feeding purposes---they are not produced for human consumption or pond stocking.

We as a department have been discussing your project and proposals to bring in additional animals. It is our belief,
that you were permitted to operate at this location due to C-1 allows for “outdoor/indoor entertainment” use. As of
recent, the conversation to bring in animals such as cows, horses, other livestock and exotic animals is moving the
operation of this facility beyond the permissible use for this property.

We are now looking at an ordinance to put in place. Your location is at the mall; therefore, the most recent request for
cows is gearing towards agriculture activities in a commercial intended area.
At this time, please do not add any additional animals to your establishment until we can conclude how we plan to
handle this matter.
I do need to know how many animals are on site now? What type of animals? Please provide a floor plan to show
where the animals are located and/or kept inside the building? What is the square footage of the total building and
each area for the animals?

Sorry to bother you, but we are anxious to hear back regarding both our current animals and to know what
requirements we have to follow to get new livestock animals. As I mentioned previously, we've been working with
DNR to get all applicable permits for wildlife species, but we need to know if we have to follow the livestock
requirements specified in the city zoning ordinances.

I haven’t forgotten about you. I am doing some research on how your business came to be. Nothing in our code
permits this use in the C-1 zoning district, I don’t see where any building permits (electrical, plumbing, etc) were
ever pulled for your location. The only thing I am showing that was pulled is the business license.
Before I can say, yes to adding more animals, I need clarity from the personnel that were here before me. Most
of them have moved on. If I am not able to get the answers I need, I can look at putting legislation in place so
that you can continue to operate as a petting zoo/aquarium or we may look at a special land use permit.

To clarify, by "move forward with your proposal" you mean us wanting to get a mini cow, mini donkey, or
alpaca? To go back to the original question that spurred this entire email chain, do we need to consider the per-
animal square footage requirements of Chapter 27 Sec. 4.2.7, subsections E and I? Or since we aren't zoned for
agricultural use do we not need to follow those limitations and can follow industry standards as we usually do?
Also are you asking that we contact your department about any new species we acquire, or only if there are
significant changes to our operations? We have 10 SeaQuest facilities across the US and I don't think we ever
communicate to the zoning department after they give us the initial approval that our zoo/aquarium business
can be conducted at the desired location.

Thanks for adding that context. It definitely sounds like there's been some confusion somewhere!
I've added Chuck Findlay, our COO, to this email as he is looking into this on our end.
We have been working with the GA Department of Natural Resources and have exotic animal and native wild
animal permits for all species they regulate so no need to check into state laws. We can provide copies of our
permits on request, or we have been working with Wayne Hubbard of their Special Permits unit and you can
reach out to him if needed (wayne.hubbard@dnr.ga.gov, 770-918-6408).
We brand ourselves as a "petting zoo aquarium" and keep mammals, reptiles, birds, and invertebrates, along
with fish. I normally work on animal permitting only, not zoning, but was able to find a letter named "zoning
letter" in our files that states we can have wildlife and domestic animals at this location which I've attached to
this email.
I have also attached the tentative list of species we had planned for this location and had provided to DNR last
year while determining if we could build a SeaQuest at this location or not. I was under the impression this
same list was provided to Stonecrest City as well, but if so I was not on any of those emails.
I can get a list of the exact animals at our facility currently if necessary, but can assure you that we have many
protocols in place for the health and safety of our employees and the public and we are making sure to follow
all requirements of GA DNR, the GA Department of Agriculture, USFWS, and USDA (which we also hold a license
for exhibiting animals under the Animal Welfare Act).

I was told that the City allowed this as a temporary event due to an outdoor event your facility was having at
the time. It was not intended to be permanent. I was told the facility is under the use aquarium.
I will take a look at the business license to see what category you are under. The concerns we have is safety,
health concerns, and the specific types of animals that will be present. I will also look at State laws regarding
exotic animals and get back with you.

We keep some livestock and chickens---the chickens are in an indoor-only exhibit and the livestock are
in a combined indoor-outdoor area, outdoor most of the time but brought in at night or if there's
inclement weather. At first we thought this section may not apply to us at all, as we are not an
agriculture facility and are not using the animals for agricultural purposes; we are a petting zoo
aquarium that has wildlife, exotic animals, and also some farm animals.
When first discussing the possibility of opening a SeaQuest aquarium at the Stonecrest Mall, we
provided the city with a list of the types of animals we typically keep at our facilities, including the
livestock animals, and it was not indicated to us that there were any restrictions on what we had
proposed. However, before we acquire any more animals, we want to verify for sure if this section does
apply to us or not, so we can ensure we are meeting all requirements necessary.
E.2. With animals kept indoors and indoor-outdoor, does the minimum lot size apply? Does the
restriction on number of animals apply to us?
E.4. Does this maximum number of animals apply to us?
E.6. The indoor area is within the mall building. If these restrictions apply to us, does that mean
our indoor area does not apply to the fenced area size?
E.7. Would these housing space minimums apply to the indoor portion of our indoor-outdoor
area?
E.8. We keep domestic pigs (Sus scrofa domesticus) of which pot-bellied pigs are one breed.
Does this breed restriction apply to us?
I.1. We have our chickens in an indoor exhibit so they have no fenced yard area. Do we need to
provide them access to our outdoor area?
