    (To: Motion to Dismiss)

    The undersigned City Prosecutor, unto this Honorable Court, most


    respectfully manifest that the prosecution interposes no objections to the
    motion to dismiss on the ground that the warrantless arrest of the
    accused was illegal. The affidavit of the arresting officers contains
    allegations that are inconsistent with or contradictory to a fraglante
    delicto arrest. Moreover, there is no evidence that the place where the
    accused was arrested was used as a drug den.
